One Cool Earth Waiver and Release of Liability

By signing this waiver, I acknowledge that I am voluntarily participating in an event organized by One Cool Earth and its partners at their headquarters site (875 Laureate Ln., SLO). I understand that outdoor activities may involve inherent risks, including but not limited to weather conditions, uneven terrain, wildlife encounters, and other unforeseen circumstances.

 

This agreement is made on (select today's date below):

by and between One Cool Earth hereinafter referred to as “OCE” and (enter your full name below) participant: 

1. Assumption of Risk
I acknowledge and fully understand that participation in outdoor activities may expose me to risks of personal injury, property damage, or other potential hazards. I voluntarily assume all risks associated with my participation in this event, including but not limited to the risk of falls, contact with other participants, equipment failure, and any condition of the premises.

2. Waiver of Liability
In consideration of being permitted to participate in this event, I, on behalf of myself, my heirs, and personal representatives, hereby release, discharge, and hold harmless One Cool Earth, its officers, directors, employees, volunteers, and any other affiliated parties from any and all claims, liabilities, damages, or losses arising from or in connection with my participation in the event.

3. Medical Treatment Authorization
In the event of an injury or illness during the event, I authorize One Cool Earth to seek medical treatment on my behalf if I am unable to provide consent. I agree to assume full financial responsibility for any medical expenses incurred as a result.

 
4. Media Release
I grant permission for One Cool Earth to capture and use photographs or video recordings of me (or the participant listed above, if under 18) for promotional, educational, and outreach purposes, including social media, website, and printed materials.

5. Agreement to Respect Space, Fellow Participants and Land We as a community agree to uphold healthy communication if there are behaviors that become a pattern and do not feel safe to the group. If there is harm to the land, property, persons, or equipment, we will seek an appropriate solution and may ask participant(s) to not return. 

6. Weather Policy
Cancellations due to weather will not be refunded.
When severe weather is in the forecast, families will be alerted about the potential of an adjusted day, delay, or cancellation. Communication will be issued to families by 5 pm the evening prior to the affected session with the definitive plan. If severe weather happens unexpectedly, participants will shelter in the tent (for things like intense rain, hail etc). 

Conditions for a Canceled Day (Any one of these conditions will result in a delayed/canceled day):

High winds of 20 mph or more
Wind gusts of 40 mph or more
Heat index of 95°F or above by 10 am
More than 0.3 inches of rain/hour for more than 1 hour
Air Quality Index (AQI) above 125
Flood warning in effect for our site

Any combination of the following conditions will result in a delayed/canceled day:

25°F or below by 10 am
Heavy rain
Wind gusts of 30 mph or more
High winds of 15 mph or more
Lightning/thunderstorms

7. Acknowledgment of Understanding
I have carefully read this waiver, fully understand its terms, and sign it voluntarily. I acknowledge that by signing this waiver, I am giving up certain legal rights, including the right to sue One Cool Earth for any injuries or damages.
