Custom Song Form

Effective Date: Date of Creation1. IntroductionThese Terms and Conditions ("Agreement") govern the sale and production of custom songs by Heart & Soul Event Planning LLC ("Company," "we," "us," or "our"). By purchasing a custom song, you ("Client," "you," or "your") agree to these terms. Please read them carefully before making a purchase.2. Customization and Creative Processa. The Client will provide details for the custom song, including but not limited to lyrics, themes, preferred genre, and any special requests.b. The Company retains creative control over the final composition while making reasonable efforts to accommodate Client requests.c. Once the creative process has begun, no major changes may be requested unless otherwise agreed upon in writing.3. No Refund Policya. All sales are final. Due to the custom nature of our services, no refunds, cancellations, or exchanges will be permitted once payment has been received.b. If the Client fails to provide the necessary details within the specified time frame, the Company reserves the right to proceed with the song as best determined or cancel the order without a refund.c. Dissatisfaction with artistic interpretation does not constitute grounds for a refund.4. Revisions and Modificationsa. The Client may request up to one (1) minor revision (e.g., minor lyric adjustments, small melody tweaks) within one (1) day after receiving the final product.b. Major revisions, including complete rewrites or significant structural changes, will incur additional charges.5. Delivery Timelinea. Estimated turnaround times will be communicated before purchase but may vary depending on the complexity of the project.b. The Client is responsible for providing all requested materials in a timely manner to avoid delays.6. Rights and Ownershipa. The Company retains all rights to the song, including composition, production, and distribution, unless otherwise agreed upon in a separate licensing agreement.b. The Client may use the song for personal or non-commercial purposes unless explicitly granted commercial rights.c. Any unauthorized distribution, resale, or modification of the song is strictly prohibited.7. Liability and Disputesa. The Company is not responsible for any subjective dissatisfaction with the final product.b. The Client agrees not to file chargebacks or payment disputes regarding the purchase. Any disputes will be resolved through direct communication or arbitration.8. Agreement AcknowledgmentBy making a purchase, the Client acknowledges and agrees to these Terms and Conditions.
