Should an emergency arise, I authorize WRTS Atlanta or Jig2Fit to seek medical and/or dental care for my child at the nearest medical facility. I understand that I am responsible for any financial expenses that may be incurred.

In consideration of being permitted by We Rock the Spectrum Kid’s Gym Atlanta (hereinafter “WRTS”), Jig2Fit, LLC and Jig2Fit Kids, LLC (collectively referred to herein as “Program Operators”) to participate in their After School Programs and to use their equipment and facilities, now and in the future, I, as parent or legal guardian of the minor listed above (hereinafter “Minor”), hereby grant permission necessary to allow Minor to participate in all related activities and agree to the terms of this Release of Liability, Indemnity Agreement, and Assumption of Risk Agreement (hereinafter “Agreement”).

I, on my own behalf and on behalf of the Minor, further agree to release, indemnify, and discharge the Program Operators—including their agents, owners, shareholders, officers, directors, partners, employees, volunteers, manufacturers, participants, lessors, affiliates, subsidiaries, successors, and assigns (collectively, “Released Parties”)—on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives, and estate, as follows:

I understand and acknowledge that the activities the Minor may voluntarily engage in bear known and unanticipated risks, which could result in physical, emotional, or mental injury, illness or disease, paralysis, death, or damage to Minor, to property, or to third parties. I understand that such risks cannot be eliminated without compromising the essential nature of these activities.

Risks include, but are not limited to: cuts, scrapes, bruises, muscle strains, broken bones, falls, and injuries resulting from use of equipment, peer interaction, or participation in supervised or unsupervised activities. Equipment may malfunction or be misused. Participants may collide, fall, or otherwise be injured. In any such case, I agree to assume full financial responsibility for any medical treatment or other costs arising from injury to the Minor.

I acknowledge that WRTS and Jig2Fit staff strive to ensure safety but may not be aware of every participant’s fitness level, behavior, or limitations. Staff may give incomplete instructions or be negligent in supervision, maintenance, or judgment. I voluntarily assume all such risks on behalf of the Minor.

I represent that I have full legal authority as parent or guardian to enter into this Agreement on behalf of the Minor. I agree to accept and assume all risks, whether or not described herein, and allow the Minor to participate despite such risks.

I further agree to forever release, discharge, defend, indemnify, and hold harmless the Program Operators and all Released Parties from any and all claims, causes of action, or liabilities connected to the Minor’s participation, including but not limited to negligence, omissions, or other acts by the Released Parties.

I agree to cover all legal costs, including attorney’s fees, should the Program Operators be required to enforce this Agreement or defend against claims brought by or on behalf of the Minor. I certify that I carry adequate insurance or accept full financial responsibility for any injury or loss incurred during participation.

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia. Any legal action arising from participation must be brought solely in Georgia, and Georgia law shall govern the dispute. If any provision is held invalid or unenforceable, the remainder shall continue in full force and effect.

I further understand and agree:

• This Agreement shall remain in effect for all future participation in After School Programs, events, and visits at this WRTS location.
• WRTS Atlanta is not a licensed childcare facility and is exempt from licensure requirements by the Georgia Department of Early Care and Learning.
• I authorize WRTS, Jig2Fit, and Jig2Fit Kids to photograph and/or record me or the Minor for promotional, marketing, or archival purposes, with full usage rights and without compensation. All images and recordings shall remain the property of the Program Operators.

I certify that the Minor is in good health and does not have a condition that would make participation inadvisable. I have read this Agreement in full, understand its terms, and agree to be bound by them. I also understand that, by signing, I may be waiving the right to pursue legal action for claims resulting from the Minor’s participation, including those arising from the negligence of the Released Parties.
