Students and guardians indemnify FSC Africa in terms of the POPI Act, thereby agreeing for FSC Africa to store and communicate personal information.

Due to the demanding nature of the Structure Clearance Program, FSC Africa will require certain medical information provided from you.

 

Applicant Declaration

I declare that:

I have read and understood this form, including the information above. I acknowledge that I am required to disclose all pre-existing injuries and/or diseases as well as any mental health problems and prescribed medication that I take.

 

NOTE: All successful applicants who suffer from a serious medical disorder and/or injury will need to produce an original letter from a doctor stating they are medically fit to attend the Structure Clearance Program prior to course commencement.  

Structure Clearance 01 - R 7,500.00

 

A 70% non-refundable deposit is required to ensure successful enrolment. The remainder is to be paid one week prior to course commencement.

Due to the nature of this training, it is important that the applicant understands the risks involved with undertaking such training.

FSC Africa abd its staff, trainers and partners will take every precaution to ensure the safety of its students, but this training has inherent risks which cannot be avoided.

 

These risks include but are not limited to:

1. Students will be training in areas with dangerous game, snakes, spiders, scorpions, insects, and other dangerous animals. These animals are unpredictable and can cause injury or death.
2. Students will be working long hours while wearing tactical kit and equipment. This can lead to fatigue or injury if not correctly prepared for.
3. Students will perform simulated force-on-force exercises with Unit Solution Unit 4 rifles. This carries risk of injury or death if the correct drills and procedures are not followed.
4. Students will have to perform training scenarios and exercises regardless of weather conditions and temperatures, which carries great risks if the correct procedures are not followed by the student.

 

I fully understand that the risks involved with the training can lead to severe injury and loss of life. Nevertheless, I am willing to proceed and freely accept all risks, dangers and hazards that may arise from the training activities which could result in personal injury, loss of life and property damage.

1. I hereby affirm and acknowledge that I have been fully informed of the inherent hazards and the risks associated with training given by the Indemnitee.
2. I fully understand that the risks involved with this training can lead to severe injury and even loss of life.
3. Nevertheless, I choose to proceed and freely accept all risks, dangers, and hazards that may arise from the training activities which could result in personal injury, loss of life, and property damage.

I agree to:

1. Waive and release any and all claims based upon negligence, active or passive with the exception of intentional, wanton and willful misconduct that I may have in the future against the indemnitee.
2. To indemnify and release the Indemnitee, its officers, directors, employees, representatives, agents and volunteers, and hold them harmless from and against any and all claims, demands, actions, liabilities, responsibilities, damages, losses, costs and expenses, whatsoever, for any claims or actions that I, my estate, executors or assigns may have for personal injury, property damage or wrongful death arising from the training.
3. Undertake and keep the Indemnitee indemnified and hold its shareholders, directors and employees harmless against all loss or damage, including the following:

 

Force Majeure, Acts of God, court action, loss of life, accidental or deliberate injuries caused during the training program, damage to property, equipment and personal belongings, bad weather, default of whatsoever nature by any third party mandated by the Indemnitee for any cause whatsoever arising during which I may sustain as a result of having undergone a training program or instruction.

 

I hereby declare that I am of legal age and am competent to sign this agreement.

I do hereby acknowledge that the Prohibition of Mercenary Activities and Regulation of Certain Activities in Country of Armed Conflict Act 27 of 2006 intends:

1. to prohibit mercenary activity;
2. to regulate the provision of assistance or service of a military or military-related nature in a country of armed conflict;
3. to regulate the enlistment of South African citizens or permanent residents in other armed forces;
4. to regulate the provision of humanitarian aid in a country of armed conflict;
5. to provide for extra-territorial jurisdiction for the courts of the Republic with regard to certain offences;
6. to provide for offences and penalties; and
7. to provide for matters connected therewith.

I do hereby warrant and undertake that I will not:

1. participate as a combatant for private gain in an armed conflict;
2. directly or indirectly recruit, use, train, support or finance a combatant for private gain in an armed conflict;
3. directly or indirectly participate in any manner in the initiation, causing, or furthering of –
   1. an armed conflict; or
   2. a coup d’état, uprising or rebellion against any government; or
4. directly or indirectly perform any act aimed at overthrowing a government or undermining the constitutional order, sovereignty or territorial integrity of a state, within the Republic of South Africa or elsewhere in the world as a result of my training received at FSC Africa.

I do hereby acknowledge that should I contravene the abovementioned, I will be guilty of an offense in terms of The Prohibition of Mercenary Activities and Regulation of Certain Activities in Country of Armed Conflict Act 27 of 2006, in which event I indemnify and hold FSC Africa harmless from and against any and all claims, demands, actions, liabilities and responsibility of whatsoever nature from whomsoever, which may arise due to my contravention of The Prohibition of Mercenary Activities and Regulation of Certain Activities in Country of Armed Conflict Act 27 of 2006.
