Brewery further agrees as follows:
- That all beer must be either bottled, canned, or in 5 gallon kegs – cans are preferred;
- That all product must be TABC certified/approved;
- That Brewery will supply its own TABC Certified Representative(s) on site to serve its product on the day of the event, or that Brewery will not provide TABC Certified Representative(s) to serve its product on the day of the event and volunteer TABC Certified servers will be supplied by Host;
- That Brewery will provide 4-6 flavors of product;
- That Brewery will not sell or display any goods or services other than those described herein;
- That Brewery is welcome to give away merchandise or promotional products, but is not permitted not sell any merchandise or promotional products;
- That Brewery or Volunteer will accept scans from RFID wristbands throughout the event as the sole method of payment for its products. Using a supplied touch screen portal, Brewery or Volunteer will input how many tastes or full beers are being purchased per transaction and scan guest’s RFID wristband for payment. Brewery or Volunteer will also replenish balances on guest wristbands by swiping guest credit and debit cards, entering the dollar amount to be added to wristband, and scanning wristband to add that amount to it’s balance;
- That Brewery will be on the Festival site no later than 12:00pm, April 26, 2025;
- That Brewery will provide a Form 1099 to the Host if beer purchase exceeds $600;
- That booth space will be determined by Host and provided to Brewery prior to the event;
- That Brewery’s staff or representatives will be clothed and groomed in a clean, neat fashion and shall conduct themselves in an orderly fashion;
- That Brewery shall not place a tip jar in the booth or request any sort of compensation;
- That Brewery’s staff or representatives will not consume FREE beer. The beer is purchased by Wurstfest and is their property. Wristbands will be provided that can be used for beer purchases;
- That Breweries MAY NOT bring their own beer into the festival;
- That no music, noise, or amplification devices shall be used by Brewery;
- That Brewery may not pack out prior to 8:00pm, but must be completely packed and out of the property by 10:00pm, after the event;
- That Brewery shall leave the booth area clean and in the condition it was in prior to the event;
- That Brewery shall provide a certificate of general liability insurance with a minimum of $1,000,000 per occurrence and $2,000,000 aggregate naming Rotary Club of New Braunfels as Additional Insured with Waiver of Subrogation.
Host further agrees as follows:
- That Host will provide the following on the day of the event: space under tent or other covering, 6’ table, adequate space for Brewery’s booth, cooler, ice, and signage set-up;
- That Host will provide uniform signage for all Breweries, if Brewery desires to bring additional signage, they are welcome to do so provided that it fits in designated space provided and is approved by Host no later than thirty (30) days prior to the event;
- That Host will put Brewery’s name on the Host’s website within seven (7) days of execution of this Agreement;
- That Wurstfest Association will purchase, from Brewery, all product/beer used for event, the day of the event.
The parties agree that Rotary International and/or Rotary Club of New Braunfels, its representatives, or affiliates will not be responsible for any liability, lost, stolen, or damaged merchandise, or any injury incurred during the Event.
INDEMNIFICATION To the fullest extent permitted by law, Brewery agrees to indemnify, release, defend, and hold harmless “Host”, its officials, officers, employees, and volunteers from any losses, claims, demands, damages, actions, liabilities, and expenses including reasonable attorneys’ fees and costs (collectively, the “Claims”) of any kind that may arise from or are in any manner related to the acts or omissions of Brewery or its officers, employees, agents, invitees in connection with this Agreement and any amendments thereto or damages or injuries incurred by third parties due to Brewery’s products. Brewery’s obligations in this Section, however, shall not extend to any Claims that are proximately caused by the sole negligence or willful misconduct of Host, its officials, officers, employees, volunteers or agents.”
Your signature below states that you have fully read, understand, and agree to abide by the terms and conditions set forth in this document and no agreements in writing or otherwise, other than those contained herein shall be binding upon the parties unless signed by both parties hereto. Your signature below further warrants that you have the authority to bind Brewery to the terms contained herein.
