This Equipment Rental Liability Waiver and Release Agreement (the "Agreement") is made and entered into by and between:

"The Business", Rose from Concrete, LLC  and "The Renter"

Terms & Conditions

 

1. Assumption of Risk

By signing this Agreement, the Renter acknowledges and agrees that renting and using the "X-Stage Lite" (Stage Pole) involves risks, including but not limited to personal injury, property damage, and other
unforeseen risks. The Renter voluntarily assumes all risks related to the use, operation, and possession of the rented equipment.

 

2. Waiver and Release of Liability

The Renter agrees to waive, release, and discharge "Rose from Concrete, LLC", its owners, employees, agents, and affiliates from any and all claims, demands, damages, costs, expenses, and liabilities arising from or related to the Renter's use, operation, or possession of the equipment, including claims arising from negligence.

 

3. Indemnification

The Renter agrees to indemnify and hold harmless "Rose from Concrete, LLC" from any claims, damages, or expenses (including legal fees) arising from or related to the Renter's use or possession of the equipment, including damages caused to third parties.

 

4. Responsibility for Damage or Loss

The Renter agrees to take full responsibility for the care, custody, and control of the equipment during the rental period. The Renter shall reimburse "Rose from Concrete, LLC" for any damage, loss, or theft of the equipment occurring while the equipment is in the Renter's possession, whether due to negligence or otherwise.

Fees for Damages could range from $100-$1000 based on the damage incurred during the time of rental. Damages considered to be paid for by The Renter include but are not limited to: base damage, base stain, pole scratches or stripping of the pole, etc. 

 

5. Condition of Equipment

The Renter acknowledges that the equipment was inspected prior to rental and is in good condition. Any pre-existing damage or defects must be documented in writing before the rental period begins. 

 

6. Prohibited Uses

The Renter agrees not to use the equipment in an illegal, unsafe, or inappropriate manner. 

 

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia.

 

8. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes any prior or contemporaneous agreements, whether written or oral.

 

9. Acknowledgment

By signing below, the Renter acknowledges that they have read and understood this Agreement and voluntarily agree to its terms.
