16. Stallholders Code of Conduct and Responsibilities
Stallholders should take all reasonable steps to read and understand all terms and conditions.
Submission of an application is accepted as agreeance that the stallholder will comply with the terms and conditions, including those listed in pre-event documents.
Stallholders are not just representing themselves but are also representing the WQM and are part of a wider team environment and be mindful of maintaining a positive and supportive mindset of those around them.
- Positive representation should extend to any comments or posts on social media.
- Stallholders should work to ensure that their stall and their personal presentation are of a suitable standard and enhance and be a positive contribution to the atmosphere of the market.
- Stallholders should ensure that goods are of a high standard at all times.
- Stallholders should be mindful that fellow vendors are part of the same team, not rivals or competitors.
- Stallholders should be mindful of intellectual property law and copyright legislation.
- Stallholders must respond co-operatively to any direction given by the manager or representative in relation to the operation and occupation of their stall, equipment, goods and vehicle during operating times and any direction of a security or safety nature.
- Please do not block or obstruct other stall holders, infringe on their space or otherwise interfere with their stall or personal space and please respect their boundaries.
- Please be mindful of any excess noise levels including during set up and pack up times.
- Loud product promotion by stallholders (spruiking) is not permitted.
- Music broadcast by stallholders is not permitted. This includes Bluetooth speakers.
- Stallholders must not act in a verbally or physically abusive, dangerous, or disruptive manner. It will not be tolerated and will result in immediate termination of this agreement.
- Stallholders must ensure that their activities or equipment do not endanger the safety or security of any people at the event.
- Stallholders must not cause damage, make alterations or additions of any nature to, or carry out works of any nature to market site property and that, if any damage is caused, the costs of any repairs, making good or replacement are borne by the stallholder.
- Stallholders must immediately report to the manager any incident or accident to any person or property that involves loss, damage or could be expected to give rise to a claim. Retrospective claims or reports cannot be actioned.
- Stallholders are required to be present at their stall during the market, this includes young entrepreneurs.
- Stallholders should operate with a degree of flexibility with changing conditions on site, including but not limited to adverse weather issues, end of trade variabilities and any necessary site changes.
- Stallholders are welcome to provide feedback regarding any WQM concerns.
- Stallholders that have concerns about any aspect of the market should contact the manager either via email or on site.
- Stallholders are requested to refrain from defaming, spreading misinformation, or implying negativity about the market or any vendor, as this may have adverse effects on other vendors by association. This includes word of mouth and social media.
- You are an integral part of the market and we encourage you to seek out the manager at the WQM info table if you have any complaints, grievances or suggestions for improvement and a feedback form will be provided to you.
- If the matter is not able to be satisfactorily resolved by the WQM manager, this feedback document will be presented at the next available committee meeting, with any potential outcome reported to you as soon as possible.
17. Event Manager and Market coordinator responsibilities
The market organiser will work to:
- Organise and manage the market and to oversee and manage all operations on and off site, prior to and during events.
- To advertise and support the event marketing of the event and vendor interests.
- To promote communication and community engagement.
- Maintain best possible communication with all vendors and event managers on an ongoing basis.
- Keep vendors advised of any changes and updates including trading hours as affected by visitor numbers, weather or other
- Develop strategies and make improvements to the market, including to operations to ensure best practise and opportunities for vendor sales and market attendance.
- Be available to support and assist stallholders with matters including but not limited to visual merchandising, marketing, stall layouts and general presentation that may lead to improvements of the stallholders’ market experience and potential sales.
- Be available on site for the duration of the event and until all vendors have vacated the location.
- To ensure that provision is made for the collection of any feedback from stallholders and visitors.
- To work to ensure that the interests of both stallholders and WRP are supported.
The market manager reserves the right to undertake any of the following actions:
- Take photographs of the market, any stallholder, stall, display or product and to use any recorded image for the purpose of promoting the WQM and its participants.
- Re-locate or otherwise shift a stall/stallholder to another site within the event space if necessary.
- Request a stallholder to remove from sale any goods or services offered by the stallholder which were not stated in the original application form and/or are not prior approved products.
- Request a stallholder remove from sale any goods that are duplications or copies of another stallholder or artist’s work or is considered an infringement of intellectual property.
- Request that the stallholder undertake any reasonable measure to improve the safety of the stall.
- Request that the stallholder undertake any reasonable measure to improve appearance and standard of their good, their stall and presentation.
- Request that the stallholder make alterations to their stall or display where it interferes with another stallholders allocated space or activities. This included removal of signage if it infringes on another vendor’s space
- Request the departure of any stallholder who does not adhere to the terms and conditions or to directives given during the event.
- Request the departure of any stallholder or associate that acts in a hostile or belligerent manner and acts in a way which may be dangerous to themselves, to others or others’ property, or the venue.
- Remove a vendor from mailing lists.
- Terminate a stallholder agreement and revoke any right to trade.
- Terminate a 6MPA agreement.
- To remove or cancel any stallholder agreement for vendors that fail to respond to emails or invitations and remove them from the mailing list for future invitations.
- Vendors that have been removed from stallholder mailing or invitation lists may be required to reapply.
- The manager reserves the right to make addition or amendment to the terms and conditions as a response to any incident or feedback received and to improve the event for both visitors and market vendors on an ongoing basis. This includes feedback and requests received from WRP exec committee representatives.
- Any addition or amendment will be forwarded to all relevant parties in writing, either within a supplementary document or as part of the pre-event information package.
Termination of stallholder agreements
A : Stallholder seeking withdrawal of application or agreement
- Vendors may cancel their application at any time or otherwise request to be removed from invitations and mailing lists.
- If this cancellation of application includes cancelling a site booking, it is subject to the same conditions as any other stall cancellation, ie if made less than 48 hours prior to the market, the stallholder is still liable for site payment.
- Vendors who have 6MPA agreements may apply for any eligible funds to be refunded when withdrawing their application.
B : Termination of stallholder agreement by manager
Stallholders, participants or visitors that disregard or are in breach of the terms of conditions will be:
1st instance : Reminded of or have the conditions, or condition in question, brought to the stallholder’s attention with the aim to discuss and resolve any issue.
2nd instance : Receive a verbal warning and request stallholder follow the terms and conditions.
3rd instance : Receive a written warning via email which will also be forwarded to the WRP executive committee. This information may also be made available to other WRP event managers including festival organizers.
4th instance : The stallholder will have their agreement cancelled and will no longer be permitted at WQM or potentially any other WRP event.
Vendors with a 6MPA will have any eligible credit refunded if their stallholder agreement right to trade is terminated.
Instant termination of agreement and removal from event will occur if a stallholder:
- Acts in a hostile manner to intimidate, threaten or cause upset to any vendor, volunteer or management.
- Deliberately acts to damage Willunga Rec Park property or any properties belonging to stallholders, volunteers or management.
- Sells, promotes or makes available in any way, any prohibited item, including vapes or tobacco, as well live animals etc
- Sells, promotes or makes available in any way, alcohol to minors. This includes the sale of sealed containers, purchasing and providing sealed containers or served alcohol or any tasting samples.
- In addition the matter may also be reported to SAPOL.
- Any member of the public that engages in any of the above will be reported to SAPOL
