    Survey on Gender and Sexual Violence Experiences in the Cultural, Arts, and Creative Industries
  • 我們是一班藝文圈從業員及性/別議題關注者,現正透過關注婦女性暴力協會收集與「文藝及創意產業工作」相關的性別、性暴力及影像性暴力經驗,希望了解攝影、視覺藝術、表演藝術、電影電視等行業工作者涉及身體的工作經驗,包括前期商討、工作過程,以及後續展出、發布、買賣、收藏及版權擁有權。

    性別、性暴力及影像性暴力包括:在工作期間使用帶有性別歧視成份或性意味的語言、動作、態度或工作安排、未經同意觸碰或拍攝身體部位、以權力施壓要求進行涉及裸露或性意味的工作內容、在未取得事先同意下公開、發佈、散播、製作或出售涉及你身體或含性意味的影像或描述,以及在其他工作過程中所施行的涉及性別與性的騷擾、侵犯及暴力行為。

    通過收集對相關行為的認知數據及受害倖存者的經驗,我們希望進一步了解這類性別暴力及性暴力所帶來的影響、傷害與求助的困難,作為我們未來倡導的基礎。


    We are a group of practitioners in the arts and cultural sector and advocates for gender and sexuality issues. Currently, through the Association Concerning Sexual Violence Against Women, we are collecting experiences related to gender, sexual violence, and image-based sexual violence in the context of "arts and creative industry work." Our goal is to understand the experiences of body work in industries such as photography, visual arts, performing arts, and film and television, including the pre-production discussions, work processes, and subsequent exhibition, release, sale, collection, and copyright ownership.

    Gender, sexual violence, and image-based sexual violence include: the use of gender-discriminatory or sexually suggestive language, actions, attitudes, or work arrangements during work; non-consensual touching or photographing of body parts; coercion through power dynamics to engage in work involving nudity or sexually suggestive content; the public release, dissemination, production, or sale of images or descriptions involving your body or containing sexual implications without prior consent; and other harassment, assault, or violent behaviours related to gender and sexuality during work processes.

    Through collecting insights on these behaviours and the experiences of survivors, we aim to better understand the impact, harm, and difficulties in seeking help resulting from these forms of gender-based and sexual violence.

  • 本問卷分為兩部分。
    第一部分旨在收集您的個人經驗,填寫時間約為10分鐘;
    第二部分為意見調查,屬選擇性填寫,預計需時約30分鐘。

    This questionnaire consists of 2 parts.
    The first part aims to understand your personal experience in the industry, and will take approximiately 10 minutes to complete.
    The second part aims to understand your views and opinion, which is optional, and will take approximiately 30 minutes to complete.

  • 性暴力的定義是任何未經同意而帶有性意味的行為,包括插入式性侵犯、未經同意觸摸私密部位、性行為期間偷偷脫去安全套、性騷擾(言語或行為)、影像性暴力等等。

    Sexual violence is defined as any sexual act or attempted sexual act directed against another person without their consent, including penetrative sexual assault, non-consensual touching of private parts, stealthing (non-consensual condom removal), sexual harassment (verbal or physical), and image-based sexual violence, among others.

  • 問卷調查的第二部份,我們希望了解受訪者對於「文化藝術及創意產業工作性別及性暴力」的認知和看法,當中涉及16個情境及4個業界內常見的說法。完成這個部份約需時30分鐘。

    In the second part of the survey, we aim to understand respondents' awareness and views on gender and sexual violence in the art and cultural sector. This section involves 16 scenarios and 4 commonly heard statements within the industry. Completing this part will take approximately 30 minutes.

  • 前期商討 Discussion and Preparation

    以下有一系列情境題,請先花少許時間閱讀,再用你的直覺回答後續的問題。Below are some scenarios. Please take a moment to read through them, and answer the subsequent questions with your intuition.
  • 情境一 Scenario 1

    A在洽商工作內容期間,製作方不斷要求A提供身體部位的影像,並要求A分享過去裸露拍攝的經驗,否則就不會提供工作機會。

    During the discussion of work details, the production team repeatedly requested A to provide images of their body parts and asked A to share their past experiences with nude photography. They stated that otherwise, no work opportunities would be offered.

