Kwanda Kinetics Child Development And Therapy Centre is a private Kinderkinetics practice in South Africa.
In terms of Section 11 of the Electronic Communications and Transactions Act 25 of 2002, as amended ("ECTA"), the following Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Kwanda Kinetics, in relation to your child participating in Kwanda Kids and your access to the Kwanda Kinetics website. If you do not agree to the following Terms and Conditions, do not accept and sign your Kwanda Kids contract.
By agreeing to these terms and conditions, you hereby declare that your child is healthy and you give permission for him/her to participate at his/her own risk in Kwanda Kids, a Kinderkinetics® program offered by Kwanda Kinetics.

You further take note of the most important clauses:
✓ Kwanda Kids is offered only during public school terms. A minimum of 32 lessons per year is guaranteed, which includes 2 individual assessments as well as 2 professional reports per year.
✓ You take note that the assessment periods last 2 - 3 weeks, during which your child will be taken individually to be assessed by the school's Kinderkinetics. Please note that no lessons will take place during the assessment period.
✓ Classes are protected by copyright and as such all content of the classes, whether written, oral or physical movements, may not be reproduced, processed or displayed in whole or in part in any media form, nor may it be used for commercial gain without the written permission of Kwanda Kinetics.
✓ You hereby irrevocably indemnify Kwanda Kinetics and their staff from any loss, illness, injury, damage and/or death that may be suffered by your child and/or your child’s property as a result of either direct or indirect participation in the Kwanda Kids program. You hereby waive any right and renounce any claim that you, your child and/or the school may have to claim compensation from Kwanda Kinetics for any loss, illness, injury, damage and/or death as a result of your child’s participation.
✓ Unfortunately, you will not qualify for any deduction, discount or refund due to your child’s absence or withdrawal from any or all of the lessons contracted to relieve you of your obligations under this agreement and you understand that full term fees are still payable.
✓ Kwanda Kinetics reserves the right to terminate lessons if fees are in arrears. However, this clause may not be abused to exempt yourself from your obligations under this agreement.
✓ A registration fee of R200 must be paid when you enrol your child. This is a one-off annual fee.
✓ The programme fee is R675 per term OR R270 per month (10 instalments from February to November).
✓ A 10% discount is available if a sibling also enrols for the programme
✓ For administration and security reasons, no cash payments are allowed. An invoice will be send once we have received your enrollment form. You will then be able to make an EFT payment upfront for the term, using your child’s name AND surname as a reference.
By signing these terms and conditions as well as the disclaimer, you hereby acknowledge that you have read and understood the contents of this electronic online document. You also accept all the terms and conditions relating to the Kwanda Kids programme.

As jy nie met die volgende Bepalings en Voorwaardes saamstem nie, moenie jou Kwanda Kids-kontrak aanvaar en onderteken nie.
Deur tot hierdie bepalings en voorwaardes in te stem, verklaar jy hiermee dat jou kind gesond is en gee jy toestemming dat hy/sy op eie risiko mag deelneem aan Kwanda Kids, 'n Kinderkinetika®-program wat deur Kwanda Kinetics aangebied word.

Jy neem verder kennis van die belangrikste klousules:
✓ Kwanda Kids word slegs tydens openbare skoolkwartale aangebied. 'n Minimum van 32 lesse per jaar word gewaarborg, wat 2 individuele assesserings sowel as 2 professionele verslae per jaar insluit.
✓ U neem kennis dat die assesseringsperiodes 2 - 3 weke duur, waartydens u kind individueel geneem sal word om deur die skool se Kinderkinetikus geassesseer te word. Neem asseblief kennis dat geen lesse gedurende die assesseringsperiode sal plaasvind nie.
✓ Klasse word deur kopiereg beskerm en as sodanig mag alle inhoud van die klasse, hetsy dit geskrewe, mondelinge of fisiese bewegings is, nie in geheel of gedeeltelik in enige mediavorm weerspieël, verwerk of vertoon word nie, en ook nie vir winsgewende gewin gebruik sonder die geskrewe toestemming van Kwanda Kinetics.
✓ Jy vrywaar hiermee Kwanda Kinetics en hul personeel onherroeplik van enige verlies, siekte, besering, skade en/of dood wat deur jou kind en/of jou kind se eiendom opgedoen mag word as gevolg van óf direkte of indirekte deelname aan die Kwanda Kids-program. Jy doen hiermee afstand van enige reg en verloën enige eis wat jy, jou kind en/of die skool mag hê om vergoeding teen Kwanda Kinetics te eis vir enige verlies, siekte, besering, skade en/of dood as gevolg van jou kind se deelname.
✓ Ongelukkig sal jy nie kwalifiseer vir enige aftrekking, afslag of terugbetaling weens jou kind se afwesigheid of onttrekking van enige of al die lesse wat gekontrakteer is om jou van jou verpligtinge ingevolge hierdie ooreenkoms te onthef nie en jy verstaan dat volle termynfooie steeds betaalbaar is.
✓ Kwanda Kinetics behou die reg voor om lesse te beëindig indien fooie agterstallig is. Hierdie klousule mag egter nie misbruik word om jouself te vrywaar van jou verpligtinge m.b.t. hierdie ooreenkoms nie.
✓ Jy aanvaar aanspreeklikheid vir die betaling van een kwartaal se geskrewe skriftelike kennisgewing sou jy die klasse wil beëindig.
✓ 'n Registrasiefooi van R200 moet betaal word wanneer u u kind inskryf. Dit is 'n eenmalige jaarlikse fooi.
✓ Die programfooi is R700 per kwartaal OF R280 per maand (10 paaiemente van Februarie tot November).
✓ 'n 10 % afslag is beskikbaar indien 'n boetjie/sussie ook vir die program inskryf.
✓ Vir administrasie sowel as sekuriteitsredes word geen kontantbetalings toegelaat nie. 'n Invoice sal aan u gestuur word sodra u kind se inskrywingsvorm ontvang word waarna u 'n EFT betaling vooruit vir die kwartaal kan maak. Gebruik asb. u kind se naam en van as verwysing vir enige betalings.
Deur hierdie bepalings en voorwaardes sowel as die vrywaring te onderteken, erken jy hiermee dat jy die inhoud van hierdie elektroniese aanlyn dokument gelees en verstaan het. Jy aanvaar ook al die bepalings en voorwaardes wat verband hou met die Kwanda Kids-program.
