BONORA SPORT WAIVER

This Agreement is entered into between Bonora Sport ("Club") and the undersigned ("Client" The provision of adult fitness, personal training, gymnastics, ninja warrior, parkour classes, events and birthday party services by the Club to Client, and Client's use of any premises, facilities or equipment are contingent upon this Agreement.

You acknowledge that participation in gymnastics, ninja warrior, parkour, fitness classes, events, and birthday party activities at Bonora Sport involves inherent risks, including but not limited to falls, collisions, and physical exertion. While Bonora Sport takes all reasonable precautions to minimize risks, injuries may still occur.

You agree that by engaging in any physical exercise or activity at our facility, you assume responsibility for any injury or damage you may suffer, except where Bonora Sport has failed to provide its services with due care and skill as required under the Australian Consumer Law (ACL).

Bonora Sport is committed to delivering services safely and professionally. Nothing in this waiver excludes, restricts, or modifies any rights or remedies you may have under the ACL, including liability for negligence where such exclusion is not permitted by law.

If you have concerns about your or your child’s ability to safely participate, we encourage you to speak with our staff before engaging in activities.

 

I grant Bonora Sport, its representatives, and employees the right to take photographs and videos of my child during classes, events, birthday parties, and activities. I authorize Bonora Sport to use, edit, publish, and distribute these images and videos for promotional, marketing, and educational purposes, including but not limited to social media, websites, and printed materials. I waive any rights to compensation or claims related to the use of these images.

You agree, on behalf of yourself and your representatives, executors, administrators, and agents, to release and discharge Bonora Sport (including its affiliates, employees, directors, volunteers, agents, and representatives) from any and all claims or causes of action, except where Bonora Sport has failed to provide its services with due care and skill as required by Australian Consumer Law (ACL).

This waiver does not exclude, restrict, or modify any rights or remedies available under the ACL, including liability for negligence where such exclusion is not permitted by law.

This release includes, without limitation, injuries which may occur as a result of:
(a) Your use of any exercise equipment or facilities;
(b) Normal wear and tear of exercise equipment, premises, or facilities;
(c) Participation in activities that involve inherent risks, including gymnastics, ninja warrior, and parkour;
(d) Client misrepresenting their ability level;
(e) Slipping, tripping, or falling while on the premises;
(f) Traveling to or from Bonora Sport activities or events.

Bonora Sport takes reasonable steps to maintain a safe environment, but you acknowledge that participation in physical activities carries inherent risks. If you have concerns about your ability or your child’s ability to safely participate, we encourage you to discuss this with our staff before engaging in activities.

 

 

You acknowledge and agree that the foregoing release is intended to comply with all applicable laws in Victoria, Australia, including the Australian Consumer Law (ACL). If any portion of this waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full legal force and effect.

You understand that Bonora Sport is not a licensed medical provider and does not diagnose, examine, or treat medical conditions of any kind. If you or your child have any pre-existing medical conditions, it is your responsibility to consult with a qualified healthcare professional before participating in any activities. Any information provided by Bonora Sport, including but not limited to social media, blogs, emails, programs, services, or products, is for general educational and informational purposes only.

You acknowledge that participation in gymnastics, ninja warrior, parkour, adult fitness, events, and birthday party services involves inherent risks. While Bonora Sport takes reasonable steps to provide a safe environment, this waiver does not exclude or limit any rights or remedies under the Australian Consumer Law, including liability for negligence where such exclusion is not permitted by law.

For birthday parties and specific events, a Parent/Guardian may be required to remain present while their child participates, unless the activity is structured and supervised by Bonora Sport coaches. Please refer to event-specific guidelines for supervision requirements.

You confirm that you have carefully read and fully understand this waiver and release. By signing below, you expressly assume the risks associated with participation and agree to the terms outlined above.
