    Please read carefully and keep for your records. By accepting a stallholder position it is considered as agreement of these terms and conditions. These terms and conditions apply to all stallholders. Compliance is a strict condition of the contract for all stallholders at any and all markets.

    All stallholders must cooperate and support the operators in ensuring the Hutton Moor Artisan Makers Market & Craft Fair is a safe and enjoyable place for all attendees and stallholders. Stallholders must comply with the commercial and administrative terms (paying particular attention to bookings and payments), the insurance terms, trading statutory guidelines, food hygiene and the risk management and accident prevention terms. 

    Bookings

    Stallholders will only be invited to attend an event via email.

    Stallholders are invited entirely at the operators (Michelle/Angela) discretion. Please do not assume a pitch is automatically yours because you have had a stall before.

    Confirmation of attendance is by booking and paying via the link in the invite, and in doing so it is considered the stallholder is in agreement of the Terms and Conditions.

    Payment

    Booking and payment must be made in advance of an event. Only under written confirmation for the operators are stallholders able to pay on the day.

    If a booking has not been agreed or confirmed by the operator, the operator will assume you cannot attend and reserves the right to invite an alternative trader offering a similar product range. If a trader cannot attend an event having received an invitation please let the operator know via email or phone call at your earliest convenience.

    Payment should be made at the time of booking.

    Cheques will not be accepted.

    There is no facility for late payments, unless agreed in writing by the operator.

    Pitch fee is £15.

    Refunds

    Stallholders must accept the risk of bad weather and will not be entitled to a refund for these reasons.

    Stallholders must accept the risk that large events may also be at the venue, which could impact the footfall at the Hutton Moor Artisan Makers Market & Craft Fair, and will not be entitled to a refund for these reasons.

    Should a confirmed stallholder cancel, eligibility for a refund will be considered on the condition the operator is able to find a suitable replacement.

    In the event the market is cancelled due to external forces outside the operators control no refunds will be offered, taking into consideration the operators pre-event expenses.

    Trading Hours

    Most regular monthly events will operate the following times, unless directed or confirmed by the event operator prior to an event. Set up time 10am ready for trading to commence at 11am until 2:30pm. Packing up is from 2:30pm until 3pm.

    Stallholders are expected to arrive and leave promptly and trade for the duration of the event as a courtesy to their fellow traders and at the request of the operator.

    Should a stallholder be required to leave early it is expected they will first gain permission from the operator.

    Allocation and Position of Pitch

    The operator is solely responsible for the allocation of pitch positions on site.

    If you would like a specific change in pitch position, please speak to or contact the operator. We will endeavour to meet your requirements at our discretion, but we do require notice to ensure we are able to best facilitate the changes in the least impactful way to other stallholders.

    It is not permissable for stallholders to change the pitch position themselves, they must consult with the operator.

    Eligible Goods

    On booking, stallholders are to supply a description with photographs of the goods intended for sale. Any additions/amendments to this portfolio must be approved by the operator. The operator will ask for any non-authorised goods to be removed from display and sale.

    Exclusive Trading Rights

    The operator will endeavour to prevent duplication of products within the event but does not guarantee exclusivity.

    Site Use and Presentation

    Stallholders must operate strictly within the boundaries of the stall site that has been allocated to them and avoid encroachment into neighbouring stallholders pitches.

    The presentation of stalls must be of a presentable standard that is satisfcatory to the operator.

    Traders supplying their own infrastructure must ensure it is good quality and weighted properly.

    Approval to use portable generators can only be given by the operator and only in exceptional circumstances.

    Approval to use electricity at the venue can only be given by the operator and may incur additional charges.

    Stallholder Requirements

    Food stallholders must rely on their own public liability insurance to include cover for claims arising from the sale of food or from food contamination.

    Food stallholders must acknowledge and agree that the operator is not liable for any worker's compensation claim by any staff or public.

    In the storage, preperation, cooking and service of food, food stallholders must comply strictly with all legal requirements and/or the recognised best practice standards including but not limited to: must have an official FSA rating, all sales of alcohol must be made in accordance with Challenge 25 guidelines and hold a TENS licence and personal licence, goods must be marked and priced according to legal requirements. Contact your local trading standards office for more information.

