Risk Warning, Brazilian Jiu Jitsu Activities are Dangerous.
In this Waiver, Release and Indemnity I acknowledge and agree that:
Brazilian Jiu-Jitsu: means the martial art / fighting known as Brazilian Jiu-Jitsu
Brazilian Jiu-Jitsu Training and Activities: means the training and activity regime utilised to teach Brazilian Jiu-Jitsu
Gracie Barra Hornsby: means Gracie Barra Hornsby PTY LTD
"I" or "Participant": means the person who signs the Waiver, Release and Indemnity against the heading 'Participant' below OR where the participant is under 18 years of age means the participant identified under the heading ' Participant's Details' below and where the context permits also means the Participant's Parent who signs this Waiver, Release Indemnity.
The status of a "Participant" may include a person 'trying out' any training or activities at Gracie Barra Hornsby including current member, lapsed member, resuming member, or any other person including 'walk ins' that a representative of Gracie Barra Hornsby has agreed may participate.
This waiver, release and indemnity continues to apply whether the status of the participant changes (e.g. a person trying out becomes a member, this release continues to apply)
"My" means the Participant and "me" has corresponding meaning.
"Venue" means the facility being used by Gracie Barra Hornsby to conduct any activities or training.
1. Waiver, Release and Indemnity
1.1. I acknowledge the inherent risks of Brazilian Jiu JItsu Training and Activities and the possibel consequences of serioes injury and even fatality. Without limiting this acknowledgement, I acknowledge that it just may result due to strenuous exercise of high velocity and high impact or repetitive movement and that I may suffer harmfull physical contact as a consequence of technique delivery, evasion or apllications of counter techniques by me or another person.
1.2. In consideration of, and as a condition of Gracie Barra's acceptance of my involvement in Brazilian Jiu-Jitsu Training and Activities, I agree to participate in Brazilian Jiu Jitsu Training and Activities entirely at my own risk.
1.3. I agree that I am voluntarily participating in Brazilian Jiu Jitsu Training and Activities.
1.4. I agree that I assume all risks of Injury, illness and even death.
1.5. I acknowledge that I am responsible for any loss of or damage to my personal property arising from my participation in or attendance at Gracie Barra Hornsby for Brazilian Jiu-Jitsu Training and Activities.
1.6. I acknowledge that I may choose not to participate in any particular Brazilian Jiu Jitsu Training and Activities. I acknowledge that the decision to refrain from participation is entirely my responsibility.
1.7. I agree to inspect the Venue and all equipment to be used for Brazilian Jiu Jitsu Training and Activities prior to use and further agree only to participate in Brazilian Jiu Jitsu Training and Activities if I am satisfied with the adequacy and condition of the Venue and equipment.
1.8. In relation to any medical condition or injury that I currently have or may have in the future:
1.8.1. I acknowledge to advise and keep Gracie Barra Hornsby updated in relation to any medical condition or injury that may affect or may be affected by my participation in Brazilian Jiu Jitsu Training and Activities. I agree to do this as soon as practicably possible should any of my information change.
1.8.2. I declare that (regardless of any advice i have given or may in the future give to Gracie Barra Hornsby) I am medically fit (physically and mentally) to participate in the Brazilian Jiu Jitsu Training and Activities of Gracie Barra Hornsby.
1.8.3. I agree that the medical conditions and injuries referred to above and advised to Gracie Barra from time to time shall not in any way limit the operation of this Waiver, Release and Indemnity.
1.9. I, for my self, my heirs, executors and administratios, waive release and discharge Gracie Barra Hornsby and Gracie Barra Hornsby Representatives from all claims or causes of action I may have (including negligence) arising from any injury, illness or death and/or loss or damage to any property arising either directly or indirectly out of my attendance at or participation in Brazilian Jiu Jitsu Training and Activities AND I indemnify Gracie Barra Hornsby and Gracie Barra Hornsby Representatives against all costs, losses or damages arising from or in relation to My attendance at or participation in Brazilian Jiu Jitsu Training and Activities.
1.10. I acknowledge that this Waiver, Release and Indemnity does not have an expiry date and shall apply at all and any times I participate in Brazilian Jiu Jitsu Training and Activities with Gracie Barra Hornsby.