  • 情境二 Scenario 2

    B在參與試鏡的時候,突然被要求模擬性愛的情節,B害怕失去工作及被製作方標籤為麻煩,唯有接受。

    During an audition, B was suddenly asked to simulate a sex scene. Fearing the loss of the job and being labeled as troublesome by the production team, B felt compelled to comply.

  • 情境三 Scenario 3

    C與D洽商的工作中並沒有涉及性意味的演出,雙方同意工作內容。C要求在合約條款中明確列明工作內容不涉及性意味的互動或裸露身體的演出,惟D表示不能保證,及以保留創作空間為由拒絕,並表示這是行業常規,C唯有接受。

    In the work discussion between C and D, no sexually suggestive performances were involved, and both parties agreed on the work content. C requested that the contract explicitly state that the work would not involve sexually suggestive interactions or nudity. However, D stated that such guarantees could not be made and refused the request with the need to preserve creative freedom as reason. D also claimed this was standard industry practice, leaving C with no choice but to accept.

  • 情境四 Scenario 4

    E與F在洽談工作期間,E邀請F到其家中/酒店房間進行單對單的面試和試鏡。F表示希望經理人陪同,唯E要求F獨自出席,F因害怕失去工作機會而出席。

    E invited F to their home/hotel room for a one-on-one interview and audition during the job negotiation period. F expressed the wish for their manager to accompany them, but E insisted that F attend alone. F, fearing the loss of the job opportunity, attended.

  • 情境五 Scenario 5

    A聘請B工作,雙方同意進行涉及裸露身體的演出,但事前並未討論過演出包括含性意味的互動;在工作進行期間,A突然提出要求,並在討論中提及終止合約、扣取酬勞、和威脅損害聲譽等可能後果,B感到壓力,最後接受作出未經討論過的涉及性意味的演出。

    A employed B, both parties agreed to a performance involving nudity. However, there was no prior discussion about the performance including sexually suggestive interactions. During the course of the work, A suddenly made such a request and, during the discussion, mentioned potential consequences such as contract termination, withholding payment, and threats to damage B's reputation. Feeling pressured, B ultimately agreed to perform the sexually suggestive acts that had not been previously discussed.

  • 情境六 Scenario 6

    在涉及裸露身體與具性意味的拍攝的工作完成後,C向D提出性邀請,D拒絕,C聲稱會公開及散佈D的裸照及影片,D最後同意與其發生性行為。

    After completing a photoshoot involving nudity and sexually suggestive content, C suggested sexual invitation towards D. D refused, C threatened to publicly release and distribute D's nude photos and videos. D ultimately agreed to engage in sexual activity with C.

  • 情境七 Scenario 7

    E聘請F工作,雙方同意進行涉及裸露身體的拍攝,但事前並未討論過演出包括含性意味的演出;在工作進行期間,E不停以讚美去鼓勵F增加裸露程度,並引導F擺出具性意味的姿勢。F當時沒有抗議,但事後感到不適,要求E不要散佈影像,但E以F當時自願配合拍攝為由拒絕。

    E employed F, both parties agreed to a photoshoot involving nudity. However, there was no prior discussion about the performance including sexually suggestive content. During the shoot, E continuously flatter F with compliments to increase the level of nudity and guided F into posing in sexually suggestive ways. Although F did not protest at the time, F felt uncomfortable afterward and requested E not to distribute the images. F refused, claiming that F had voluntarily complied during the shoot.

  • 情境八 Scenario 8

    G聘請H工作,雙方同意進行涉及裸露身體及包括性意味的拍攝,但事前並未仔細討論過工作空間及拍攝安排;G在工作進行之前發現拍攝現場並沒有採取適合的措施保障其私隱,例如製作方以效率為名拒絕清場,G亦以專業為由要求H繼續演出。

    G employed H, both parties agreed to conduct a filming involving nudity and sexually suggestive content. However, they did not thoroughly discuss the workspace and filming arrangements beforehand. Before the work began, H discovered that the filming location had no appropriate measures to protect H’s privacy—for example, the production team refused to clear the set under the pretext of efficiency. Nevertheless, G, citing professionalism, requested H to continue performing.

