WAIVER AND RELEASE OF LIABILITY

I hereby assume and release the Leadership Experience, an Arizona non-profit corporation (hereinafter referred to as the “LX”) of all risk of injury or illness while participating in the Leadership Experience (LX) which involves a number of physical and social activities (the “Activities”). I warrant that I am in good health and can safely participate in the Activities. I understand that my participation in the Activities is voluntary and is in no way job-related or a condition of any employment or business venture. I understand that the Institute reserves the right to withdraw its permission allowing me to participate in the Activities at any time and for any reason. 

As consideration for the right to participate in the Activities, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of the Activities, and do hereby release and forever discharge, the LX, and its managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, illness due to COVID-19, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of the Activities. 

If I participate in the Activities, I am doing so voluntarily and entirely at my own risk.  I am aware of the risks associated with traveling to and participating in the Activities at this time of heightened restrictions due to COVID-19, which may include, but are not limited to, physical or psychological injury, illness or death caused by the coronavirus disease (COVID-19) or other diseases, pain, dehydration, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my participation in the Activities, or from my own or others’ negligence. Nonetheless, I assume all related risks, both known or unknown to me, of my participation in the Activities, including travel to and from the Activities. 

I agree to defend, indemnify, and hold harmless LX against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, the costs of enforcing any right to indemnification under this release, and the cost of pursuing any insurance providers, incurred by LX arising out of or resulting from any claim of a third party related to my participation in the Activities.

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention due to my participating in the Activities. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation. 

I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability.  I expressly agree to release and discharge the LX, and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against the Institute for personal injury or property damage.
