DEMO RIDE LIABILITY WAIVER & AGREEMENT G-FORCE POWERSPORTS

I, the undersigned, in consideration for being permitted to participate in a demo ride provided by G-Force Powersports and/or Indian Motorcycle of Denver (collectively referred to as "Dealer"), hereby acknowledge and agree to the following terms and conditions:

1. ASSUMPTION OF RISK
   1. I acknowledge that operating or riding as a passenger on a motorcycle, ATV, UTV, snowmobile, watercraft, boat or other powersports vehicle involves inherent risks, including the risk of serious injury or death. I voluntarily assume all risks associated with this demo ride.
2. DRIVER REQUIREMENTS
   1. I affirm that I am at least 18 years old and possess a valid driver’s license with the appropriate motorcycle endorsement (if applicable).
   2. I agree to provide a REAL ID-compliant driver’s license for verification before participating in the demo ride.
   3. I certify that I am not under the influence of alcohol, drugs, or any substances that impair my ability to operate the vehicle.
   4. I agree to wear closed-toe shoes, boots, and long pants during the demo ride.
   5. I acknowledge the importance of safe riding practices and have been informed about risks and safety procedures, protocols and laws.
3. VEHICLE RESPONSIBILITY & DAMAGE AGREEMENT
   1. I am fully responsible for any and all damages to the demo vehicle that occur during my test ride, regardless of fault.
   2. In the event of an accident or damage, I agree to reimburse the Dealer for the full cost of repair or replacement as determined by the Dealer.
   3. I authorize the Dealer to charge my credit card or other form of payment for the amount of damage incurred.
   4. I am responsible and liable for any and all damages to any other person, vehicle or property. 
4. RELEASE OF LIABILITY AND INDEMNIFICATION
   1. I, on behalf of myself, my heirs, successors, assigns, and legal representatives, hereby release, discharge, and agree to hold harmless G-Force Powersports, Indian Motorcycle of Denver, their officers, employees, agents, affiliates, and manufacturers from any and all liability, claims, demands, losses, or damages arising from my participation in this demo ride, including those caused by negligence. 
   2. I acknowledge that G-Force Powersports and Indian Motorcycle of Denver do not provide insurance coverage for the demo ride, and I am responsible for any injuries, damages, or liabilities arising from my participation.
   3. I agree to indemnify and defend G-Force Powersports and Indian Motorcycle of Denver against any claims or legal fees arising from my actions during the demo ride, including claims for injury or property damage by third parties.
5. SAFETY REQUIREMENTS
   1. I agree to wear a DOT-approved helmet, gloves, long pants, closed toe shoes, eye protection, and any other required safety gear during the demo ride.
   2. I will follow all traffic laws, dealership policies, and ride guidelines as instructed by Dealer staff. I understand that a pre-ride safety inspection will be conducted on the demo vehicle, and I will acknowledge its condition before riding.
6. ACKNOWLEDGEMENT OF TERMS
   1. I affirm that I am in good physical and mental condition, free of any conditions that may impair my ability to operate a powersports vehicle safely.
   2. I understand that I am responsible for any medical expenses incurred due to injuries sustained during the demo ride and authorize G-Force Powersports to obtain emergency medical care on my behalf, releasing them from liability related to such care.
   3. I agree that any dispute arising from this agreement shall be resolved through binding arbitration in Colorado, in accordance with the rules of the American Arbitration Association.
   4. I grant G-Force Powersports and Indian Motorcycle of Denver permission to take and use photographs or video footage of me during the demo ride for promotional purposes.
   5. I acknowledged that all demo rides are a maximum of two (2) miles and maximum of five (5) minutes. 
7. I have carefully read and fully understand this Demo Ride Liability Waiver and Agreement. I voluntarily participate in the demo ride and accept full responsibility for my actions. I understand that by signing below, I am waiving certain legal rights, including the right to sue.
