COMMUNITY GAMESHOW APPLICANT RELEASE FORM

This Applicant Release Form ("Release") is required for participation in the Community Gameshow ("Program"). By signing below, I acknowledge that my participation is voluntary and subject to the terms and conditions outlined herein.

ELIGIBILITY REQUIREMENTS AND ACKNOWLEDGMENTS:
I am at least 18 years of age as of the date of my registration.
I am a legal resident of the United States.
I am not a candidate for public office and will not become one until at least one (1) year after my participation in the Program.
I understand that participation is contingent upon passing any required background checks, and I authorize the Community Gameshow and its affiliates to obtain necessary information for this purpose.
REPRESENTATIONS, WARRANTIES, AND RELEASES:
By signing this Release, I acknowledge, agree, and warrant that:

I have provided accurate and truthful information in my application, and any false or misleading information may result in my removal from consideration or participation in the Program.
The Community Gameshow and its affiliates are under no obligation to select me as a contestant or to produce or air the Program.
I will keep all details about the Program confidential unless otherwise authorized.
MEDIA RELEASE AND USAGE RIGHTS:
I grant the Community Gameshow, its affiliates, and licensees the unrestricted right to use my name, voice, image, likeness, biographical information, and any materials I provide in connection with the Program.
I acknowledge that all footage, recordings, photographs, and other materials captured during my participation are the sole property of the Community Gameshow, which has full rights to edit, distribute, and promote them in any media, now or in the future.
I understand that I will not receive any compensation for granting these rights, nor do I have any ownership claims over the materials.
LIABILITY WAIVER AND INDEMNIFICATION:
I assume all risks associated with my participation in the Program, including but not limited to personal injury, property damage, and other unforeseen incidents.
I release, discharge, and agree to hold harmless the Community Gameshow, its organizers, sponsors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from my participation.
I agree to indemnify and defend the Released Parties against any claims brought against them due to my actions, misrepresentations, or failure to adhere to the Program’s guidelines.
GENERAL TERMS:
This Release shall be governed by the laws of the state in which the Community Gameshow operates.
Any disputes arising from this Release shall be resolved through binding arbitration.
If any provision of this Release is found to be invalid, the remainder of the document shall remain in full force and effect.
By signing below, I confirm that I have read, understood, and voluntarily agreed to the terms of this Release.

CONFIDENTIALITY 

 

Whether or not I am selected to be a participant in the Program, I will keep in strictest confidence and shall not, and shall not authorize or cause others to, directly or indirectly, use or disclose to any third party at any time (i.e., prior to, during, or after the taping or exhibition of any episode of the Program) any of the following, which is the exclusive property of Producer or Network: any information or materials that I may read, hear or otherwise acquire or learn in connection with or as a result of my participation in or in connection with the Program, including without limitation, any information or materials concerning or relating to Producer or to Network, the business of Producer or Network, any program produced by Producer or exhibited by Network, including, without limitation, any information concerning or relating to the Program, the Program applicants, the Program participants, the location(s) of the Program, the events contained in the Program, the outcome of any episode of the Program, and the contents of this Application and Release or any other with respect to confidentiality set forth in this Application and Release shall continue in perpetuity or until terminated by Network by giving me written notice of termination. In no event will I have the right to terminate my confidentiality obligations under this Release. I acknowledge that in the event I breach the confidentiality or any other provisions of this Release, my breach may, in the sole discretion of Producer or Network result in me being disqualified to participate as a participant in the Program. I further acknowledge that a breach by me of any of the confidentiality provisions in this Release would cause Producer and Network irreparable injury and damage that cannot be reasonably or adequately compensated by damages in an action at law, and, therefore, I hereby expressly agree that Producer and Network shall be entitled to injunctive and other equitable relief to prevent and cure any breach or threatened breach of any of the confidentiality provisions of this Release by me. I also recognize that proof of damages suffered by Producer in the event that I breach this paragraph will be costly, difficult, or inconvenient. Accordingly, I agree to pay Producer the sum of Fifty Thousand Dollars ($50,000.00) per breach.

RELEASE AND AGREEMENT NOT TO SUE

 This Release and Agreement Not to Sue ("Agreement") is made by the undersigned participant ("Participant") in favor of Community Gameshows, its affiliates, and other associated entities as outlined below.

