GOLD COAST YACHT CHARTERS
WAIVER AND RELEASE OF LIABILITY

This Waiver and Release of Liability ("Agreement") is made and entered into on this date below between Gold Coast Yacht Charters ("Company") and the undersigned participant ("Participant").

1. ASSUMPTION OF RISK
Participant understands and acknowledges that boating, swimming, snorkeling, and other water activities involve inherent risks, including but not limited to drowning, collisions, falls, weather conditions, and equipment failure. Participant voluntarily assumes all risks associated with participation in yacht charter activities.

2. RELEASE AND WAIVER OF LIABILITY
Participant, on behalf of themselves, their heirs, assigns, and personal representatives, hereby releases, waives, and forever discharges Gold Coast Yacht Charters LLC, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising out of any injury, death, or property damage sustained while participating in any activity related to the charter.

3. INDEMNIFICATION
Participant agrees to indemnify and hold harmless Gold Coast Yacht Charters LLC from any claims, liabilities, damages, or expenses (including attorneys' fees) arising from Participant’s actions, negligence, or failure to comply with Company rules and safety instructions.

4. SAFETY AND COMPLIANCE
Participant agrees to comply with all safety rules, instructions from crew members, and applicable laws. Failure to adhere to safety protocols may result in termination of participation without refund.

5. MEDICAL DISCLOSURE AND AUTHORIZATION
Participant certifies that they are in good health and have no medical conditions that would impair their ability to safely participate in charter activities. In case of a medical emergency, Participant authorizes Gold Coast Yacht Charters LLC to obtain necessary medical treatment and agrees to bear any associated costs.

6. DAMAGE TO PROPERTY
Participant agrees to be responsible for any damage caused to the yacht, equipment, or other property due to Participant’s negligence or misconduct.

7. PHOTO RELEASE
Participant grants Gold Coast Yacht Charters LLC permission to use photographs or videos taken during the charter for promotional and marketing purposes.

8. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of __________. Any disputes shall be resolved in the appropriate courts of said state.

9. ACKNOWLEDGMENT AND ACCEPTANCE
Participant acknowledges that they have read and understood this Agreement, and voluntarily agree to its terms.
