Applicant Terms & Conditions
I (applicant) warrant that all necessary skills, experience, and education to
perform the necessary job duties are honest and accurate. I (applicant) have no
doubt that I am able to perform job functions based on my
qualifications/licensing/certification and all information stated in the application,
resume and other pertinent documentation.
I (applicant) will keep all personal information private and refrain from disclosing
my information to the dental office. It is also my responsibility to refrain from
sharing any of my personal information with any office staff while on temporary
assignment or interview/working interview. In doing so, it is a breach of contract
and can result in legal ramifications.
Temporary/Permanent Placement:
For temporary assignments, we will connect with you via text/email/call
regarding necessary job details (location, rate of pay, contact information). You
are encouraged to familiarize yourself with job location. Please call the office in
advance of a temporary work assignment to introduce yourself and confirm your
date of work.
For permanent placement, we will connect with you via text/email/call regarding
necessary job details (location, rate of pay, contact information). We highly
encourage/recommend you do no less than 2 working interviews post initial
in-person interviews to see if the office fits your work needs. The working
interviews are paid at the temporary assignment fee. An interview is a non-paid
assignment. Please remember if days or hours of work increase from the initial
agreed upon assignment, you are required to notify smile dental staffing of any
additional changes. It is your responsibility to inform smile dental staffing
immediately of any additional changes to your work schedule (increased hours
or days of work), regardless of when they occur.
Non-Guarantee Disclosure:
Smile Dental Staffing (SDS) does not promise or guarantee any referrals on
behalf of applicants. We do not give any preference over any other applicant
registered with Smile Dental Staffing (SDS).
Non-Discriminatory Statement:
We do not discriminate against any potential candidate based upon sex,
race, sexual orientation, gender, religion, age, disability and/or national
origin.
Late Assignment Cancellation Notice:
If an assignment is canceled by the dental office on a short notice (less than 12
hours), Smile Dental staffing will attempt to negotiate a minimum of a half day
(4 hours) of pay for a full day (8 hours) assignment These attempts do not
guarantee pay and Smile Dental Staffing (SDS) is not responsible for any lost
time/wages.
An applicant should not accept an assignment and attempt to cancel less than
24 hours in advance of scheduled assignment. If an applicant repeatedly
cancels scheduled assignments, he/she will be less likely to be placed by our
recruiting service.
Applicants must adhere to the highest standards of professionalism. If a
candidate reports late to assignment or does not show-up to scheduled
assignment, he/she may be subject to discontinued job placement. However, if
the candidate has and can show reasonable evidence for tardiness or absence,
Smile Dental Staffing (SDS) will use its sole discretion to place applicant in
future assignments.
Assignment Rejection:
The applicant may reject any/all and/or portion of any assignment(s) for any
reason. Rejecting an assignment does not penalize you and shall not reflect
on any subsequent placement. Smile Dental Staffing (SDS) is not obligated to
give any applicants preferences over another with similar qualifications.
Employer Feedback Disclosure
Dental office will be given an applicant feedback form regarding applicant(s) job
performance. Both negative and positive feedback will be placed in applicants
file and may considered towards future placement/services.
Terms/Services Agreement:
Smile Dental Staffing (SDS) is a temporary and permanent referral staffing
agency. The applicant understands and agrees that he/she is not an employee
of Smile Dental Staffing (SDS). Applicant understands that he/she is
compensated solely by the dental office for his/her/their employment services
performed to which he/she/they were referred by Smile Dental Staffing (SDS).
Applicant understands that the assigned dental office is fully responsible for
payment of employee wages, taxes, deductions, workers compensation
coverage, unemployment benefits and any/all other services performed by
the undersigned employee.
Any employment claims consisting of but not limited to: applicant injury, failure to be paid, timelines of pay, sexual harassment, emotional distress and any/all
other issues related to the employee’s experience in the dental office are not
considered a liability claim against Smile Dental Staffing (SDS).
Applicant warrants and represents he/she/they does/will not seek any
compensation from Smile Dental Staffing (SDS) directly. If the applicant seeks
such compensation, this will result in a violation of this agreement. Smile
Dental Staffing will then seek a legal case against the applicant.Applicant will
be responsible for all attorney/expert fees and/or costs incurred by Smile
Dental Staffing (SDS) in defending itself against these claims. Smile Dental
Staffing (SDS) is not a “direct employment agency”. Smile Dental Staffing
(SDS) has the right to refuse services to any potential applicant provided
refusal is not based on discriminatory grounds.
The applicant agrees to notify Smile Dental Staffing (SDS) of any assignments
offered by any dental office with whom they were referred to and/or placed at by
our agency for temporary and/or permanent position(s) within a 365-day period
from the last day worked in a dental office that was a direct result of our referral.
Applicant is responsible for notifying Smile Dental Staffing (SDS) if any term
and/or assignment is extended or shortened. Such notifications should be
communicated to Smile Dental Staffing (SDS) as soon as the changes in
assignment occur.
Applicant understands that all job assignments with a dental office where Smile
Dental Staffing (SDS) is responsible for employee referral must be conducted
through Smile Dental Staffing (SDS) services. Regardless of any/all previous
contact including but not limited to employee application submission,
resume/cover letter submission, 3rd party referral and any/all conducted
interviews between applicant and dental office prior to the signing of this
agreement.
If applicant does not notify Smile Dental Staffing (SDS) of additional
assignments, this will be considered a breach of agreement and will constitute
the relationship between Smile Dental Staffing (SDS) and applicant no longer
valid.
When an applicant is placed temporarily or permanently by Smile Dental
Staffing’s (SDS) recruiting efforts, the applicant agrees to comply with all
policies and procedures of dental practice.
Applicant understands that California is an “at will employment” state, thus
employers can terminate the applicant from temporary and/or permanent
position at any time.
Confidentiality/Privacy Agreement:
Confidential information is defined as any information found in the patient’s
medical record, personal information, and/or work-related information
(including salary information). All information relating to a patient’s care,
treatment, and/or condition constitutes confidential information. This
confidentiality policy also encompasses any trade secret(s), scientific and/or
technical information developed by the practice or its personnel.
Applicants should never discuss a patient’s condition with any non-employee
of the practice, friends, and/or family members. Confidential matters involving
patients will not be discussed in areas where they might be overheard by
other patients and/or other non-employees of the practice.
I consent to the full extent of this agreement made between myself and Smile
Dental Staffing (SDS) and this supersedes any/all other prior understandings,
conversations, and proposals. This agreement is not to be amended, unless
there is a written/signed and dated agreement by all parties involved. Once
signed below,all parties agree any reproduction of the agreement made by
means of fax, scan, photocopy, electronic signature and any other reliable
means are considered an original document. Additionally, I give Smile Dental
Staffing (SDS) permission to conduct a reference check verification.
All signature below certifies that I have not knowingly withheld any information that
might affect my employment referral and that all answers given on this application
are correct and true to the best of my knowledge. I understand all information in
this application is subject to verification and any/all false statements or omissions
of pertinent information may lead to dismissal if hired.
