Parent & Minor - Waiver & Media Release

This form is for students under the age of 21 (for any class involving handguns) or under the age of 18 (for any class involving rifles or shotguns). This form is to be filled out by the student(s)’ legal parent or guardian. The legal parent or guardian MUST accompany the student(s) to the class.
RELEASE, WAIVER, HOLD-HARMLESS, AND ASSUMPTION OF RISK AGREEMENT

In this waiver, the definition of a Minor is:
- Any person under the age of 21 participating in any class(es) involving handguns.
- Any person under the age of 18 participating in any class(es) involving rifles or shotguns.
- The definition of a Minor in any class(es) involving handguns supersedes the definition of a Minor in any class(es) involving rifles or shotguns when any mixed-firearm class(es) are conducted. The definition of a mixed-firearm class is a class conducted with handguns and rifles and/or shotguns combined in the curriculum.
WHEREAS, in consideration of the use of the facilities contracted by Trigoon LLC DBA Trigoon Dynamics (TD), 1846 E. Innovation Park Dr., STE 100 Tucson, AZ 85755, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Undersigned and on behalf of the Minor(s) under their guardianship (i.e. legal parent or guardian) agrees to the following:
The Undersigned and on behalf of their Minor(s), hereby acknowledges and agrees to have voluntarily applied to use the facilities contracted by TD. It is understood and acknowledged that the use of these facilities in which others, as well as the Undersigned and their Minor(s) under their guardianship, are engaged in airsoft and live-fire shooting activities involves inherent extreme hazards, dangers, and risks. The Undersigned represents that themself and their Minor(s) is physically able, emotionally stable, and fully competent to participate in training and shooting activities and that the Undersigned and their Minor(s) freely, knowingly, and voluntarily assumes the risks of participating in such activities, including the risks of property damage, bodily harm, and death.
The Undersigned and on behalf of their Minor(s) acknowledges, understands, and agrees to follow all shooting range and facilities rules and directives.
The Undersigned and on behalf of their Minor(s) affirms that themself and their Minor(s) have and will refrain from being under the influence of alcoholic beverages or medications, including medical marijuana, that might impair judgment prior to, and during, shooting sports activities. Further, the Undersigned and on the behalf of their Minor(s) affirms that themself and their Minor(s) understands the possession, usage, and influence of illegal drugs is expressingly prohibited on TD contracted properties, and that any person(s) who, strictly by our observations, appears to be under the influence of alcohol or illegal drugs or emotionally unstable, shall be denied access to and removed from any part of said facilities and TD properties.
The Undersigned and on behalf of their Minor(s) affirms, under penalty of law and perjury, that themself and their Minor(s) can legally possess a firearm, and that themself and their Minor(s) have no criminal or mental background that restricts themself or their Minor(s) from such possession.
In addition, the Undersigned and on behalf of their Minor(s) they represent do for themselves, and on behalf of their heirs, executors, administrators, officers directors, owners, partners, agents, brokers,employees, insurers, and assigns, hereby releases, acquits, indemnifies, and hold harmless TD, and its heirs, executors, administrators, trustees, officers, directors, wonders, partners, agents, brokers, employees, insurers, assigns, Terence Liberato, Annie Tran, Hua-Yu (Jason) Wang, Kenneth Smith, Melissa Koch, and all other related instructors and event officials, persons, entities, affiliates, predecessors, and successors, from any and all claims, actions in law or equity, causes of actions, demands, rights ,damages, costs, loss of services, expenses, and compensation whatsoever arising from any damage to property, injury to person, or death (whether predicated upon negligence or otherwise) in connection with use of TD’s contracted facilities or participation in any activities therein. The Undersigned and on behalf of their Minor(s) takes full legal and financial responsibility for any damage or harm to themselves, the Minor(s), and to their guests, if any, and for damages or harm to other individuals on the premises, event equipment, or other facilities equipment that is a result of the actions of the Undersigned, the Minor(s), and/or their guests.
The Undersigned and on behalf of their Minor(s) grants permission to TD, to use themselves and their Minor(s) image (photographs and/or video) for use in any publications. The Undersigned and on behalf of their Minor(s) waives the right to inspect or approve the finished photographs or electronic materials that may be used in conjunction with them now or in the future, whether that use is known or unknown. The Undersigned and on behalf of their Minor(s) also waives any right to royalties or other compensations arising from or related to the use of the image.*

By signing this instrument, the Undersigned and on behalf of their Minor(s) affirms that they have read, understand, and will comply with the requirements as set forth herein, and does hereby agree to defend, indemnify, and hold TD, its shareholders, officers, managers, assigns, heirs, employee, Terence Liberato, Annie Tran, Hua-Yu (Jason) Wang, Kenneth Smith, Melissa Koch, and all other related instructors and event officials, entities, affiliates, predecessors, or successors, harmless from any act or omission for which the Undersigned, the Minor(s), and their guests is/are directly or indirectly responsible. This instrument binds the Undersigned, their Minor(s), and their executors, administrators, assignees, or heirs.