    Stallholders Warranties and Representations

    The stallholder acknowledges and agrees that, by applying to hire a stall pitch position they make the following warranties and representations: the statements made in the online application system are true, accurate and complete; the stallholder has read the T&Cs and agrees to be bound by the T&Cs; the stallholder has full legal and beneficial ownership of the goods they offer for sale and that their ownership is free from any encumbrances; the stallholder will not engage in any false or misleading conduct including but not limited to selling counterfeit goods or misleading goods; the stallholder has the necessary licences, practicing certificates or permissions to sell the goods that they offer for sale.

    Setting Up, Closing Down, Loading and Unloading

    Stallholders must set up, close down, load and unload strictly within the specified times and guidelines. Instructions will be confirmed in advance. Those with vehicles can gain a parking permit from Hutton Moor.

    Stallholders before vacating their stall site will remove all rubbish and all other things that may be reasonably necessaary, to leave the stall site in the same condition that it was in before they set up.

    Stallholders are required to remove any items that have been attached to gazebos and tables so as not to cause harm or encumbrance to crew during de-rig.

    Stallholders are required to remove and take away their own trade waste.

    Inspection of Insurance Policies & Other Documents

    Stallholders must at all times have available copies of their Public Liability Insurance policies.

    Stallholders must have public liability insurance cover of £5M

    Risk Management and Accident Prevention Terms

    Stallholders must comply with the Operator’s online bookings and payment procedures.

    Any stallholder endangering the health & safety of any persons will be asked to leave the event.

    Stallholders must report promptly to the Operator any security problems including, but not limited to, robberies, pickpocketing, unusual packages, drunken or belligerent customers at the events.

    Smoking/Vaping

    Smoking/Vaping is not permitted.

    Bad Weather/Disruptions

    The Hutton Moor Artisan & Makers Market & Craft Fair events operate in all weathers and will operate on the designated market day unless extreme weather or other disruptions, that are beyond the Operator’s control, compel the Operator to close the markets for the safety of traders and the public.

    It is the responsibility of the stallholder to contact the Operator to check if the event is going ahead.

    The Operator will communicate the cancellation of an event via the social media Facebook Page.

    Operator’s Directions

    Stallholders must comply with all directions given to them by the Operator.

    Stallholders must treat the Operator, and other stallholders and members of the public politely and with respect at all times. Any unacceptable behaviour including, but not limited to, aggression, being under the influence of drugs/alcohol, abusive language, nuisance to other traders, or refusing to comply with reasonable direction will be treated as a breach of a condition of these regulations. Such a breach is likely to result in that stallholder being required to leave the markets immediately and being banned from trading at any future markets.

    Any direction given by the Operator regarding risk management or accident prevention must be complied with strictly and immediately.

    Exclusion Of the Operator’s Liability

    The stallholder acknowledges and agrees that the Operator has not given any warranties or made any representations relating to the stallholder’s occupation or use of a stall site at The Hutton Moor Artisan Makers Market & Craft Fair, other than those that are specifically set out in these regulations. This includes, but is not limited to, any warranties or representations relating to:

    Stallholder’s likely sales and profits;
    The benefit of the location of any particular stall site;
    The number of potential customers that are likely to visit the markets;
    Another stallholder on the same market day selling the same or similar goods or services or the location of their stall site.
    The services and facilities that are available to the stallholder other than those that are expressly set out in these regulations;
    The extent to which the Operator has carried out marketing or advertising to attract customers to the markets.
    The suitability of the markets for any particular purpose.


    Claims Against The Operator

    The stallholder acknowledges and agrees that the Operator is not liable for any claims arising from:

    Damage, or theft of goods or other property of the stallholder.
    Injury, loss or damage suffered by any person at The Hutton Moor Artisan Makers Market events;
    The Operators request for the trader to leave the market/lack of future invitations to the event;
    Damage to or the theft of the property of any person at the markets; The operator cannot be held responsible for any damage, loss or theft from/to stallholders vehicles.


    Car Park/Traffic Management

    Stallholders must appreciate when setting up, closing down, loading and unloading that they must exercise the same degree of care for their own safety and consideration and for the safety and convenience of others that they should exercise in any other public place and car park.

    Tripping/Other Accidents

    In order to reduce the risk of tripping accidents, stallholders must keep their stall site and the immediate vicinity clear of anything that might obstruct and cause tripping accidents.

    Stallholders must ensure that their stall sites are free of any dangerous projections, sharp corners,  that might injure customers, particularly hard materials such as timber, metal or glass.

    It is imperative that dangerous or sharp objects are not attached to tables or gazebos that may endanger or encumber set up crew when erecting or dismantling equipment e.g screws, clips, fastenings.
