EXONERACIÓN Y LIBERACIÓN DE RESPONSABILIDAD
LEA DETENIDAMENTE ANTES DE FIRMAR. ESTE DOCUMENTO AFECTA SUS DERECHOS LEGALES.

En consideración a que se me permite participar en actividades de lanzamiento, incluyendo pero no limitándose al lanzamiento de hachas, cuchillos, lanzas, shurikens y palas (en adelante las “Actividades”) en Sticks and Stones Guatemala (en adelante “Sticks and Stones”), yo, el/la abajo firmante, reconozco, entiendo y acepto lo siguiente:

RECONOCIMIENTO DE RIESGOS:
Entiendo que la participación en las Actividades conlleva riesgos inherentes, peligros y posibles situaciones de riesgo que pueden resultar en lesiones graves o incluso la muerte. Estos riesgos incluyen, pero no se limitan a:
- Cortes, laceraciones, perforaciones u otras lesiones causadas por objetos punzocortantes.
- Lesiones por impacto de objetos lanzados o por rebotes.
- Lesiones por resbalones, tropiezos o caídas.
- Lesiones causadas por negligencia propia o de terceros.
- Otros riesgos no previstos.

ASUNCIÓN DE RIESGOS:
Asumo voluntariamente todos los riesgos, peligros y situaciones relacionadas con la participación en las Actividades, sean estos conocidos o no, previstos o imprevistos.

LIBERACIÓN DE RESPONSABILIDAD:
Por medio de la presente, libero, exonero, descargo y me comprometo a no presentar demandas contra Sticks and Stones, sus propietarios, representantes legales, directores, empleados, agentes, voluntarios y afiliados (en adelante “Liberados”), por cualquier tipo de responsabilidad, reclamo, demanda, acción legal o causa relacionada con pérdidas, daños o lesiones, incluyendo la muerte, que pueda sufrir yo o mis bienes, ya sea por negligencia de los Liberados o de otra índole, durante mi participación en las Actividades.

INDEMNIZACIÓN:
Me comprometo a indemnizar y mantener en paz y a salvo a los Liberados de cualquier reclamo, demanda, acción legal, responsabilidad, daño, costo o gasto, incluyendo honorarios legales, que resulten de mi participación en las Actividades.

REGLAS Y NORMATIVAS:
Acepto cumplir con todas las reglas y normativas de Sticks and Stones, incluyendo las medidas de seguridad y las instrucciones proporcionadas por el personal. Entiendo que el incumplimiento de dichas reglas puede resultar en mi expulsión del lugar.

ATENCIÓN MÉDICA:
Autorizo a Sticks and Stones a gestionar atención médica para mí en caso de una lesión, y acepto que seré responsable de los costos asociados con dicho tratamiento.

AUTORIZACIÓN DE USO DE IMAGEN:
Autorizo a Sticks and Stones a utilizar mi imagen o semejanza con fines promocionales.

DIVISIBILIDAD:
Si alguna disposición de esta exoneración se considera inválida, las demás disposiciones seguirán en pleno vigor y efecto.

ACUERDO COMPLETO:
Este documento constituye el acuerdo completo entre las partes y sustituye cualquier otro acuerdo previo, ya sea oral o escrito.

HE LEÍDO ESTE DOCUMENTO DETENIDAMENTE Y ENTIENDO SU CONTENIDO. FIRMO VOLUNTARIAMENTE ESTA EXONERACIÓN CON PLENO CONOCIMIENTO DE LOS RIESGOS INVOLUCRADOS.

ENGLISH VERSION

WAIVER AND RELEASE OF LIABILITY
PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

In consideration of being permitted to participate in throwing activities, including but not limited to axe throwing, knife throwing, spear throwing, shuriken throwing, and shovel throwing (hereinafter referred to as “Activities”), at Sticks and Stones Guatemala (hereinafter referred to as “Sticks and Stones”), I, the undersigned, acknowledge, understand, and agree to the following:

ACKNOWLEDGEMENT OF RISKS:
I understand that participating in the Activities involves inherent risks, dangers, and hazards, which may result in serious personal injury or death. These risks include, but are not limited to:
- Cuts, lacerations, punctures, and other injuries from sharp objects.
- Impact injuries from thrown objects or ricochets.
- Injuries from slips, trips, and falls.
- Injuries caused by the negligence of myself or others.
- Other unforeseen risks.

ASSUMPTION OF RISKS:
I voluntarily assume all risks, dangers, and hazards associated with participating in the Activities, whether known or unknown, foreseen or unforeseen.

RELEASE OF LIABILITY:
I hereby release, waive, discharge, and covenant not to sue Sticks and Stones, its owners, officers, directors, employees, agents, volunteers, and affiliates (hereinafter referred to as “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Releasees or otherwise, while participating in the Activities.

INDEMNIFICATION:
I agree to indemnify and hold harmless the Releasees from any and all claims, demands, actions, causes of action, liabilities, damages, costs, and expenses, including attorney’s fees, arising out of or related to my participation in the Activities.

RULES AND REGULATIONS:
I agree to abide by all rules and regulations of Sticks and Stones, including safety rules and instructions provided by staff. I understand that failure to follow these rules may result in my removal from the premises.

MEDICAL TREATMENT:
I authorize Sticks and Stones to obtain medical treatment for me in the event of an injury, and I agree to be responsible for the cost of such treatment.

PHOTOGRAPHIC RELEASE:
I grant Sticks and Stones permission to use my photograph or likeness for promotional purposes.

SEVERABILITY:
If any provision of this waiver is held to be invalid, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT:
This waiver constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral.

I HAVE READ THIS WAIVER CAREFULLY AND UNDERSTAND ITS CONTENTS. I AM VOLUNTARILY SIGNING THIS WAIVER WITH FULL KNOWLEDGE OF THE RISKS INVOLVED.
