  • Terms and Confitions

  • This agreement serves to confirm the following.

    • Upon approval by Happy Yappers, this Adoption Application and Contract in its totality forms a binding and enforceable contract between the following parties:
      • Happy Yappers NPO 119-872, herein referred to as Happy Yappers; and
      • The Applicant is listed under the heading “Personal Information of Applicant” above.
    • Happy Yappers and the Applicant agree as follows:
    • Happy Yappers has the right to refuse this application for adoption without providing reasons to the Applicant.
    • If Happy Yappers declines the application, this contract will not become effective.
    • If Happy Yappers approves the adoption application, this contract will become effective from the date on which Happy Yappers communicated the approval to the Applicant.
    • This contract contains all the provisions agreed on by the parties about the subject matter of the contract and supersedes and novates in its entirety any previous understandings or agreements in respect thereof, and the parties waive the right to rely on any alleged provision not expressly contained in this contract.
    • Happy Yappers is entitled to enquire regarding the status and wellbeing of the animal at any time, and the Applicant will provide the required information to Happy Yappers within 5 days from the date of the enquiry.
    • Happy Yappers has the right to do home checks during the term of this contract if Happy Yappers deems it necessary in its sole discretion after giving the Applicant 5 days written notice of such home check.
    • Happy Yappers reserves the right to remove the animal from the Applicant’s care on a permanent or temporary basis if the animal does not, in the sole discretion of Happy Yappers, receive the appropriate care; or if the Applican breaches any term of this contract; or if the Applicant provided any false or misleading information to Happy Yappers when this application was made.
    • Happy Yappers cannot be held liable in any manner for the behavior or temperament of the animal, and the Applicant adopts the animal at his / her own risk.
    • Happy Yappers, its board, management, volunteers, and employees will not be held liable or responsible for any loss, damage, or injury of whatsoever nature (including to third parties) by the animal or to the animal. The Applicant accepts responsibility in this regard.
    • The Applicant irrevocably and unconditionally indemnifies Happy Yappers, its board, management, volunteers and employees against all losses suffered or claims instituted against them resulting from or in connection with, directly or indirectly – the breach of any warranty provided by the Applicant in terms of this contract; and/or due to any act performed or failure by the Applicant or any of its representatives relating to or in connection with this contract, including but not in any manner limited to negligent or fraudulent acts or failures; and/or any inaccurate and/or incomplete information provided by the Applicant, including any and all legal costs to be incurred in respect of any such losses or claims on a scale as between attorney and own client.
    • If at any time the Applicant can no longer care for the animal, the animal will be returned to the care of Happy Yappers for rehoming and may not, under any circumstances, be rehomed in the Applicant’s personal capacity.
    • If the animal must be rehomed for any reason whatsoever, the Applicant will pay a rehoming fee of R500 to Happy Yappers.
    • All information provided by the Applicant is warranted to be true and correct, and it is understood that any incorrect information provided by the Applicant may lead to the upliftment of the animal.
    • Happy Yappers reserves the right to uplift the animal at any time if, in its sole discretion, Happy Yappers is of the opinion that the animal is not receiving the correct care, shelter, and nutrition.
    • If the animal is uplifted for any reason whatsoever, the Applicant will pay an upliftment fee of R500 to Happy Yappers.
    • The Applicant will meet any and all of the animal’s needs financially, including but not limited to medical care, training, shelter, and food, and understands the financial commitment of owning a dog. Happy Yappers will not make any financial contribution to the care of the animal or pay any expenses with respect to the animal other than those specifically provided for in this contract.
    • The Applicant warrants that the animal will receive all vaccinations on the due dates.
    • Should the Applicant breach any provision of this contract, Happy Yappers shall be entitled, without prejudice to its other rights in law, to terminate this contract immediately and to claim damages from the Applicant.
    • A certificate given under the hand of a duly authorised senior official of Happy Yappers, whose appointment need not be proven, shall be prima facie proof of any amounts due in terms of this contract. The Applicant further agrees that such a certificate may also be used to obtain provisional or summary judgment against him/her.
    • The Applicant’s chosen domicilium citandi et executandi address will be used for all purposes arising out of or in connection with this contract at which address all processes and notices arising out of or in connection with this contract, its breach or termination may validly be served upon or delivered.
    • The Applicant may change his / her domicilium citandi et executandi by written notice to Happy Yappers, and the change will be valid from the date on which Happy Yappers acknowledged receipt of the change in writing.
    • Each and every provision of this contract is deemed to be separate and severable from the remaining provisions of this contract and if any of the provisions is found by any court of competent jurisdiction to be invalid and/or unenforceable then, notwithstanding such invalidity and/or unenforceability, the remaining provisions of this contract shall be and remain of full force and effect.
    • The applicant agrees to safeguard the dog(s) to the best of their ability, this includes not taking the dog for walks or to public places until fully vaccinated.
    • The granting of any indulgence, extension of time, or relaxation of any provision of this contract by Happy Yappers shall not constitute a waiver of any right by Happy Yappers or prevent or adversely affect the exercise by Happy Yappers of any existing or future right.
    • The Applicant will register the microchip on the www.getmeknown.co.za website.

  • Permission to share information with Dotsure

  • There is no obligation on the Applicant to take out pet insurance. We would, however, like to encourage the Applicant to speak to dotsure.co.za to understand their pet insurance options available and the benefits of taking out pet insurance. By signing this section of the contract, you give Happy Yappers permission to provide your name and contact details to dotsure.co.za to contact you to provide you with information about their pet insurance products. dotsure.co.za may apply a discount on the first 3 premiums, and Happy Yappers may receive a donation from dotsure.co.za if you decide to take out pet insurance through them. We will use any such donation toward the care and sterilization of animals in our care. Dotsure Limited is a licenced non-life insurer and an authorised financial services provider.

  • VACCINATION & DEWORMING SCHEDULE

  • Your Dog would have needs to receive an annual combination vaccine; you can either contact Happy Yappers to have this administered (at an additional cost) or ensure your dog is taken to your vet of choice for this vaccine.

    Deworming, De-tick, and de-flea should be undertaken regularly, and if you have children in the home, it is recommended that deworming takes place once every three months.

  • I hereby accept that I have read, understood and agree to the above contract.

  • I agree to this option and agree that the follow-up vaccinations will be administered by a member of Happy Yappers. I understand that it is my responsibility to get my dog to the vaccination appointment arranged by Happy Yappers.

  • For adopted dogs the dog will be received with a microchip. The adopter undertakes to register the microchip on the www.getmeknown.co.za website.

    Should the adopter choose to forgo the option to use Happy Yappers to insert the microchip, they are able to have this done privately at a vet of their choice at their own expense, as the microchip is at the benefit for the adopter and dog, proof of microchip doesn’t not have to be sent through to Happy Yappers.

  • We are a no-kill shelter. We aim at giving every dog a chance until their time comes. With age, can come issues. We are happy to assist if any health problems come up. Our vet is Oaktree Petcare, where we get discounted rates for our rescues.
