Sun Fat Trading Company

1. By Signing the Credit Application you (the applicant) are hereby allowing and authorizing Sun Fat Trading Company to obtain your credit information with relative agencies
2. By executing this Credit Application, you, either as an individual, or as the owner, shareholder, partner, officer, of an entity, hereby agrees to be personally liable, jointly and severally, for any and all charges / debts incurred by the entity.
3. Sun Fat Trading Company at its option, may terminate this agreement and credit at any time. Should Sun Fat Trading Company terminate the agreement / credit, all charges / credit incurred shall become immediately due.
4. Once the payment is overdue, Sun Fat Trading Company at its sole discretion may immediately authorize its attorney to prosecute the delinquency and you, the applicant, agree to pay all charges incurred.
5. If any indebtedness incurred pursuant to this request for credit is not paid in full when due, the undersigned agrees to pay all costs of collection, including a reasonable attorney fee.
6. You, the applicant, further waive the jury trial and all matters shall be conducted by summary judgment, if it is permissible under the laws of the State of California.
7. I Attest that I understand the above completely and thoroughly.

3. Privacy Acknowledgement and Consent - Guarantor/s

By signing this application, you authorize Sun Fat Trading Company and any of our agents (as defined in the Privacy Act) to give to and obtain from a credit reporting agency:

• Certain personal information about you to allow you to be identified
• Information that you have offered to act as a guarantor
• Personal information and information as to your creditworthiness, credit standing, credit history and credit capacity, for the purposes of assessing your guarantee for personal credit given to another person
• We authorize all trade references, banks and credit reporting agencies to disclose to Sun Fat Trading Company any and all information concerning the financial and credit history of my company and myself.

By signing this application, you acknowledge that:

• We verify the identity of guarantors via the collection of personal information
• The personal information of guarantors is used only in connection with the proposed guarantee.

In addition to the authoriztions set out above in relation to credit reports, by signing this application you authorize us to:

• give to and obtain from your bank and/or other credit provider any record that has any bearing on your creditworthiness, credit standing, credit history or credit capacity:

1. For the purpose of assessing whether to accept you as guarantor for credit applied for or provided to the borrower/s
2. For any purpose related to the subsequent management of the credit guaranteed by you
3. For any purpose related to the enforcement or proposed enforcement of your guarantee, and/or
4. For the purpose of assessing the risk in purchasing any credit facility (being a credit facility given to or applied for by the borrower) from us and/or the risk in undertaking credit enhancement of any such credit facility, each as the case may be

1. I have read and accept the “Privacy Acknowledgement and Consent” and consent to such use and disclose of my personal information.
2. I acknowledge that you will rely on information in this form and that obtain from a credit agency reporting
3. Agency to make a decision as to whether to offer the applicant a commercial loan.
4. I have been truthful in all information provided and have not given false names in this application.
5. I understand that this form does not constitute and offer or acceptance of credit as defined in any legislation relating to the provision of credit.
