For and in consideration of the opportunity to participate in Windjammer Days activities and with knowledge of the inherent risks involved in sailing, yachting, boating and nautical activities in general, I hereby for myself, my heirs, next of kin, personal representative(s) and assigns fully and forever release, forgive, acquit and discharge the TOWN OF BOOTHBAY HARBOR, the FRIENDS OF WINDJAMMER DAYS,
The Shipyard at Bristol Marine, the ANTIQUE BOAT COMMITTEE, and all other organizations endorsing or sponsoring Windjammer Days activities and each and every officer, director, employee, servant agent, successor(s) or assigns of each and every such organization as well as each and every individual who organizes, participates in, endorses, sponsors or assists in Windjammer Days activities, as well as their heirs, and/or personal representative(s), jointly and severally of and from any and all responsibility or liability for any injury or damage to my person or property (including without limitation any diseases or effects thereof) as well as any and all claims, demands, actions, causes of action, loss, cost, expense of every kind, nature or description (including, without limitation, claims based on the alleged negligence of any party hereby released), which may arise or result directly from my participation in Windjammer Days activities. IN furtherance of the foregoing release, I hereby agree to indemnify, protect and forever save
harmless, each and every organization and individual released from liability hereinabove of and from any loss cost, expense, obligation, claim or liability including, without limitation, attorney’s fees arising directly or indirectly or out of any injury to me or my property as a result of my participation in any and all Windjammer Days activities.I HEREBY CERTIFY THAT I HAVE READ THE FORGOING DOCUMENT AND UNDERSTAND IT, AND ACKNOWLEDGE THAT: (1) BY SIGNING THIS DOCUMENT I AM WAIVING IMPORTANT LEGAL RIGHTS; (2) I HAVE HAD THE OPPORTUNITY TO CONSULT WITH COUNSEL OF MY CHOOSING AND TO THE EXTENT I BELIEVE NECESSARY OR APPROPRIATE I HAVE DONE SO; AND (3) THE EXECUTION OF THIS DOCUMENT IS MY FREE AND VOLUNTARY ACT AND DEED.
