Assumption of All Risk

I do hereby assume full responsibility for any and all damages, injuries (including death), or losses that I may sustain or incur, if any, while attending, engaging, practicing, participating or witnessing activity and/or certain event(s) occurring in or about the premises during Ultimate Defender Goalkeeper Academy To Go or To Stay Clinic. I hereby assume full risk, waive all claims and release and hold ULTIMATE DEFENDER GOALKEEPER ACADEMY, individually or otherwise, harmless for any and all liability, claims, suits, damages, expenses, fees, actions, or rights of action or judgments as a result of injury or death to myself or members of my family or heirs, or my guests, or damage, destruction or loss to my property, which in any way relates to, arises out of, or is in any way connected with my presence on the premises, or my participation in events of activities thereon, or the negligent acts or omissions of the releases or any other third party.

I agree to wear all protective equipment required while participating in the activity.

In consideration of my participation in and the use of the ULTIMATE DEFENDER GOALKEEPER ACADEMY leased premises or facilities, I hereby release and covenant not to sue the owner of the premises (releases), shareholders, directors, officers, employees, representatives, agents, affiliates and lessees from any and all claims resulting from any physical injury that may occur to me while participating in any program or event sponsored by ULTIMATE DEFENDER GOALKEEPER ACADEMY.

I HAVE READ AND FULLY UNDERSTAND THE ABOVE RELEASE/WAIVER AND FULLY UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS WAIVER VOLUNTARILY.

Medical Release and Authorization

I authorize ULTIMATE DEFENDER GOALKEEPER ACADEMY, its agents, employees, staff members, directors and officers to take whatever action is necessary, in their best judgment, in an emergency and I hereby release and discharge ULTIMATE DEFENDER GOALKEEPER ACADEMY, its agents, employees, staff members, directors and officers from any responsibility or liability related thereto. I hereby grant permission for ULTIMATE DEFENDER GOALKEEPER ACADEMY; the NEAREST MEDICAL TREATMENT CENTER; EMERGENCY RESPONDERS, to administer proper treatment for this registrant.

I give permission for the named athlete to receive emergency medical or surgical treatment and hospitalization if necessary. I understand that good faith attempt will be made to contact me, or the emergency contact named above, before taking this action. I will be financially responsible for any medical attention needed during the event or resulting from an injury received at the event. My medical insurance shall be the sole insurance coverage for any medical treatment.

I certify that the participant is in good health and able to participate in all clinic activities.

Cancellation Policy

Individual Withdrawal
We hire coaches for you based on a per-registration basis. Your registration triggers per-goalie expenses, facility rental fees, and a hiring process with a guaranteed salary. We will not un-hire coaches because of cancellations - their expenses must be covered. If you must cancel your commitment to attend this clinic, we need time to allow other goalies to take your place and cover our costs. To ensure that we are able to secure the very best staff, our refund policy for clinics is as follows:
Registration is fully refundable up to 30-days before the event. (11:59pm the night before the 30-day mark)
Between 30- and 14-days before the event, 50% of your tuition may be refunded.
Between 14- and 7-days before the event, 25% of your tuition may be refunded.
7-days or less before the event, tuition is non-refundable.

While we will consider last minute cancellations on a case-by-case basis, please understand the formula described above. We always strive to be empathetic (shit happens!) but timing and logistics may make it impossible for us to make an exception to the cancellation policy.

Weather Cancellation Policy
Should the Ultimate Defender event be cancelled due to inclement weather BEFORE the event begins, 70% of your tuition fee will be refunded.
If less than half of the event is completed within the allotted time, 50% of your tuition fee will be refunded.
If participants attend clinic and half or more of the event runs as planned (while participants are onsite), no compensation will be offered.

Expenses
Ultimate Defender or its staff will not be responsible for any expenses incurred by any individual, team, club or organization if the event is canceled in whole or in part.

Release of Media Rights

For good and adequate consideration, which I acknowledge I have received, I hereby grant, release, and quit claim to ULTIMATE DEFENDER GOALKEEPER ACADEMY (UDGKA) royalty free the right and authority to use, reproduce, and distribute, quoted material, my photograph, likeness, recorded voice or videotaped filmed appearances (the "Materials") for promotional and advertising purposes as UDGKA in its sole discretion will deem appropriate. The undersigned further expressly agrees that the attached waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Confirmation

BY ACKNOWLEDGING AND SIGNING BELOW, I AM DELIVERING AN ELECTRONIC SIGNATURE THAT WILL HAVE THE SAME EFFECT AS AN ORIGINAL MANUAL PAPER SIGNATURE. THE ELECTRONIC SIGNATURE WILL BE EQUALLY AS BINDING AS AN ORIGINAL MANUAL PAPER SIGNATURE.
