Terms and Conditions of Liability
Program Participation and Risks
By enrolling my child/ward (“Participant”) in the Higher Learning Performing Arts Program (“Program”), I understand that the Participant will take part in creative activities including drama, dance, movement, and music, which may involve physical risks. I accept these risks and acknowledge that the Program will take all reasonable steps to ensure participant safety.
Public Liability and Waiver
The Program is delivered in venues covered by public liability insurance. While general protections are in place, I agree to release Higher Learning Performing Arts, its staff, volunteers, and affiliates from any liability for personal injury, property damage, or other loss, except in the case of proven gross negligence.
Medical Authorization
In case of an emergency, I authorize the Program to seek necessary medical treatment for the Participant. I understand I will be responsible for any medical expenses. The Program will make every effort to contact me or the listed emergency contact prior to action.
Behaviour and Conduct
Respectful, responsible behaviour is expected at all times. The Program reserves the right to suspend or remove a Participant due to disruptive, unsafe, or disrespectful behaviour. No refund or guarantee of re-entry will apply in these cases.
Ownership of Creative Work
All creative works developed within the Program—including scripts, performances, writings, recordings, and artworks—remain the intellectual property of Matai Arts & Innovation / Higher Learning, unless otherwise discussed and agreed upon in writing. Participants may receive access to copies or media for personal use, but commercial or public use must be approved.
Media Release
I grant permission for images, video, or audio of the Participant to be captured and used for Program promotion, documentation, or educational purposes across print, digital, and social platforms. No compensation will be provided.
Data Protection
I agree to the collection, storage, and use of my child’s personal information for Program administration, safety, and communication purposes, in line with Australian privacy laws.
Fees and Fundraising
While the Program is free to attend, families are expected to support the continuation of the Program through:
Voluntary donations, or
Active participation in fundraising initiatives
This helps cover resources, food, transport, and staffing.
Food and Dietary Needs
Light meals or snacks may be provided during Program sessions. If the Participant has any dietary requirements, allergies, or restrictions, it is the parent/caregiver’s responsibility to notify the Program staff in advance.
Attendance and Communication
Regular attendance is vital. If a Participant cannot attend a session, parents/caregivers must inform the Program in advance.
Failure to attend two or more sessions without communication may result in the space being offered to another student on the waiting list.
The Program will provide updates and information through accessible communication methods (e.g. text, phone call, in person, or digital notices). It is the responsibility of parents/caregivers to stay informed and respond when needed.
Program Leadership and Delivery
The Program is led by professional artists and educators who may adjust content and delivery to best serve the group. By enrolling, I acknowledge and support the Program’s flexibility to evolve and be delivered at a high standard, led by the creative vision of its facilitators.
Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be addressed under this jurisdiction.
Agreement
By ticking the box below, I confirm that I have read, understood, and agree to these Terms and Conditions. I certify that I am the legal guardian of the Participant and have the authority to enrol them.
