Agreement Overview
This agreement is between The Movement Collective, hereinafter referred to as "TMC", and the signer of this retreat agreement, hereinafter referred to as the "Client", collectively referred to as the "Parties", with the wellness retreat detailed below. The package list and price list and/or documents attached to this contract are integral parts of this document. The contract terms, agreement, and price list are the only legally binding documents between the Parties.
This agreement contains the entire understanding between TMC and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to notify TMC. If the Parties want to waive one part of this agreement that does not mean that any other part is also waived. All contracts must be signed within 48 hours of receipt and the deposit must be paid to secure a spot at the retreat.
Non-Refundable Deposit
A non-refundable deposit is required to book this retreat. This is a non-refundable deposit. Clicking the "Done!" button is an agreement to be invoiced and pay the amount corresponding with Client's room selection via one single payment or by setting up a payment plan. Deposit shall be liquidated for damages to TMC in the event of a cancellation, or breach of contract by the Client. No space is reserved until a deposit is received. The deposit shall be applied towards the total cost of the retreat. The balance of the complete package price must be paid by August 31, 2025. If final payment is not received by the August deadline, the Client's spot will be released and a convenience fee of up to $2000 will be held.
Travel
Travel is not included in the retreat payment. Client is responsible for transportation to and from the retreat.
Cancellation
There shall be no refund of deposit after the signing of the Contract to reserve a retreat spot. Once an invoice is paid, it is non-refundable. Any other arrangements shall be discussed between the Clients and TMC. All arrangements will be put in writing.
Unforeseeable Circumstances
TMC hopes that you have the most enjoyable experience and knows that, unfortunately, there are situations that, by nature, are beyond our control. Examples that are not guaranteed nor warranted and will not result in a refund or credits include, but are not limited to; failure of heat, pool & hot tub equipment, appliances, electronics, internet service, system or mechanical malfunctions, plumbing, neighborhood construction or noise disturbances, accommodations not to your taste or expectations, natural disasters, pandemic, and of course, weather. In the rare event of a mechanical failure or malfunction, TMC, along with our hotel will do the best to resolve it quickly. There are no refunds or credits for early departures due to system
malfunction. If we must postpone from date on original contract due to flood, natural disaster, COVID-restrictions, or serious illness, we may postpone to a future date within a reasonable timefram. Any deposits or payments made shall be held by TMC and applied to the rescheduled date. An amendment to this contract that reflects the new dates will be required to be signed by all parties. Rate differences may apply and are subject to change.
Returned Checks
Returned checks are subject to a $35.00 returned check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by TMC in the event that enforcement of this contract becomes necessary. All legal action shall be taken appropriately.
