Beta Tester Agreement
This Beta Tester Agreement ("Agreement") is entered into between Build Your Education LLC ("Company"), a limited liability company, and the individual signing below ("Beta Tester") as of the date of signature ("Effective Date"). The Company is offering beta testing of its educational materials, and the Beta Tester agrees to participate under the terms outlined below.
1. Purpose
The purpose of this Agreement is to allow the Beta Tester to test and provide feedback on the Company’s educational materials, including lesson plan books and student workbooks for Language Arts, Science, US History, and World History ("Beta Materials"), prior to their official release.
2. Beta Materials Provided
The Company will provide the Beta Tester with access to the Beta Materials, which include:
- Lesson plan books covering all subjects (Language Arts, Science, US History, and World History).
- Student workbooks covering all subjects, tailored to grade levels K-8 or specific learning levels (K-2, 3-5, 6-8) as applicable.
Pricing: Lesson plan books are provided at a discounted rate of 50% off the published price to cover printing costs: $40.00 each (regularly $79.99).
- Student workbooks are provided at the full published price: $19.99 each.
3. Beta Tester Obligations
The Beta Tester agrees to:
Use the Materials: Actively use the Beta Materials in an educational setting (e.g., homeschooling, cooperative, or small group environment) for a period of 18 weeks (one full semester) from receipt ("Testing Period"), unless otherwise agreed in writing.
- Provide Feedback: Submit detailed feedback to the Company at the following intervals:
Week 3: Initial feedback on usability, content quality, errors, and early student reactions.
- Week 6: Feedback on usability, content quality, errors, and student engagement after initial implementation.
- Week 9: Mid-term feedback on usability, content quality, errors, student reactions, and early observations on learning gaps.
- Week 12: Feedback on usability, content quality, errors, student engagement, and progress on learning gaps.
- Week 15: Feedback on usability, content quality, errors, student outcomes, and effectiveness in bridging learning gaps.
- Week 18: Final, comprehensive feedback including all prior points plus suggestions for improvement, confirmation of learning gaps bridged, and overall student outcomes.
- Submission Method: Feedback will be submitted via email to an address provided by the Company or through a designated online form, as specified by the Company.
4. Payment
The Beta Tester agrees to pay the discounted rate for lesson plan books and the full price for student workbooks upon signing this Agreement or as invoiced by the Company.
Payment will be made via a method specified by the Company (e.g., online payment link, check).
5. Confidentiality
The Beta Tester agrees to keep the Beta Materials and any proprietary information shared by the Company confidential and not to disclose them to third parties, except as needed for testing purposes (e.g., with students or co-educators directly involved).
This obligation survives the termination of this Agreement.
6. Ownership and Rights
The Beta Materials remain the intellectual property of Build Your Education LLC.
The Beta Tester may retain the physical copies provided but does not gain any rights to reproduce, distribute, or sell the Beta Materials.
7. No Warranty
The Beta Materials are provided "as is" for testing purposes. The Company makes no warranties regarding their completeness, accuracy, or fitness for a particular purpose.
8. Termination
Either party may terminate this Agreement with written notice if the other party breaches its terms.
Upon termination, the Beta Tester must cease using the Beta Materials and return or destroy any copies as requested by the Company, except those purchased and retained for personal use.
9. Limitation of Liability
The Company is not liable for any damages arising from the use of the Beta Materials, including but not limited to educational outcomes or printing issues.
10. Miscellaneous
This Agreement is governed by the laws of the state in which Build Your Education LLC is registered.
Any amendments must be in writing and signed by both parties.
