Danny’s Cycles NY, LLC (“Danny’s Cycles”) is pleased to be of service to you by
loaning you a bicycle and safety equipment. Please review the following procedures & ensure your understanding before you ride your bicycle and the safety equipment we have issued you.
1. I understand that this bicycle is a vehicle and is subject to all vehicular laws which I agree to abide by.
2. I assume all risks and hazards involved with cycling and assume all personal liability in case of injury.
3. I have been properly instructed in, and fully understand the use of the quick-release mechanisms, brakes, gears, suspension, and all foot retention devices on this bicycle.
4. In consideration of the services provided to me by Danny’s Cycles, in the event of an occurrence, accident, or loss while operating my bicycle, I hereby agree to release and hold harmless Danny’s Cycles and its employees from any and all claims and causes of action, liabilities, costs or losses for property damage or physical or mental injuries, relating to or
in any manner connected with the equipment loaned to me by Danny’s Cycles. I also agree that this release binds my spouse, heirs, legal representatives, and assigns.
5. I acknowledge that these Danny’s Cycles’ bicycle products have been loaned to me in sound mechanical condition, and will be returned in the same condition, at or before the end of the rental period.
6. I assume and agree to pay for all losses or damages incurred to the equipment which are not deemed as “normal wear and tear.” Including but not limited to: Crashed or damaged components, derailleur, shifters, rims/wheels, saddles, handlebars, frame/fork, flat inter-tube, and theft.
7. I assume and agree to pay a cleaning charge of $65.00 if I do not return the rental equipment in the same condition as I received them.
8. I can cancel the reservation no less than 48 hours before the pick-up date/time. If I cancel my reservation within less than 48 hours, I will be forfeiting the reservation fee.
9. I understand that the rental equipment is due back on the date/time as noted on my reservation. Late returns will be charged for an additional day. I also understand if the rental equipment is not returned within 48 hours from the rental end date/time, we reserve the right to charge your credit card the full amount for the rental equipment.
10. It is my responsibility to inform Danny’s Cycles of any damage to the rental equipment. If I fail to provide notification of damage, any subsequent claims will not be considered.
11. I acknowledge that as a security deposit, Danny’s Cycles reserves the right to authorize my credit card for the total amount of the rental equipment.
12. Rental fees may be used as a store credit towards the purchase of a similar style bicycle within 30 days of the rental for the rider of that rental ONLY. Credit can only be equal to the price of one reservation. Credit cannot exceed 25% of the bicycle's sale price and cannot be used for any other items. This credit is non-transferable and holds no cash value.
13. I will return the rental equipment to the Danny’s Cycles location I received them.
