Rule of Law & Public Safety Under Attack
In July of 2024 the Police Commission enacted DGO 9.07 which makes illegal behavior legal, and the legal enforcement of that behavior by SFPD grounds for disciplinary action. Recognizing that 9.07 prevents police officers from performing their sworn duty to protect our residents, the POA has filed a lawsuit to prevent this dangerous DGO from being enforced.

The POA's efforts to block DGO 9.07 from being enacted should be supported because DGO 9.07 contradicts State Law and advances a dangerous and radical agenda that was rejected by our own CA legislature.
This should frighten you: The anti-law enforcement majority on the Police Commission continue to overstep their authority in a way that is now more alarming than ever. Not only did they do an end run around our legislators in Sacramento, but they are also putting SFPD officers in the position of having to choose between their duty to enforce our state and local laws and/ or risk being disciplined by the police commission for enforcing those laws. SB50, a bill containing similar provisions to DGO 9.07, banning police officers from making “pretextual” stops, FAILED to pass into State Law, yet our unelected Police Commissioners proceeded as if it passed.
Why is our City Attorney allowing this?
This Police Commission believes it is authorized to pick and choose which laws the SFPD should enforce, without regard to our State Laws or our public safety. Worse, our City Attorney actively advances the anti-public safety agenda by supporting this illegal atempt to circumvent state law and perpetuate an environment of lawlessness.
Under DGO 9.07, if our police officers do their jobs and enforce our local and state laws like they are sworn to do, they can be disciplined. The real world consequences of this policy are: less proactive policing and increased likelihood of illegal drugs and weapons flowing into our city; drugs and weapons that could have been recovered from a routine traffic stop, a decline in traffic safety as enforcement of traffic violations will be less prevalent. All of this makes our streets and our city less safe.
Our City Attorney failed to step in to support the POA, and failed to remind the Police Commission of its limits. We cannot allow this to continue.
Remind our City Attorney which side of the law he is supposed to be on. David Chiu has repeatedly allowed the Police Commission to overstep its authority to the detriment of our public safety. The police commissioners are not legislators and they cannot hand pick which laws they will allow SFPD to enforce and which they will allow them to overlook. David Chiu must end this costly litigation by conceding that the POA has standing and is correct in fighting this DGO.
