The Renter acknowledges and agrees that full custody, care, and control of the rented equipment transfers to the Renter immediately upon pickup and remains with the Renter at all times until the equipment is physically returned, inspected, and accepted by QUICK RENTAL LLC. During this entire period, the Renter assumes all risk of loss, theft, damage, destruction, liability, or injury of any kind, whether known or unknown, foreseeable or unforeseeable, and regardless of cause, fault, or negligence.
The Renter agrees to indemnify, defend, and hold harmless QUICK RENTAL LLC, its owners, members, managers, officers, affiliates, employees, agents, and representatives from any and all claims, actions, demands, damages, losses, liabilities, fines, penalties, judgments, costs, and attorney fees, whether asserted by the Renter, an insurer, or any third party, arising out of or related in any way to the rental, possession, towing, loading, unloading, storage, use, misuse, operation, or return of the equipment, including claims alleging negligence by QUICK RENTAL LLC, except to the limited extent prohibited by applicable law. These obligations survive expiration or termination of the rental.
The Renter is solely and exclusively responsible for any bodily injury, death, or property damage to any person or entity occurring while the equipment is in the Renter’s possession or control. This responsibility is absolute, non-waivable, and is not reduced, limited, or affected by the election of any loss or damage waiver.
The Renter agrees that the equipment is valued by QUICK RENTAL LLC at replacement-level condition and not depreciated value. In the event of damage or loss, QUICK RENTAL LLC retains sole discretion to determine whether the equipment will be repaired or replaced, the method and scope of repair, the repair provider, and the total cost. The Renter is responsible for all resulting charges, including repair or replacement costs, loss of use, diminished value, missing or damaged components, administrative expenses, transportation, storage, inspection costs, and any related fees.
The Renter represents and warrants that they have notified their insurance provider of their intent to tow, haul, or use rented trailer equipment and that applicable liability and physical damage coverage exists. QUICK RENTAL LLC does not verify, rely upon, or guarantee the existence or adequacy of such insurance. Failure of the Renter’s insurance to respond or provide coverage does not relieve the Renter of any obligation under this Agreement. The Renter waives all rights of subrogation and agrees that no insurer shall have any right of recovery against QUICK RENTAL LLC or its owners, members, or affiliates, regardless of fault.
The Loss / Damage Waiver (“LDW”), if elected, is optional, is not insurance, and does not replace insurance. LDW only limits the Renter’s financial responsibility for certain accidental physical damage to the equipment, subject to strict exclusions, and does not eliminate responsibility. LDW does not apply to bodily injury or death, third-party property damage, theft or disappearance, total loss, misuse, abuse, negligence, recklessness, intentional acts, overloading, improper towing, or any prohibited use.
If LDW is elected, the Renter’s responsibility for covered accidental physical damage is capped at either One Thousand Dollars ($1,000) per occurrence under the standard package or Five Hundred Dollars ($500) per occurrence under the enhanced package. The enhanced package provides only a reduced deductible and does not expand the scope of covered damage. An occurrence is defined as a single incident or event; separate incidents constitute separate occurrences, each subject to a separate deductible. In all cases, the Renter remains responsible for loss of use, diminished value, administrative costs, missing components, and all excluded damage.
