Member agrees that this membership provides you with access to the number and type of sessions based on membership level chosen above. It is not a redeemable or transferable service or product in an event you do not use all your available sessions, including mini sessions, upon membership expiration or if you move. If your membership comes to an end and you have unused sessions, they will not be converted into monetary or studio credit in any form for later use, nor will they rollover to a new membership in the event of a contract renewal.

Unless re-enrolled for another full term, delivery of services under your membership will not be extended past end of your membership term final month for any reason including but not limited to lack of membership utilization, moving, family travel, illness, busy personal life, or other unforeseen circumstances.

Gallery Access and Image Availability:

After the first photography session, members will receive a gallery link to access and view their session images. The gallery link will remain active for as long as the individual maintains their membership. During the active membership period, images can be purchased and downloaded to the member's personal device.

Expiration of Membership and Post-Membership Access:

Upon expiration of the membership, the former member will have a grace period of one (1) year from the date their membership expires to download all images from their gallery onto their personal device.

Deactivation of Gallery After Grace Period:

After the one-year grace period following membership expiration, the gallery link will be deactivated, and the images will no longer be accessible. The photographer will not retain or maintain any copies of the images beyond this period. It is the responsibility of the member to ensure all images are downloaded within the one-year grace period provided after membership expiration.

Member agrees to pay the agreed upon membership fee plus applicable taxes each month thereafter on the credit card supplied via Stripe subscription link sent separately.

Members commit to a full 12-month membership. There are no refunds or studio credit on money paid to member for membership cancellation or discontinuation for any reason. If a member cancels the membership before the 12-month commitment is fulfilled, or if payment lapses due to a canceled credit card or other issues, all services, products, and digital images received will be converted to non-member a la carte pricing listed on our website www.nestphotostudio.com at the time of cancellation. The member will be responsible for paying the difference between membership pricing and non-member rates for any sessions or products already provided. By signing below, the member agrees to these terms and acknowledges the obligation to fulfill the full 12-month commitment or pay the adjusted rates.

Cancellation Notice: A minimum of twenty-four (24) hours' advance notice is required for the cancellation of any scheduled appointment. Cancellations made without the required notice will result in a charge to the credit card on file in the amount of the a la carte cost of the scheduled service ($295), to cover the photographer's time and the lost use of the studio.

Rescheduling:

If you need to reschedule your session with less than twenty-four (24) hours’ notice, a $25 change fee will apply, due to the photographer's time and studio availability. Note that re-shoots are not available for regretful hair or clothing choices. We can allow no more than one re-shoot appointment during the course of your membership for reasons such as a child's unwillingness to participate in the session.

No-Show or Late Arrival:

Failure to show up for your session, or arriving more than ten (10) minutes late, will result in a charge to your credit card for the current non-Member rate for the booked session type. Please note that if you are more than ten (10) minutes late, we cannot guarantee your session will proceed, regardless of circumstances.

Holiday Sessions:

Holiday sessions booked during the months of October, November, and December are non-reschedulable for any reason. Any cancellation or failure to attend such a session will result in the forfeiture of the session.

Nest Photo Studio retains copyright ownership of all images created as a result of this contract. Member may reproduce images for personal use only and may not use files for any promotion, advertising, campaigns, or non-profit use without express written permission from the Nest Photo Studio owner.

Nest Photo Studio takes utmost care with respect to the exposure, development and delivery of images. However, in the event that the studio fails to comply with these terms, the studio's liability is limited to refund of previously paid retainers. French Media Group, LLC d/b/a Nest Photo Studio cannot be held responsible for product damages incurred after the product has left the studio or loss of digital products or images. Should Nest Photo Studio close for any reason during the course of your Membership, you will be given opportunity to use your sessions and receive your digital files during a shortened period of time and last payment to the studio will be made during the same month of closing. A session agreement, which outlines our liability policy regarding your safety must be signed each time you have a session scheduled. An automated email will be sent requesting your signature.

This contract is entered into with French Media Group LLC, as the studio owner doing business as Nest Photo Studio ("NPS"). The studio owner, NPS reserves the right to assign any and all portion of its rights and interests in this agreement to any entity which is affiliated with French Media Group LLC and the member shall thereupon have all of the same duties and obligations to said assignee as if said assignee had been the original contracting party hereto. Contract will remain in effect if French Media Group LLC relocates Nest Photo Studio within a 25 mile radius of current location at 8145 Ardrey Kell Road, Set 102, Charlotte, NC 28277.

Member agrees to adhere to a code of conduct, which includes mutually respectful communication and treatment of all Nest Photo Studio staff and associates. Our studio is built with your children in mind but we ask that you do watch over them at all times. In an unlikely event, we reserve the right to refuse service and end your membership early due to repeated conduct violations.

By signing below, I acknowledge that I have read and agree to the terms and conditions of this agreement.

I hereby authorize French Media Group LLC (dba Nest Photo Studio) to charge my credit card on a monthly basis during the agreed upon membership term.
