    1. Right to refusal of adoption. The completion and submission of this form does not entitle you to adopt any animal(s) from SAM Your form will be processed by a SAM representative at their absolute discretion and at the discretion of the organisation’s
    committee. Should your form be approved, SAM may provide you with an animal or animals to adopt.

    2. Ownership of animals. Subject to these terms and conditions, all rights and title to any adopted animal is passed from SAM to you on the date on which you receive an adopted animal (receipt date).

    3. Payment of animals. The adoption fee for any SAM animal must be paid before the date on which you receive the animal (take the animal home).

    (i) For any animal advertised as being under the age of 9 weeks (or before vet work has been completed), a $50 non-refundable deposit must be paid via Paypal or Bank Transfer within 24 hours of the applicant meeting the animal (upon receiving adoption approval). Until the non-refundable holding deposit is received, the animal remains available for adoption to other potential applicants.
    (ii) For any animal advertised as being over the age of 9 weeks (once vet work has been completed), the adoption fee must be in full via Paypal OR Bank Transfer within 24 hours of the applicant meeting the the animal. Until the adoption fee is received, the animal remains available for adoption to other applicants.

    4. Property inspections. To ensure the safety and security of the adopted animal, you will permit SAM at any given time to inspect your property, and all parts of the property the adopted animal(s) will be kept. This will be applicable for a period of 24 months thereafter the approved adoption date.

    5. Compliance with laws. You agree to comply with all applicable laws in respect of any adopted pet.

    6. Microchip transfer. You agree to transfer microchip ownership into your name within 7 days of collecting any adopted SAM animal/s, as required by law and stipulated in the Cat Act WA 2011. If you were not provided a microchip transfer form at the time of adoption, please contact SAM immediately.

    7. Voluntary return/Prohibition of animals as gifts. You agree that you are adopting the animal for yourself and it is not to be sold, adopted or given to another party. If for any reason you can no longer care for or keep the animal, you must return the animal to SAM, and may not transfer ownership or possession of the animal to any third party including any other rescue groups, shelters, pound or alternate owner that is not approved by SAM in writing. Upon the return of the adopted animal, all rights and title regress back to SAM.

    8. Involuntary return. If within 24 months of the adoption date, SAM considers on reasonable grounds that you have not, are not, or are reasonably likely to not in the future, comply with this agreement, SAM may on 48 hours’ notice require you to return any adopted pet. On the return of the adopted pet to SAM, all rights and title of the adopted animal regresses back to SAM.

    9. Trial periods. All SAM animals over the age of 5 months are entitled to a trial period of 1 week. Should you feel during this period that the animal is not suitable, it must be returned immediately to SAM Animals under the age of 5 months are not entitled to a trial period.

    10. Refunds.

    (i) Animals over the age of 5 months: If you return an adopted animal who was over the age of 5 months at the time of adoption within one week of the adoption date, SAM. will give you a full refund of the adop-tion fee. If you return an adopted animal after one week from the adoption date, the extent to which you receive a refund is at the discretion of SAM.

    (ii) Animals under the age of 5 months: If you return/or change your mind about an adopted animal who was under the age 5 months of age at the time of adoption, you will not receive a refund.

    11. Health and temperament of animals. Any adopted SAM animal may have been at any time exposed to dan-gerous or unhealthy environments that have potentially had lifelong effects on the adopted animal. SAM makes no warranties or health and temperament guarantees of any adopted animal.

    12. Desexing of adopted S.A.M. animals.

    (i) Adopted cats and kittens: Adopted cats and kittens will typically be desexed (spayed or neutered) prior to their release however, some kittens may be released with a desexing voucher for one of our affiliated vets. If you are given a voucher, you agree to return the adopted SAM cat or kitten to the vet specified on the voucher provided when it reaches 6 months of age.
    (ii) Adopted dogs and puppies: Adopted Dogs will typically be desexed (spayed or neutered) prior to their release however, puppies under the age of 6 months may be released without having had the procedure completed. If you have adopted a SAM puppy that has not yet been desexed, you agree to return the puppy to one of SAM's associated vets for the required procedure when the puppy reaches 6 months of age. The procedure booking must be made by a SAM representative. Please contact SAM by email: info@savinganimalsmatters.org.au to request a preferred appointment date.

    13. Bar to action. You will not sue or take any legal action against SAM, concerning or relating in any way to any fostered SAM animal, other than a claim ascending from a breach of this agreement. SAM may lead this agreement in bar to any claim taken against SAM by you or any person claiming on your behalf.

    14. Release/ Indemnity. From the date that an adopted SAM animal is collected by you, you agree to indemnify SAM, its directors, representatives and volunteers against all liability costs including losses, injuries, damages or for the spread of any contagious disease, virus, infection or illness that any foster animal may have through the duration of a fostering term. You agree to release SAM, its directors, representatives and volunteers against any damages and expenses that you may incur in defending any claim by a third party as a result of yout actions or inactions as a Foster Care Volunteer or of a foster animal while in your care.

    15. Accuracy of information given. You confirm that the information you have given in this form is accurate to the best of your knowledge and belief.

    16. Applicable law. The law of Western Australia governs this agreement.

    17. Severance. If any provision of this Agreement is determined to be void or unenforceable, such determination shall not affect the remainder of this agreement, which shall continue to be in force.
