Disclosure and Consent Agreement
By signing this form you are agreeing to all the terms and conditions set forth. The contestant must compete in the correct age division determined by their age on April 13, 2025 (the day of the pageant) in the year of the competition.
The contestant and/or parent/legal guardian listed below give permission to America's Total Miss and Cheryl Smukowski to use their photographs, speeches, performances, videos, written work, art work, etc. for publicity, advertising, and marketing purposes, as well as pageant materials and publications, in perpetuity. This permission extends to any future photographs, speeches, performances, videos, written work, art work, and the like; while theyh are serving as reigning royalty for America's Total Miss in any capacity, in perpetuity; and can only be revoked in writing after agreed upon by all parties.
In consideration for being accepted as a contestant, and if the aforementioned is under the age of 18, then we the parents and/or guardians of the contestant, and the contestant individually named below, do hereby release America's Total Miss, Cheryl Smukowski, and all of its affiliates, including its directors, staff, and volunteers, from any and all claims and damages directly or indirectly resulting from the named contestant below in any America's Total Miss event.
It is understood that all fees are non-refundable without exception. Additionally, an event will never be cancelled; however, we reserve the right to convert any event to a virtual event for any reason.
CONSENT TO USE ELECTRONIC RECORDS AND SIGNATURES: The Communications we provide to you, or that you sign or agree to at our request, will be in an electronic form ("Electronic Records"). We may also use electronic signatures and obtain them from you as part of our transactions with you. Examples of electronic records covered by your consent include, but are not limited to, the following: This E-sign Disclosure and Consent Agreement and any amendments to it, all communications related to America's Total Miss to the extent electronic delivery is not otherwise prohibited by law, notices of amendments to any of your agreements with us, and other disclosures and notices that we are either legally required to provide to you or choose to provide to you in our discretion. Any signature (including any electronic symbol or process attached to, or associated with, a contract or other record and adopted by a person with the intent to sign, authenticate or accept such contract or record) hereto or to any other certificate, agreement or document related to this transaction, and any contract formation or recordkeeping through electronic means shall have the same legal validity and enforceability as a manually executed signature or use of a paper-based recordkeeping system to the fullest extent permitted by applicable law, including the Federal Electronic Signatures in Global and National Commerce Act, or any similar state law based on the Uniform Electronic Transactions Act, and the parties hereby waive any objection to the contrary.
