RELEASE AND AGREEMENT NOT TO SUE
This Release and Agreement Not to Sue ("Agreement") is made by the undersigned participant ("Participant") in favor of Community Gameshows, its affiliates, and other associated entities as outlined below.
1. DEFINITION OF RELEASED PARTIES
The term “Released Parties” shall mean and refer to Community Gameshows, its organizers, sponsors, affiliates, partners, employees, agents, contractors, and all associated entities involved in the development, production, distribution, promotion, or any other aspect of the Program. This includes, but is not limited to, their respective parent, subsidiary, and affiliated companies, licensees, successors, assigns, advertisers, directors, officers, executives, on-air talent, employees, and representatives.
2. RELEASE OF LIABILITY
To the maximum extent permitted by law, I hereby irrevocably and unconditionally release each of the Released Parties from any and all liability arising from my application for and/or participation in the Program, including but not limited to:
The recording, use, and exploitation of my Likeness (name, voice, image, biographical details, and any materials submitted or created in connection with the Program).
My involvement in any participant selection process, live events, rehearsals, or filming related to the Program.
Any personal injury, illness, property damage, emotional distress, defamation, invasion of privacy, or any other claim resulting from my participation.
Any claim of misrepresentation, negligence, or infringement of rights arising from my involvement in the Program.
3. AGREEMENT NOT TO SUE
To the fullest extent permitted by law, I agree not to sue or bring any legal action against the Released Parties for any reason related to my participation in the Program, including but not limited to any of the claims outlined in Section 2.
4. WAIVER OF UNKNOWN CLAIMS
I acknowledge that there may be unknown or unsuspected claims related to my participation that I am not currently aware of. I expressly waive all rights under Section 1542 of the California Civil Code, as well as any similar law in any jurisdiction worldwide. Section 1542 states:
"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."
I fully understand and accept that this Release covers all claims, known and unknown, suspected and unsuspected, arising from my participation in the Program.
5. GENERAL TERMS
This Agreement shall be governed by the laws of the state in which the Community Gameshow operates.
Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with applicable laws.
If any provision of this Agreement is found to be invalid, the remainder shall remain in full force and effect.
By signing below, I confirm that I have read, understood, and voluntarily agreed to the terms of this Release and Agreement Not to Sue.