1. DEFINITION OF RELEASED PARTIES
The term “Released Parties” shall mean and refer to Community Gameshows, its organizers, sponsors, affiliates, partners, employees, agents, contractors, and all associated entities involved in the development, production, distribution, promotion, or any other aspect of the Program. This includes, but is not limited to, their respective parent, subsidiary, and affiliated companies, licensees, successors, assigns, advertisers, directors, officers, executives, on-air talent, employees, and representatives.

2. RELEASE OF LIABILITY
To the maximum extent permitted by law, I hereby irrevocably and unconditionally release each of the Released Parties from any and all liability arising from my application for and/or participation in the Program, including but not limited to:

The recording, use, and exploitation of my Likeness (name, voice, image, biographical details, and any materials submitted or created in connection with the Program).
My involvement in any participant selection process, live events, rehearsals, or filming related to the Program.
Any personal injury, illness, property damage, emotional distress, defamation, invasion of privacy, or any other claim resulting from my participation.
Any claim of misrepresentation, negligence, or infringement of rights arising from my involvement in the Program.
3. AGREEMENT NOT TO SUE
To the fullest extent permitted by law, I agree not to sue or bring any legal action against the Released Parties for any reason related to my participation in the Program, including but not limited to any of the claims outlined in Section 2.

4. WAIVER OF UNKNOWN CLAIMS
I acknowledge that there may be unknown or unsuspected claims related to my participation that I am not currently aware of. I expressly waive all rights under Section 1542 of the California Civil Code, as well as any similar law in any jurisdiction worldwide. Section 1542 states:

"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

I fully understand and accept that this Release covers all claims, known and unknown, suspected and unsuspected, arising from my participation in the Program.

5. GENERAL TERMS
This Agreement shall be governed by the laws of the state in which the Community Gameshow operates.
Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with applicable laws.
If any provision of this Agreement is found to be invalid, the remainder shall remain in full force and effect.
By signing below, I confirm that I have read, understood, and voluntarily agreed to the terms of this Release and Agreement Not to Sue.

 MISCELLANEOUS 

 I agree that Community Gameshows and its affiliates may license, assign, or otherwise transfer this Application and Release, along with all rights granted by me under this Application and Release, to any person or entity without restriction.
This Application and Release shall be governed and interpreted in accordance with the internal, substantive laws of the State of California, without regard to any conflicts of law principles.
Any and all claims, disputes, or controversies arising out of or in connection with this Application and/or Release that are not otherwise barred or released under the terms herein shall be resolved exclusively and confidentially by binding arbitration. The arbitration shall take place before a single, neutral arbitrator under the auspices of JAMS, using its Streamlined Arbitration Rules and Procedures, and conducted through its Los Angeles, California office. By agreeing to this provision, I waive my right to a trial by jury.
I agree that my sole remedies for any breach of this Agreement by Community Gameshows or any other Released Party shall be limited to monetary damages, if any. Under no circumstances shall I be entitled to rescind this Agreement, revoke any rights granted herein, or seek injunctive or other equitable relief.
This Application and Release may be executed using an original, facsimile, or electronic signature. Any signed copy delivered via fax, email, or electronic transmission shall be treated as an original and shall be legally binding.
If any provision of this Application and Release is deemed illegal, invalid, or unenforceable, such determination shall not affect the validity or enforceability of the remainder of the Agreement, which shall be enforced to the maximum extent permitted by law.
If I am selected as a potential contestant, I agree to execute any additional waivers, releases, or agreements required by Community Gameshows, its affiliates, sponsors, or assigns. This includes, but is not limited to, a contestant agreement in the form provided by Community Gameshows. I also confirm that I have secured or will secure, at no cost to Community Gameshows, all necessary rights for the use of any materials I provide in connection with the Program.
By signing below, I acknowledge that I have read, understood, and agreed to the terms and conditions outlined in this Application. I certify that all information provided in this Application is true and complete. I understand that false or incomplete information may result in my immediate disqualification from the contestant selection process. No modifications to this Agreement shall be valid unless signed by both me and Community Gameshows.
Exhibit A, attached hereto and incorporated by reference, provides a summary of the personal information we collect and how it is used. The actual information collected and its use may vary based on the nature of our interactions. The attached table outlines the categories of personal information collected and their purposes. In some instances, where required by law, we will obtain your explicit consent before collecting certain personal data.
I have read, understood, and agreed to the foregoing terms. I acknowledge that by signing this Agreement, I am voluntarily waiving certain legal rights, including but not limited to my right to file a lawsuit in court regarding any claims related to this Application and Release.
