RELEASE AND WAIVER OF LIABILITY AGREEMENT
This Release and Waiver of Liability Agreement ("Agreement") is made and entered into by the Team Manager, on behalf of all parties associated with his/her team (the "Team"), in connection with participation in the Central Texas (CenTex) BBQ Roundup (CTBR) event.
1. Release and Indemnification
The Team Manager, on behalf of the Team, hereby agrees to release, indemnify, defend, and hold harmless Central Texas (CenTex) BBQ Roundup (CTBR), International BBQ Cookers Association (IBCA), the Cadence Bank Center (CBC), and any sponsors, affiliates, or related entities involved in the event, including, but not limited to, CTBR & CBC, its officers, directors, managers, shareholders, employees, agents, landlords, lessees, sponsors, representatives, volunteers, and affiliates (hereafter collectively referred to as the "Released Parties").
The Team expressly waives and releases the Released Parties from any and all liability, responsibility, damages, losses, claims, demands, actions, suits, judgments, costs, and expenses (including attorneys' fees) resulting from personal injury, accident, illness, death, and/or property loss or damage, including but not limited to theft, fire, and any form of simple, active, or passive negligence of the Released Parties.
2. Assumption of Risk
The Team acknowledges and fully understands that participation in the event involves inherent risks, including but not limited to injury, property damage, or other potential harm. By agreeing to the Terms and Conditions of this Agreement, the undersigned voluntarily assumes all such risks on behalf of the Team and agrees that the Released Parties shall not be liable for any claims or damages arising out of such risks.
3. Waiver of Legal Claims
Notwithstanding any legal remedies available, the Team expressly waives all claims against the Released Parties arising from any cause, including but not limited to:
- The actions, omissions, or negligence of the Team, its agents, employees, or anyone acting on its behalf;
- The use or display of any equipment, machinery, or other items by the Team at the event.
This waiver extends to any and all claims of liability imposed by law, including but not limited to claims based on premises liability, general negligence, or any other legal theory of recovery.
4. Compliance with Event Rules
The undersigned acknowledges that they have read, understood, and agree to abide by the rules and regulations governing the Central Texas (CenTex) BBQ Roundup (CTBR) event. The undersigned further represents and warrants that they have the full authority to sign this Agreement and legally bind the Team to its terms.
5. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflicts of law principles. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Bell County, Texas.
6. Acknowledgment
By accepting these Terma and Conditions, the Team Manager affirms that they have read this Release and Waiver of Liability Agreement, fully understand its terms, and agree to be legally bound by them on behalf of the Team.
