RELEASE & WAIVER OF LIABILITY & MEDIA WAIVER
I understand that participation in dance training at Soul Speak Dance LLC (“SSD”) is my choice and carries inherent risks, including the possibility of minor or major injury. I agree to take full responsibility for my personal safety by not exceeding my limits. I acknowledge that SSD and its instructors are not liable for any injuries I may sustain during class. Furthermore, I understand that SSD instructors have the authority to require me to leave a class if they believe my participation poses a risk to myself or others. I acknowledge that instructors may offer physical adjustments to improve technique and alignment. If I prefer not to receive physical adjustments, I will inform the instructor before class begins.
I hereby release, waive, discharge and covenant not to sue SSD, and each of their directors, officers, agents, volunteers and employees, (hereinafter referred to as “Releasees”) from all liability to the undersigned, his/her personal representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demands therefore on account of injury and/or exposure to infectious syndromes or diseases to the person or property or resulting in illness of the undersigned arising out of or related to the event(s), whether caused by the negligence of the releasees or otherwise. By participating or attending this event you assume all risks whether known or unknown.
I hereby agree to indemnify and save and hold harmless the Releasees and each of them from any loss, liability, damage, or cost they may incur arising out of or related to the dance training whether caused by the negligence of the Releasees or otherwise.
I further expressly agree that the foregoing liability waiver is intended to be as broad and inclusive as its permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the remainder of the agreement shall, notwithstanding, continue in full legal force and effect.
I hereby grant to the Releasees (and grant to the Releasees the right to grant to others), as well as their successors and assigns, in perpetuity, the irrevocable right (but not the obligation), with or without my knowledge, to film, tape, photograph, record, exhibit, edit, alter, copy, reproduce, license, sell, rent, disclose, display, publish, distribute, broadcast, webcast, prepare derivative works from or otherwise preserve, use and/or exploit in any format and/or manner now known or hereafter developed, whether commercial or non- commercial in nature (collectively, the “Use and Materials”): (1) my appearance at and/or participation in the dance training; (2) my name, likeness, voice, singing voice, conversation, sounds, biographical data, testimonials, and/or any other information or material secured by the Releasees in connection with my appearance at and/or participation in the dance trainings. I agree that Releasees shall have the right to the Use and Materials, for their own account, throughout the universe and in perpetuity. I acknowledge and agree that I shall not be entitled to receive any compensation whatsoever in connection with the Releasees’ exercise of its Use and Materials rights.
I agree that SSD may use such photographs of me with or without my name and for any lawful purpose, including, for example, such purposes as publicity, illustration, advertising, and Web content.
I have read this release and waiver of liability, assumption of all risk, and indemnity agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and voluntarily without any inducement, assurance or guarantee being made to me and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
By signing below, I further understand and acknowledge that (i) SSD has the right to refuse services and classes to any individual at anytime, (ii) that all class discounts have an expiration date, after which time, the classes are no longer valid, (iii) that classes are non-transferable, and (iv) that I have read and accept SSD’s Rules of Conduct.
