Mechanical Bull Riding/ Red Neck Log Slammer - Release of Liability, Waiver of Claims Express Assumption of Risk and Indemnity Agreement

Express Assumption of Risk Associated with Mechanical Bull Riding/ Red Neck Log Slammer

I, do hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with Mechanical Bull Riding activities/ Red Neck Log Slammer, transportation of equipment related to the activities, and traveling to and from activity sites of which I am about to engage in. Inherent hazards and risks include but are not limited to:

* Risk of injury from the activity and equipment utilized in Mechanical Bull Riding and Red Neck Log Slammer usage is significant and includes the potential for permanent disability and death.

* Possible equipment failure and/or malfunction of my own or other’ equipment.

*The rotation and bucking movement of the Mechanical Bull or Log Slammer will cause me to fall off to the Bull/ Log in an uncontrollable manner.

Riders must be 48 inches tall - Small children may board for a photo-op only with an adult next to them. 

* My own negligence and/or the negligence of other, including employees, agents, independent contractors or representatives of Big Bright Bounces LLC. Including but not limited to operator error.

*Injury to hands, fingers, feet and toes, including but not limited to inflammations and/or strain of muscles ligaments and/or tendons, nerve damage or compression, and broken bones.

* Broken bones, severe injuries to the head, neck, and back which may result in severe physical impairment or even death.

* Exposure to outdoor elements, including but not limited to inclement weather, thunder and lightning, severe and or varied wind, temperature or weather conditions, or the presence of flying insects/animals or other flying objects.

*Heat or sun related injuries or illnesses, including sunburn, sun stroke or dehydration.

* My sense of balance, physical coordination, and ability to follow instructions.

I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. I understand that the risks associated with the activity cannot be eliminated without jeopardizing the essential qualities of the activity.

Release of Liability, Waiver of Claims, and Indemnity Agreement

* I agree to release the Big Bright Bounces LLC, their officers, assigns, directors, employees, representative, agents, and volunteers, and vessels from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releases or otherwise. By executing this document, I agree to hold the releases harmless and indemnify them in conjunction with any injury, disability, death, or loss of damage to person or property that may occur as a result of engaging in the above activities.

* By entering into this agreement, I am not relying on any oral or written representation or statements made by the releases, other than what is set forth in this agreement. This release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforceable.

Media Release: I understand that by using Big Bright Bounces services that Big Bright Bounces has the right to the use of media depicting me or anyone else who may be covered by the Waiver, including but not limited to photographs, videos, or other media, taken by Big Bright Bounces relating to the use of the unit(s) herein without further release obtained from the party using Big Bright Bounces property. Consideration for Big Bright Bounces right to use media under this paragraph is taken into account under the terms of this agreement without further consideration to be provided by Big Bright Bounces.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I UNDERSTAND THAT I MAY CHOOSE NOT TO PARTICIPATE IN THIS ACTIVITY IF I DO NOT UNDERSTAND THIS DOCUMENT OR DO NOT WISH TO WAIVE MY RIGHTS OR ASSUME THE RISKS STATED HEREIN.
