**If under the age of 18 you must have a parent or legal guardian sign this waiver before you may participate in any activities at or for ROAR Florida.
The Volunteer desires to work as a volunteer for ROAR FLORIDA and engage in the activities related to being a volunteer (the “Activities”). In order to participate in ROAR FLORIDA volunteer opportunities and all related activities, including any activities incidental to such participation the undersigned Volunteer (hereafter referred to using “I”, “me”, or “my”) releases and agrees not to sue ROAR FLORIDA or its officers, directors, employees, sub-contractors, sponsors, agents, and affiliates (“the Organization”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property loss or damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however they may occur.
Volunteer further agrees not to assist in the prosecution of any legal action filed by another, arising out of an injury to the person or property of the Organization while participating in Volunteer Activities. This covenant extends to include the heirs, executors, administrators, or assigns of the Member.
The Volunteer freely, voluntarily, and without duress executes this Release under the following terms:
I understand and agree that the Organization is not responsible for any injury, property loss, or damage arising out of the Volunteer Activities, even if caused by ordinary negligence or otherwise.
I understand that this Release discharges the Organization from any liability or claim against the Organization with respect to any personal injury, illness, death, or property damage that may result from the Volunteer’s Activities with the Organization, whether caused by the negligence of the Organization, its officers, directors, employees, or agents or otherwise. I also understand that the Organization does not assume any responsibility or obligation to provide financial or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness. I agree to participate in the Volunteer Activities with knowledge of the potential danger involved and I agree to accept all risks of participation.
I also agree to indemnify and hold harmless the Organization for all claims arising out of my participation in the Volunteer Activities.
I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which Volunteer Activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
I also acknowledge that the Organization has not arranged and does not carry any insurance of any kind for my benefit. I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in Volunteer Activities.
Any controversy or claim between the parties arising out of this Agreement must be settled by binding arbitration in Polk County, Florida before a mutually agreed upon qualified arbitrator in lieu of judicial proceedings. If the parties cannot agree on an arbitrator, then either party may petition a court of competent jurisdiction for the appointment of a qualified arbitrator. The arbitrator will have no power to change the provisions of this Agreement but shall have the power to decide all issues in controversy. The determination of the arbitrators will be conclusive and binding upon the parties to this Agreement, and judgment upon the award rendered may be entered in accordance with applicable law in any court having jurisdiction thereof. The prevailing party shall be entitled to an award of reasonable attorney fees and costs.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflicts of law’s provisions.
I also understand that this document is a contract that grants certain rights to and eliminates the liability of the Organization.
I give ROAR FLORIDA permission to use photos or videos taken of me during my time as a volunteer at their discretion (social media posts, website, etc.).
I am of legal age and am freely signing this agreement. I have read this form and understand that by signing this form, I am giving up legal rights and remedies.
I give my permission to ROAR Florida's Event Committee members to contact me about the specific events checked below and keep on record my contact information for future events and activities.
