In the event that the GOLF CART should become involved in any accident or any other mishap, I shall: a) Immediately report the accident or other reportable incidents to the police and Windmill Point Park inc. b) promptly provide Windmill Point Park Inc. with an accident or incident report and c) co-operate fully with the investigation of the same.*

I will not use or permit the GOLF CART to be used: a) any time after 11:00p.m. and before sunrise. All GOLF CARTS must be equipped with appropriate and operational lighting equipment. b) reckless or while loaded beyond its rated capacity. c) to carry passengers or property for hire d) to tow or push anything. e) to be operated in a test, race or contest f) while the operator is under the influence of alcohol or a controlled substance g) for conduct that could be charged under the Criminal Code or Controlled Drugs and Substance Act offence, including the transportation of a controlled substance and/or the smuggling of any contraband h) to carry any explosive or corrosive substance or any flammable substance that has a flash point of less than 40 degrees centigrade i) in any area where GOLF CARTS are not permitted j) after it has been damaged*

In consideration for permitting the use of a GOLF CART on the property, I, for myself, my heirs, executors, successors and assigns, hereby RELEASE, WAIVE AND FOREVER DISCHARGE 582027 Ontario Limited operating as Windmill Point Park Inc. and any directors, officers, employees, agents, associations, and their respective agents, officials, servants, contractors, representatives, successors and assigns from all claims, demands, damages, costs, expenses, action and causes of action, whether in law or in equity in respect of death, injury, arising be reason of my use of the GOLF CART, whether as an operator or passenger or otherwise, whether prior to, during or subsequent to its use. AND NOTWITHSTANDING that the same may have contributed to or occasioned by the negligence of the aforesaid.

I further hereby undertake to hold and save harmless and to agree to indemnify all of the aforesaid from and against any and all liability incurred by any or all of them arising as a result of or in any way connected with my participation in the use of the GOLF CART.