  • 情境九 Scenario 9

    A聘請B工作,雙方同意進行涉及裸露身體與具性意味的拍攝,但並沒有同意影像將會用於出版及發行。在工作完成後,A在沒有與B商討的情況下,公開及散佈B的裸照及影片。

    A employed B, both parties agreed to filming involving nudity and sexually suggestive content. However, they did not agree that the footage can be used for publication or distribution. After the work was completed, A publicly released and distributed B's nude photos and videos without consulting with B.

  • 情境十 Scenario 10

    C聘請D工作,雙方同意進行涉及裸露身體的拍攝,並同意影像將會用於出版,但事前同意的出版方向不包括含性意味的呈現(作為情色作品出版);在工作完成後,C在沒有與D商討的情況下,以具有性意味的方式呈現及散佈D的照片及影片。

    C employed D, both parties agreed to film involving nudity, as well as the agreeing that the footage can be used for publication. However, the agreed-upon direction for publication did not include a sexually suggestive presentation (i.e., publication as erotic content). After the work was completed, C presented and distributed D's photos and videos in a sexually suggestive manner without consulting D.

  • 情境十一 Scenario 11

    E在與F分手後,以雙方過去的親密關係作為藍本進行創作,在不指名道姓的情況下,公開了其私密資訊及包括性生活的親密細節,F感到被影射及受威脅,要求E停止散佈,但F以自己沒有公開對方姓名及創作自由為由拒絕。

    After E and F broke up, E used their past intimate relationship as the basis for creative work. Without naming F directly, E publicly revealed private information, including intimate details about their sex life. F felt targeted and threatened by the implications and requested that E stop disseminating the material. However, E refused, citing the fact that E did not mention F’s name and claiming the right to creative freedom.

  • 情境十二 Scenario 12

    G多年前聘請當時16歲的H工作,雙方沒有簽合約,但口頭同意進行涉及裸露身體及具性意味的拍攝,G在多年後仍然持續出版及散佈H年輕時拍攝的影像。H希望G停止使用該影像,但G以雙方當時同意、自己擁有版權及創作自由為由拒絕。

    G employed H, who was than 16-year-old, for work many years ago. Although no contract was signed, they verbally agreed to conduct filming involving nudity and sexually suggestive content. Years later, G continued to publish and distribute the footage taken when H was young. H requested that G stop using the footage, but G refused, citing their mutual agreement at the time, G's ownership of the copyright, and G’s right to creative freedom as reason.

  • 情境十三 Scenario 13

    J曾經在非工作的情況下拍攝K的親密影像,後來把影像用於藝術創作,並在沒有諮詢K的情況下公開展示。K向負責展覽的藝術機構投訴,藝術機構以不知情、創作者擁有版權、及保障創作自由為由拒絕。

    J once filmed intimate footage of K in a non-work context and later used the footage for artistic creation. J publicly exhibited the work without consulting K. K filed a complaint with the art institution that is responsible for the exhibition. However, the institution refused to take action, citing a lack of prior knowledge, the creator’s ownership of the copyright, and the need to protect creative freedom as reason.

  • 情境十四 Scenario 14

    M同意在不公開其身分的前提下讓N拍攝及發佈私密影像作創作及出版用途,但N隨後發佈了該影像,但同時披露了M可辨識的身體特徵、樣貌等。

    M agreed to allow N to film and publish intimate footage for creative and publishing purposes, under the condition that M's identity would remain private. However, N subsequently released the footage, at the same time disclosed identifiable features such as M’s physical characteristics and appearance.

  • 情境十五 Scenario 15

    A屢次被指違反模特兒意願拍攝,B在知情的情況下,因為其藝術地位和價值為由,決定繼續收藏其涉及身體影像和性意味的作品。

    A was repeatedly accused of filming against the will of the models. Despite being aware of this, B decided to continue collecting works involving bodily imagery and sexual suggestiveness, citing the artistic status and value of the works as justifications.

  • 情境十六 Scenario 16

    C曾經在非工作的情況下拍攝D的親密影像,後來把影像用於藝術創作,並在沒有諮詢D的情況下把影像出售。D接觸買方投訴,買方以不知情、及自己對作品的擁有權為由拒絕歸還影像。

    C once filmed intimate images of D under non-work context and later used the images in artistic creations. C sold the images without consulting D. When D contacted the buyer to file a complaint, the buyer refused to return the images, citing lack of prior knowledge and buyer’s ownership of the artwork as reasons.
