WAIVER
Applicant agrees to waive any and all claims of whatever nature against The Locals Mix™.
RELEASE
Applicant grants permission and an unconditional release of any photographs, video or motion pictures, and/or verbal or written statements for use by the promoters of the event for any legitimate purposes, including, but not limited to, publicity, promotions, fundraising, and/or websites.
RULES AND REGULATIONS
- The artist agrees that their music is their own intellectual property and does not violate any copyright laws.
- All applicants must treat fellow artists, staff, and volunteers with respect or risk being removed from the event without a refund.
- The Locals Mix™ reserves the right to accept or deny applicants who do not adhere to these rules or other application guidelines.
- Each applicant is responsible for the security of their space and equipment. Event staff cannot be held responsible for any loss or damage.
- Applicants will be held legally and financially responsible for all damages to grounds or other property caused by themselves or their employees.
- We ask that applicants follow current CDC guidelines during events.
1. Release. I hereby fully and forever release and discharge The Locals Mix® from, and expressly waive, any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that may arise from my participation in the any event involving The Locals Mix®. I agree not to make or bring any such claim or demand against The Locals Mix®, and fully and forever release and discharge The Locals Mix® from liability under such claims or demands.
2. Insurance. I UNDERSTAND THAT, EXCEPT THE LOCALS MIX® DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE OF ANY NATURE OR LOSS OF MY PROPERTY. I expressly waive any claim for compensation or liability on the part of The Locals Mix® in the event of any injury or medical expense.
3. Indemnification. I hereby agree to indemnify, defend, and hold harmless The Locals Mix® from any and all liability, losses, damages, judgments, or expenses, including attorneys' fees, that it may incur or sustain as a result of my negligence, recklessness, or willful misconduct in connection with my participation in Locals Mix activities, or arising out of any third-party claim.
4. Photographic and Information Release. I understand and agree that I may be photographed and/or videotaped by The Locals Mix® or its agents for internal and/or promotional use. I hereby grant and convey to The Locals Mix® all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to the use of my name, image, likeness, and voice in perpetuity, in any medium or format, for any publicity without further compensation or permission. I further agree that my contact information, including but not limited to, telephone numbers, email addresses, physical addresses and other information my be distributed and released to coordinate and further the activities of The Locals Mix®, related musical festivals and artist promotion.
5. Intellectual Property. I warrant that any music I play in connection with The Locals Mix® event(s) is my own intellectual property and does not violate any copyright laws or other applicable laws.
6. General Guidelines. I understand and acknowledge that The Locals Mix®, in its sole discretion, may establish and enforce application guidelines and codes of conduct. The Locals Mix® further has the authority to remove any attendees, including artists and musicians, from any event without a refund for failure to adhere to reasonable standards of conduct.
7. Equipment and Damage. I understand that I am wholly responsible for my equipment and belongings, and The Locals Mix® will have no liability for stolen or damaged belongings. I also expressly agree that I will be responsible for all damages to grounds or other property caused by me or my agents.
8. Miscellaneous. I hereby agree that this Release represents the full understanding between The Locals Mix® and me and supersedes all other prior agreements, understandings, representations, and warranties, both written and oral, between us, with respect to the subject matter hereof. If any term or provision of this Release is held to be invalid by any court of competent jurisdiction, that term or provision shall be deemed modified so as to be valid and enforceable to the full extent permitted. The invalidity of any such term or provision shall not otherwise affect the validity or enforceability of the remaining terms and provisions. This Release is binding on and inures to the benefit of the Organization and me and our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. Section headings are for convenience of reference only and shall not define, modify, expand, or limit any of the terms of this Release.
9. Governing Law. I hereby agree that this release is intended to be as broad and inclusive as permitted, and that this release shall be governed by and interpreted in accordance with the laws of the State of Florida, without reference to any choice of law doctrine.
BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE LOCALS MIX®.
