VOLUNTEER, STAFF, CONTRACTOR, AND REPRESENTATIVE AGREEMENT AND LIABILITY WAIVER
This Release and Waiver of Liability (the "Release") is executed on this date by the undersigned individual (the "Participant"), including but not limited to volunteers, staff members, contractors, interns, board members, advisors, program facilitators, camp counselors, or any other individual acting on behalf of or in association with Reborn Ranch in any official capacity (collectively, "Representatives"), in favor of Reborn Ranch, its directors, officers, employees, and agents (collectively, "Reborn Ranch").
1. Participant Status:
I, the Participant, acknowledge that I am either freely volunteering my services to Reborn Ranch without expectation of payment, am employed by Reborn Ranch as a staff member, am serving in an advisory or leadership capacity (such as a board member or program facilitator), or am providing contracted services as an independent contractor. I understand that my role may involve physical labor, interaction with animals, outdoor activities, and working with youth. Additionally, I recognize that Reborn Ranch provides opportunities for learning life skills, including but not limited to, working with horses, caring for animals, and assisting with ranch maintenance.
2. Minor Volunteers:
Any individual under the age of 18 who wishes to volunteer at Reborn Ranch must have prior written consent from a parent or legal guardian. The parent or legal guardian must review and sign this agreement on behalf of the minor before they are permitted to participate in any activities. Minor volunteers must adhere to all Reborn Ranch policies and will be supervised at all times during their participation.
3. Assumption of Risk:
I acknowledge and understand that my activities may involve risks, including but not limited to, personal injury, property damage, accidents, and exposure to natural elements. This includes risks associated with handling horses, livestock, and other animals, as well as participating in activities that develop life skills such as operating ranch equipment, performing maintenance tasks, and assisting with structured training programs. I voluntarily assume all risks associated with participation as a Representative of Reborn Ranch.
WARNING
Under Iowa law, a domesticated animal professional is not liable for damages suffered by, an injury to, or the death of a participant resulting from the inherent risks of domesticated animal activities, pursuant to Iowa Code chapter 673. You are assuming inherent risks of participating in this domesticated animal activity. A number of inherent risks are associated with a domesticated animal activity. A domesticated animal may behave in a manner that results in damages to property or an injury or death to a person. Risks associated with the activity may include injuries caused by bucking, biting, stumbling, rearing, trampling, scratching, pecking, falling, or butting.
The domesticated animal may react unpredictably to conditions, including, but not limited to, a sudden movement, loud noise, an unfamiliar environment, or the introduction of unfamiliar persons, animals, or objects.
The domesticated animal may also react in a dangerous manner when a condition or treatment is considered hazardous to the welfare of the animal; a collision occurs with an object or animal; or a participant fails to exercise reasonable care, take adequate precautions, or use adequate control when engaging in a domesticated animal activity, including failing to maintain reasonable control of the animal or failing to act in a manner consistent with the person's abilities.
4. Release and Waiver:
I release, waive, and discharge Reborn Ranch from any and all claims, liabilities, or damages arising from my activities, including claims for personal injury, illness, death, or property loss, whether caused by negligence or otherwise.
5. Medical Treatment:
I consent to receive medical treatment if needed during my time at Reborn Ranch. I understand that Reborn Ranch does not carry or provide health or liability insurance for participants.
6. Conduct and Responsibility:
I agree to abide by all policies, procedures, and directions given by Reborn Ranch leadership. I will act in a respectful and responsible manner at all times, understanding that my actions reflect upon the Ranch and its mission.
7. Code of Conduct and Mission Alignment:
All Representatives of Reborn Ranch are expected to uphold the mission and values of the Ranch, acting with integrity, kindness, and respect toward all individuals. This includes:
Demonstrating honesty and accountability in all duties and interactions.
Treating fellow Representatives, campers, visitors, and staff with dignity and respect.
Refraining from any behavior that could harm the reputation, safety, or mission of Reborn Ranch.
Ensuring that all actions, decisions, and communications reflect the values of Reborn Ranch and its commitment to providing a safe and Christ-centered environment for all. Failure to abide by this Code of Conduct may result in immediate dismissal from the program or organization.
8. Professionalism for Representatives:
All Representatives of Reborn Ranch, including contractors, staff members, board members, and volunteers, are expected to conduct themselves with the highest level of professionalism. This includes adhering to agreed-upon schedules, maintaining clear and respectful communication, following all safety protocols, and ensuring high-quality work. Any Representative failing to meet these expectations may be subject to dismissal from their role or project.
9. Confidentiality and Privacy Clause:
Representatives agree to keep confidential any private or sensitive information they may encounter while serving at Reborn Ranch. This includes but is not limited to camper information, donor details, health records, emergency contact information, and internal operational plans. Any unauthorized disclosure of private information is strictly prohibited and may result in immediate termination and legal consequences.
10. Equipment Use and Responsibility:
Representatives acknowledge that they may use equipment, machinery, or vehicles while performing duties at Reborn Ranch. Representatives agree to use all equipment responsibly, follow safety guidelines, and report any malfunctions or damages immediately. Misuse or negligence may result in liability for damages or removal from duties.
11. Drug, Alcohol, and Tobacco Policy:
Reborn Ranch is a drug-, alcohol-, and tobacco-free environment. Representatives agree not to use or be under the influence of drugs, alcohol, or tobacco products while serving on-site. Any violation of this policy may result in immediate dismissal.
12. Termination of Participation:
Reborn Ranch reserves the right to terminate a Representative’s involvement at any time, for any reason, at its sole discretion. This includes, but is not limited to, failure to comply with the policies outlined in this agreement, engaging in unsafe or inappropriate behavior, or any conduct that jeopardizes the mission, safety, or reputation of Reborn Ranch.
13. Indemnification Clause:
The Representative agrees to indemnify and hold harmless Reborn Ranch, its directors, officers, employees, and agents from any claims, actions, damages, costs, or expenses arising from the Representative’s actions, negligence, or failure to adhere to the policies outlined in this agreement.
14. Background Check Authorization:
If my role involves working with youth, I agree to provide any necessary information for a background check and understand that Reborn Ranch reserves the right to deny opportunities based on its findings.
15. Sexual Abuse and Harassment Policy:
Reborn Ranch maintains a zero-tolerance policy for any form of sexual abuse, harassment, or misconduct. Representatives are expected to conduct themselves in a manner that is respectful, professional, and aligned with the mission of Reborn Ranch at all times.
16. Photo and Media Release:
I grant Reborn Ranch permission to use photographs, video, or audio recordings taken of me during my service for promotional and marketing purposes without compensation or further approval.
17. Legal Authority and Binding Effect:
I acknowledge that I am at least 18 years old, or my parent/legal guardian has signed this Release if I am under 18. This Release is binding upon me, my heirs, successors, and legal representatives.
I HAVE READ AND UNDERSTAND THIS RELEASE AND WAIVER OF LIABILITY, AND I VOLUNTARILY AGREE TO ITS TERMS.
