• Digital Art Commission Agreement

  • By completing this form, you are agreeing to the terms and conditions for commissioning digital artwork from DEVAUNTOON LLC. Please read through the contract details carefully.

  • 1. Project Overview

  • This Commission Agreement (the "Agreement") is entered into by and between DEVAUNTOON LLC, ("Artist"), and [Client's Full Name], ("Client"), collectively referred to as the "Parties," effective as of the date of signature.

  • 2a. Commission Pricing

    2D Illustration Pricing
  •       (Discounted Add-Ons for Extra Heads, Bodies, etc.)

    • Headshot (top of shoulders to top of head): $100
      Additional Headshots (up to 2 extra headshots in the same drawing): $30 each.
    • Half Body (waist up): $125
      Additional Half Bodies (up to 2 extra half bodies in the same drawing): $50 each.
    • Full Body (head to feet): $175
      Additional Full Bodies (up to 2 extra full bodies in the same drawing): $75 each.

      This shows that each additional headshot, half body, or full body is a discounted add-on to the base price of the first one.

     

    *All 2D illustrations will include a background that the Artist deems appropriate for the character, such as a simple plain background, a colored gradient, basic special effects, or minimal details. The Artist reserves the right to determine the complexity of the background to ensure that it aligns with the agreed pricing and timeframe. Any requests for more detailed or complex backgrounds may incur additional charges, based on the time and effort required.

  • 2b. Payment Structure

    2D Illustration
  • Art Process:

    • A non-refundable rough draft fee: of 20% of the total commission will be required before the artist begins any work on the rough draft. This fee ensures that the artist can begin working on your commission and is deducted from the total cost.

      • The rough draft fee will be deducted from the final price if the Client decides to move forward with the commission.

        Example for a Headshot ($100):
        20% of $100 = $20 rough draft fee.

        If the Client proceeds with the commission after reviewing the rough draft, the $20 fee will be applied to the total price of the artwork.

    • 50% Deposit (After Rough Draft Approval):
      Once the client approves the rough draft, a 50% deposit of the remaining balance is required before the final work begins. The deposit is non-refundable once paid.

    • Remaining Balance:
      The remaining balance will be due upon completion of the artwork. The client will receive the final artwork only once the balance is paid in full.

    • Sales Tax:
      All prices are exclusive of taxes. Sales tax will be added based on the applicable rate in the Client’s location at the time of payment.

      *Sales tax will be calculated and added at each payment stage (rough draft fee, deposit, and final balance).

  • 2c. Revision Process

    2D Illustration
  • The Client is entitled to review the rough draft of the artwork before proceeding to the final version. At this stage, the Artist will provide an initial sketch or concept (digital or pencil) to ensure that the Client’s vision aligns with the Artist's style. Any necessary changes can be made during this stage.

    • Rough Draft Revisions: The Client may request up to 2 adjustments or revisions to the rough draft. These revisions will be made before the final drawing. The revisions must be clearly defined, and the Client must provide feedback in a timely manner.

    • Final Drawing Revisions: Once the rough draft is approved and work on the final drawing or animation begins, major revisions may be limited. The Artist will provide updates throughout the creation process, and the Client will have the opportunity to request minor changes. However, please note that significant changes or alterations to the final artwork may not be possible once the artwork is completed.

    • In-Process Updates: If needed, the Artist will provide interim photos or updates via phone (or another method) during the creation process to ensure the Client’s satisfaction with the progress. These updates will give the Client the opportunity to suggest smaller adjustments before the final piece is delivered.
  • 2d. Project Timeline

    • The Artist will provide the Client with an estimated timeline for completing the commission. However, the timeline is an estimate and may be adjusted if additional revisions or complexities arise during the process.

    • The Client agrees to allow the Artist reasonable time to complete the Work, understanding that more detailed artwork, especially animation, may require more time than initially estimated.
  • 3. Cancellation & Refund Policy

    • After Rough Draft:
      If the Client cancels after receiving the rough draft consultation, the non-refundable rough draft fee will not be returned.
      If the Client cancels before the deposit payment is made, no further charges will be incurred.

    • After Deposit:
      If the Client cancels after paying the deposit, the deposit will be non-refundable.
      If the Client cancels after the final artwork has been completed, the full amount will still be owed to the Artist.
  • 4. Ownership and Rights

    2D Illustration
    • The Artist retains full rights to the artwork until the final payment has been made.

    • Upon full payment, the client will receive a non-transferable, personal-use license for the commissioned artwork. The artwork is created exclusively for the client and is not to be sold or used for commercial purposes without additional agreements. The Artist retains the right to use the artwork for promotional purposes (such as displaying it in a portfolio or on social media) but will not sell or license the specific piece to other clients.
  • 5. Liability

    2D Illustration
  • The Artist is not liable for any misuse of the artwork once it has been delivered to the Client. It is the Client’s responsibility to ensure proper use of the artwork in accordance with any copyright or trademark laws.

