By submitting this form, you agree to the following terms and conditions for participation in the CIAF Art Fair Showcase.
1. Artwork Eligibility & Cultural Protocols
1.1. All artwork presented must comply with the CIAF Code of Practice and be original work created by Aboriginal and/or Torres Strait Islander artists with traditional connections to Queensland.
1.2. CIAF supports an authentic Queensland Indigenous art movement that celebrates both traditional and contemporary expressions through unique stories, motifs, and imagery. The use of cultural designs must reflect Queensland’s Aboriginal and Torres Strait Islander cultures and not those from outside Queensland (e.g., dot work from the Central and Western Desert or Arnhem Land rarrk cross-hatching).
1.3. CIAF, in consultation with relevant Traditional Custodians, reserves the right to remove any ceremonial objects or works that may be considered offensive or culturally inappropriate.
1.4. Exhibitors must have agreements with artists that align with the minimum terms of the Indigenous Australian Art Commercial Code of Conduct, whether or not they are signatories.
2. Deposit & Payment Terms
2.1. Upon acceptance, exhibitors must pay a non-refundable deposit of 25 % to secure their booth by 25th April.
2.2. Exhibitors must pay the full booth fee by COB 30 May 2025. Booth space is not secured until payment is received. Fees are non-refundable unless CIAF cancels the event.
2.3. Booth allocations are at the discretion of CIAF management. While preferences are considered, final placement is determined by the organisers.
3. Exhibition Space & Setup
3.1. Exhibitors must adhere to CIAF’s floor plan specifications and present works professionally.
3.2. Installation and hanging of the booth are the exhibitor’s responsibility unless otherwise arranged. Artworks must be stretched, framed, and ready for display.
3.3. Bump-in and bump-out must occur on designated dates. Uncollected items will incur storage fees.
4. Sales & Transactions
4.1. All artworks presented in the Art Fair Showcase must be for sale.
4.2. Exhibitors manage their own sales via their own POS system and are responsible for all financial transactions.
4.3. Institutional acquisitions may be subject to external processes outside CIAF’s control. Terms of sale must be negotiated directly between the exhibitor and the purchaser.
4.4. Sales Reporting: Exhibitors must report all sales daily through CIAF’s official sales platform for tracking and reporting purposes only.
5. Exhibitor Responsibilities
5.1. A representative must be present at the booth at all times during opening hours.
5.2. Exhibitors are responsible for their own travel, accommodation, and display materials (e.g., plinths, racks).
5.3. Hi-res images, artist bios, statements, and other requested details must be provided for CIAF’s website, catalogue, and program.
6. Insurance & Liability
6.1. CIAF provides basic insurance coverage for artworks during the event. Exhibitors are encouraged to obtain additional coverage for high-value pieces.
6.2. CIAF is not liable for any loss, theft, or damage to artworks unless directly responsible.
6.3. Force Majeure: If unforeseen circumstances (e.g., natural disasters, pandemics) impact the event, CIAF will seek alternative arrangements but is not responsible for incurred costs.
7. Marketing & Promotion
7.1. CIAF may use exhibitor images and details for promotional purposes, including the event catalogue, website, and social media.
7.2. Exhibitors are encouraged to actively promote their participation. CIAF will provide a marketing kit to support exhibitors in promoting their work.
7.3. CIAF reserves the right to photograph exhibitor booths for promotion and marketing.
7.4. Photography will be allowed throughout the Art Fair Showcase. If exhibitors wish to prohibit photography, they must notify CIAF in writing. Signage will be provided for booths upon request.
8. Code of Conduct
8.1. Exhibitors must conduct themselves professionally and respectfully with visitors, fellow artists, and CIAF staff.
8.2. Unauthorized products, offensive materials, or unrelated activities are prohibited. Violations may result in removal from the event.
8.3. Noise levels and booth aesthetics must comply with CIAF’s guidelines to maintain a respectful and engaging environment.
9. Copyright & Intellectual Property
9.1. Artists retain copyright over their work.
9.2. By participating, exhibitors grant CIAF permission to use images of their work for event promotions (catalogues, social media, website).
9.3. Artistic styles and themes are not protected by Australian copyright law (e.g., rarrk cross-hatching from NT, Quinkan motifs from Cape York). CIAF will consult with Traditional Custodians to uphold cultural protocols.
10. Termination & Withdrawal: Refund Policy
10.1. Cancellations 60+ days before the event → Possible partial refund, but the deposit remains non-refundable.
10.2. Cancellations less than 30 days before the event → No refunds will be issued.
10.3. CIAF reserves the right to terminate an exhibitor’s participation if they fail to comply with terms or present work that does not align with CIAF’s standards.
11. Force Majeure
If the event is cancelled due to unforeseen circumstances (e.g., government restrictions, natural disasters), refunds or credits for a future edition may be offered at the organiser’s discretion.
12. Booth Transfers
Booths cannot be resold or transferred to another exhibitor without prior approval from the organisers.
13. Dispute Resolution & Legal Jurisdiction
13.1. Disputes should first be resolved informally. If unresolved, mediation or arbitration will be pursued per CIAF’s policies.
13.2. Legal matters will be governed by the laws of Queensland, with disputes settled in Cairns courts.
14. Health, Safety & Accessibility
14.1. Exhibitors must comply with all health and safety regulations.
14.2. CIAF ensures an accessible environment for all visitors and exhibitors. Booths must accommodate individuals with disabilities.
15. Amendments & Governing Law
15.1. CIAF reserves the right to amend these terms and conditions. Any changes will be communicated to exhibitors and will become binding.
15.2. These terms are governed by the laws of Queensland, Australia.
