In consideration of permission granted by Keiki Education Living Independent Institute ("K.E.L.I.I.") allowing me to participate in any "Activity or Event", which is sponsored, hosted, organized and funded by K.E.L.I.I., I (together with my parent or guardian, if I am under the age of eighteen (18) or under a legal disability) represent, covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under or through me, as follows:
1. I acknowledge that participating in the Activity or Event involves certain risks (some of which I may not fully appreciate) and that injuries, death, property damage or other harm could occur to me or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my participation in the Activity or Event, including any associated travel, regardless of whether or not caused in whole or in part by the negligence or other fault of K.E.L.I.I. and/or its partners or sponsors their departments, trustees, affiliates, employees, officers, agents or insurers ("Released Parties").
2. I waive all claims against any of the Released Parties for any injuries, damages,
losses or claims, whether known and unknown, which arise during or result from my participation in the Activity or Event, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims.
3. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in the Activity or Event, regardless of whether or not caused in whole or part by the negligence or other fault of any of the Released Parties.
4. In this release, I acknowledge that I understand the intent thereof, and I hereby agree and absolve and hold harmless "K.E.L.I.I." corporate sponsors, cooperating organizations, and any other parties connected with this activity or event in any way singly or collectively from and against any blame and liability for any injury, misadventure, harm, loss, inconvenience, or damage hereby suffered or sustained as a result of participation in the event or any activities associated therewith.
PHOTOGRAPHY/VIDEO WAIVER:
For valuable consideration received, I grant to the Keiki Education Living Independent Institute ("K.E.L.I.I."), cofounders, coordinator, committee, representatives and assigns the permission & irrevocable right to use and publish photographs, still and/or moving including videos, of me and/or my guest/s in which we may be included, for the restricted purposes of promotion, including advertising, in any manner and medium; and to alter and composite the same without restriction and without my inspection and/or approval.
I hereby release "K.E.L.I.I.", cofounders, coordinator, committee, representatives, and assigns from all claims and liability relating to said photographs or videos.
The submission of this waiver form indicates I acknowledge that I have read, understand and agree with each waiver point. Furthermore, I acknowledge this form pertains to and includes all individuals registered by the responsible parent/guardian/caregiver. Failure to agree to any of these terms will result in denying participation in this activity or event.