  • 6. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.

  • By signing below, the Client acknowledges and agrees to the terms and conditions outlined in this Agreement. The Artist agrees to deliver the commissioned artwork according to the agreed specifications, timeline, and payment terms.

  • 2a. Storyboard Phase (Flat Fee)

    2D Animation
  • Storyboard (Rough Draft) Fee:

    A flat, non-refundable fee is required to begin pre-production. This phase includes basic visual planning, timing roughs, layout suggestions, and initial scene breakdowns.

    Rates:

    • Simple Animation (short, minimal motion): $150

    • Advanced Animation (complex motion or longer scenes): $250

    Includes:

    • Up to 6 hours of work
    • Up to 2 rounds of minor revisions

    Additional Time/Revisions:
    Work exceeding the included hours or revisions will be billed at $40/hr-$60/hr.

  • 2b. Animation Phase (Hourly, Retainer-Based)

    2D Animation
  • After storyboard approval, the animation phase begins. Animation work is billed hourly and prepaid in time blocks.

    Hourly Rates:

    Simple Animation: $40/hr
    Advanced Animation: $60/hr

    Time Block Options:

    • 10 hours: $400–$600
    • 15 hours: $600–$900
    • 20 hours: $800–$1,200


    Work on animation begins after storyboard approval and once the first time block is paid. The storyboard fee is a separate charge and does not count toward animation hours.

    Example Payment Flow:

    $250 – Storyboard Phase (flat fee, paid first)
    $600 – First 10-hour Animation Block (paid after storyboard approval)
    Additional time blocks are purchased as needed to continue the project.


    Client Option (Optional):
    Clients may choose their initial time block (10, 15, or 20 hours) depending on their needs and budget. The Artist may recommend a block size based on project scope and complexity.

  • 2c. Project Timeline

    2D Animation
    • Estimated Timeline:
      The Artist will provide an estimated timeline for the completion of the 2D animation project after the rough draft (storyboard) has been approved. The estimated timeline will vary based on the complexity of the animation:

      • Simple Animation: Typically completed within 15 to 30 business days from rough draft approval, depending on the scope and level of detail.

      • Advanced Animation: Typically completed within 30 to 60 business days from rough draft approval, depending on the complexity of the animation (e.g., detailed movements, background, special effects).

    • Extensions Due to Complexity or Additional Revisions:
      If the project exceeds the estimated timeline due to additional revisions, complexities, or unforeseen delays, the Artist will notify the Client as soon as possible and provide an updated timeline.

    • Hourly Charges for Delays or Additional Work:
      If the Client requests significant changes to the animation after the rough draft (storyboard) has been approved, or if additional work is required beyond the agreed-upon scope, the Artist will continue working at the agreed-upon hourly rate of $40/hour for Simple Animation or $60/hour for Advanced Animation and or any time block. The Client will be notified of any additional charges before further work is completed.
  • 2d. Payments & Refund Policy

    2D Animation
    • Time blocks are non-refundable once work begins.
      If the Client cancels the project during a time block, a minimum of 4 hours will be billed as a termination fee. This covers project prep, communication, scheduling, and time reserved for the Client.

    • Any remaining unused hours beyond the 4-hour minimum may be refunded at the Artist’s discretion, depending on how much of the block was used.

    • The Storyboard fee is non-refundable, regardless of project completion status.

     

    Additional Information:

    Sales Tax:
    All prices are exclusive of taxes. Sales tax will be added based on the applicable rate in the Client’s location at the time of payment.

    *Sales tax will be calculated and added at each payment stage (rough draft fee, payment blocks, etc.).

    **You can see an itemized breakdown of your total and payment schedule in the final invoice, which will be sent to you after the form is submitted.


    All payments must be made via: Cashapp.

  • 2e. Revision Policy

    2D Animation
    • Minor revisions (timing tweaks, small pose edits, etc.) are included during active time blocks.

    • Major revisions (scene overhauls, character changes, animation restarts) will be billed at the standard hourly rate.


    *The Client will be notified of any additional costs and agree to these charges before further revisions are made.

    Revision Process Guidelines:
    Revisions should be specific and clearly defined. Due to the time-consuming nature of animation, any significant changes after the rough draft or early animation stages (such as major adjustments to character movements, backgrounds, or effects) may be subject to additional charges and could affect the overall timeline.

