By placing an order with The Arch Glow Co, you agree to the following:
Introduction
These Terms & Conditions govern the hire of party equipment from The Arch Glow Co (referred to as "the Owner") to the customer (referred to as "the Hirer"). By placing an order, the Hirer agrees to be bound by these Terms & Conditions.
Booking & Payment
A $50 non-refundable deposit is required to secure the booking. This deposit will be deducted from the total hire cost. The $50 non-refundable deposit is due when securing your booking, the remaining balance is due one week before the event.
We charge a $50 fee for setup and pack-down to ensure a seamless experience for your event.
A $50 Security Bond is required in addition to the hire cost. The bond will be refunded within 1-2 business days after the event, provided there are no damages, losses, or breakages to the equipment.
Payments can be made via the infomation provided on your invoice and must be completed in full prior to the event
Cancellations & Refunds
Deposits are non-refundable.
If the Hirer cancels the booking within 14 days of the event, the full hire amount will still be charged.
The Owner reserves the right to cancel the booking at any time due to unforeseen circumstances, in which case the Hirer will receive a full refund of all payments made.
Delivery & Collection
The Hirer is responsible for ensuring clear access to the event location, and any delays caused by inaccessible venues may result in additional charges.
Delivery is free within Horsham a travel fee of $1 per kilometer for locations outside this area.
A blanket 24-hour hire period applies, with equipment collection at 11am the next day unless otherwise arranged.
Collection of equipment will be done by The Arch Glow Co, unless otherwise agreed. The Hirer must ensure all equipment is safely packed and left in a secure location, as confirmed through communication with The Arch Glow Co, and ready for collection at the agreed time.
Use of Equipment
The Hirer is responsible for the proper use, handling, and care of the equipment throughout the hire period.
The Hirer agrees not to misuse, modify, or alter any equipment in any way. The Hirer agrees to follow all safety guidelines provided by The Arch Glow Co during the hire period.
The Hirer is also responsible for ensuring that all equipment is used in accordance with its intended purpose.
The Owner will not be liable for any injury, loss, or damage caused by the Hirer’s misuse, neglect, or failure to follow the provided guidelines. The Hirer assumes full responsibility for any harm, damage, or injury resulting from the improper use of the equipment.
Damage, Loss & Liability
The Hirer must inform the Owner immediately of any damage, breakage, or loss of equipment.
If any equipment is damaged, lost, or broken during the hire period, the Hirer will be liable for repair or replacement costs, which may be deducted from the Security Bond.
In the case of extensive damage or loss, the Hirer will be charged the full replacement cost, which may exceed the Security Bond amount. Any excess will be charged to the Hirer’s credit card.
The Hirer agrees to return all equipment in the same condition as it was provided.
Indemnity
The Hirer assumes all risks associated with the use of the hired equipment.
The Hirer agrees to indemnify and hold the Owner harmless from any liability, damages, losses, or claims arising from the use of the equipment.
The Hirer releases the Owner from any responsibility for injury or damage to persons or property caused by the use of the equipment.
The Hirer agrees to pay for any legal costs incurred by the Owner due to a breach of these Terms & Conditions.
Force Majeure
The Owner shall not be held liable for any failure to deliver, set up, or collect equipment due to circumstances beyond their control, including but not limited to natural disasters, government restrictions, or other unforeseen events.
