1. Cancellations, Credits and Refunds
Trainings provided by the San Juan County Economic Development Council (EDC) have limited enrollment. Your enrollment, or that of a minor child in your care, reserves a place in this Training. If you, or your minor child, does not attend the Training, that position may be lost and unavailable to someone else. Therefore, the EDC has the following cancellation policy. You agree to be bound by this
policy.
If you cancel your attendance during the Training, there will be no refund of the program fee. If you cancel attendance 10 or more days prior to the commencement of the Training, the EDC will provide to you a credit in the amount of the program fee against a future Training. This credit shall expire one year from the date that the credit is issued.
If you, or your minor child, cancels participation less than 10 days before the commencement of the training, there will be no refund or credit of the program fee.
If the EDC cancels a training, the program fee shall be refunded to the credit card used in the transaction within one week of the cancellation. If you paid the program fee by check, a check will be issued to you within three weeks of the cancellation.
For those EDC Training programs that are contracted with an outside agency, the cancellation policy of that agency shall supersede the EDC’s cancellation policy.
2. Rules
The San Juan County Economic Development Council (EDC), its contractors that provide trainings, and the owners of properties on which trainings occur, have rules designed to ensure your safety, that of your minor child, and that of others participating in the Training. You agree to follow those rules. You understand that failure to follow those rules could result in expulsion from the Training. In the event
that you are expelled from the Training, you will not be provided a refund or credit of the program fee.
3. Waiver
To allow the EDC to provide this Training, we ask that you assume the risk of injury and property damage resulting from this Training. With this waiver, you assume this risk.
While the EDC takes safety seriously, there are risks with this training of which you should be aware. These risks include:
For workforce training programs, these risks include the possibility of personal injury or death and the possibility of damage to personal property. These risks may arise out of our failure to recognize or foresee these risks, to warn you about them, and to prevent them from occurring despite our efforts. These risks include but are not limited to the potential for electrocutions, explosions, falling materials, trips, slips and falls, machinery accidents, lacerations, falls, burns, eye injuries and loss, hearing damage and loss, burns, exposure to harmful and toxic substances, cuts, lacerations, and the loss of limbs, toes, and fingers.
For tech courses, these risks include the possibility of damage to your computer and computer equipment and software, including stored files, which may arise from your inexperience, your computer equipment or software failure, or out of our failure to recognize or foresee these risks, to warn you about them, and to prevent them from occurring despite our efforts.
As consideration for the services the EDC provides, you agree to assume the risks associated with the Training. You agree to hold the EDC and its directors, officers, employees, contractors, associates, and any other agents, and their successors and assigns, harmless, and to indemnify and defend the same, from any and all claims of personal injury, death, or property damage suffered by you or any minor child
in your care, including claims made by you or any other person, and arising in any way out of your participation, or that of any minor child in your care, in the Training, whatever the cause of the personal injury, death, or property damage, including the negligence of any person whether that person is associated with the EDC or not. Further, you agree to be responsible financially for any and all medical care that you, or the minor child in your care, are provided as a result of services that the EDC provides.
You understand that you are not obligated to enter into this agreement, and that if you decline to enter into this agreement, you will not be eligible to participate in the Training.
4. Consent of Parent or Legal Guardian
If you are executing this agreement in behalf of a minor child, you certify that you are that child’s legal parent or legal guardian. You authorize and consent to you minor child participating in the Training.
5. No Guarantee
The EDC does not guarantee certification for any of its training programs.
6. Photo and Video Release
The EDC and its contractors use photographs and video taken during its programs for promotional purposes. These promotions benefit the community by supporting the programs that the EDC offers. You can assist the EDC by initialing the paragraph below.
By initialing, you give the EDC, and the contractor that is providing the Training, an irrevocable, unrestricted license to use your likeness, or the likeness of your minor child, captured in photographs and videos taken at the Training, for the sole purposes of promoting future programs provided by the EDC and fundraising by the EDC, and the promotion and fundraising of the contractor that provided the Training if any.