     

  • 3. Final Delivery

  • Final deliverables (MP4, GIF, or frame sequences) will be provided once:

    • The final time block has been fully paid, and

    • All approved revisions have been completed.
  • 4. Ownership and Rights

  • The Artist retains full rights to the artwork until the final payment has been made. Upon full payment, the Client will receive a non-transferable, personal-use license for the commissioned artwork. The artwork is created exclusively for the Client and is not to be sold or used for commercial purposes without additional agreements. The Artist retains the right to use the artwork for promotional purposes (such as displaying it in a portfolio or on social media) but will not sell or license the specific piece to other clients.

  • 5. Liability

  • The Artist is not liable for any misuse of the artwork once it has been delivered to the Client. It is the Client’s responsibility to ensure proper use of the artwork in accordance with any copyright or trademark laws.

  • 6. Governing Law

  • 2a. Design Phase (Hourly, Retainer-Based)

    Graphic Design/Logo Design & Commercial Work
  • All design work is billed hourly and prepaid in time blocks. This includes sketching, inking, coloring, layout design, and final polish.


    Hourly Rate: $40/hr
    Time Block Options:

    • 5 hours – $200
    • 10 hours – $400
    • 15 hours – $600

      The Client selects and prepays for their desired time block. Work begins once payment is received. Additional blocks may be purchased as needed to continue the project. The Artist may recommend a block size based on project scope or deadline.

    Each Time Block Includes:

    • Creative consultation and project planning
    • Up to 2 rounds of minor revisions per piece or page
    • High-resolution digital files (JPG, PNG, PDF, or PSD if specified)

  • 2b. Project Timeline & Scheduling

  • The Artist and Client will agree on a general timeline and production milestones at the beginning of the project. Turnaround time will vary depending on the size and complexity of the project.

    Typical Turnaround Estimates:

    Small Projects (e.g., single-page illustrations, posters, logos):

    • Initial drafts: within 5–10 business days after work begins
    • Final delivery: within 5–7 business days after final approval

    Larger Projects (e.g., comic books, children’s books, multi-page illustrations):

    • Timeline will be broken into milestones (e.g., thumbnailing, penciling, inking, coloring, revisions)

    • Each stage may take 1–3 weeks, depending on scope, feedback time, and complexity

    • The Artist will provide an estimated timeline after reviewing the project scope and before production begins. 

    Client Responsibilities:

    • The Client agrees to provide timely feedback (within 2–3 business days) to help keep the project on schedule

    • Delays in providing feedback, approvals, or reference materials may extend the timeline.

    Artist Availability & Rescheduling:
    The Artist’s schedule may include multiple clients and ongoing projects. To ensure availability, time blocks should be scheduled in advance. The Artist will notify the Client of any scheduling conflicts or shifts in availability.

    *Note: If a project requires faster delivery than the estimated timeline, the Artist may offer to expedite the work for an additional rush fee (see Section 2d).

  • 2c. Payments & Refund Policy

    • Time blocks are non-refundable once work begins.

    • If the Client cancels during an active block, a minimum of 2 hours will be billed as a termination fee (covers prep, communication, scheduling, and time reserved).

    • Any unused hours beyond the 2-hour minimum may be refunded at the Artist’s discretion, depending on how much work was completed.

    Sales Tax on Services:
    All prices quoted for animation, graphic design, and commercial work (such as logo design, comic book/manga illustrations, etc.) are exclusive of applicable sales tax.

    Calculation of Sales Tax:
    Sales tax will be calculated and added to the total amount based on the Client’s location and the applicable tax rate in the jurisdiction at the time of each payment.

    *The amount of sales tax will be calculated and added to each payment, and the Client will be notified of the exact amount before payment is made.

  • 2d. Rush Projects & Expedited Deadlines

    Graphic Design/Logo Design & Commercial Work
    • If the Client requires faster turnaround than the Artist's standard schedule allows (e.g., within 48–72 hours, weekend work, or urgent deadlines), a rush fee will apply.

      Rush Fee Rate:

      +50% of the standard hourly rate

      Example: $40/hr becomes $60/hr during rush periods
      Rush time must be pre-approved and paid as part of a designated time block.

  • Timely Feedback:
    To ensure that the project progresses smoothly, the Client is expected to provide feedback in a timely manner. Delays in providing feedback may result in project delays and may affect the overall timeline.

    Scope of Revisions:
    Revisions will be limited to the original scope of work and may not include new elements or drastic changes to the original concept. Requests for new concepts, ideas, or additions (e.g., new characters, major design changes, new scenes in animation) may require additional charges and time.

  • 3. Revisions Policy

    • Minor revisions (color tweaks, small layout edits, text changes) are included during active time blocks.

    • Major revisions (complete redesigns, character redraws, new layouts) will be billed at the standard $40/hr rate and may require an additional time block.
  • 4. Final Delivery

  • Final files are delivered once:

    • All active time blocks are fully paid, and
    • Final approved revisions are complete. 

    Deliverables may include high-res files suitable for print and web. PSD or layered files can be delivered if agreed upon in advance.
