  • Informed Consent, Liability Waiver, and Assumption of Risk Agreement

  • This Agreement is made between the Activity Providers: Mackenzie Rae & Haylee LaCroix (hereinafter referred to as the "Activity Providers") and

  • Purpose and Description of Activity


    I, the undersigned, acknowledge that I am voluntarily participating in the following activity:

    Activity Name: The Hidden Tides Retreat
    Location: San Marcos, Lake Atitlan, Guatemala
    Date(s): January 18th - January 24th 2026


    We will be exploring the unseen rhythmic forces of the subtle body & the language of the botanical world through yoga, breath work, plant spirit meditation, dream work, ceremony & ritual.

    Included in the retreat:

    + 7 days/6 nights of accommodation 

    + transportation to & from Guatemala City where the airport is located

    + 2 nourishing vegetarian meals & 1 snack daily

    + unlimited tea available

    + $45 credit to the cafe on site to purchase additional food, juice & coffee

    + wood fired sauna - there will be 2 sauna sessions offered throughout the retreat. If you’d like to add additional sessions, they will come at the expense of $30 per session.

    + daily yoga & meditation

    + optional psilocybin microdose

    ​+ Two Experiences Lead by Local Mayan Elders -- Traditional Mayan Fire & Cacao Ceremony, Tuj Ceremony - a sacred steam bath that symbolizes a return to the mother's womb)

    + ample space to rest & recharge, connect with others, hike & explore the land, or visit the local towns on the lake

    + 10% gratuity to staff at the retreat center

     

    Not included in the retreat:

    + Flights

    + Travel insurance (recommended)

    + Lunch in town (optional) if you want more than the provided snacks.

    + Additional services / tips

    + Shuttle service for your luggage to the retreat center is $10 each way or $20 each way for oversized bags (25 lbs+) or late arrivals (after 7pm). You also have the option to hike your bag in for free.

    + Accommodations on the evening of January 17th if you are arriving the day before the retreat as suggested.

    + Breakfast the morning of the 18th at the hotel

    + Any additional transportation costs outside of the two shuttles we will be offering


    Acknowledgement of Risks
    I understand that in order to access the retreat center, I must be in good enough physical condition to hike in from town about 15 minutes. I understand that I cannot access the retreat center by car and that participation in the activities at the retreat involve inherent risks that could result in injury, death, or property damage. These risks include but are not limited to:

    - Physical injury (e.g., sprains, fractures, or head injury).

    - Environmental hazards (e.g., weather conditions, uneven terrain, or wildlife).

    - Accidents during transportation or while performing activity-related tasks.

    - Mental or emotional stress resulting from participation.

    - I am aware of these risks and freely and voluntarily accept and assume all such risks, known and unknown.

    - By choosing to consume any herbs or psilocybin provided during this experience, you acknowledge that these can affect individuals differently, and reactions may vary based on personal health conditions, medications, allergies, or sensitivities. We are not medical professionals and do not offer medical advice. All substance use is entirely voluntary and at your own discretion. By participating, you agree that Haylee LaCroix and Mackenzie Rae Cohane are not responsible for any adverse effects, reactions, or negative outcomes resulting from the use of any herbs or herbal products provided, suggested, or consumed as part of this experience.


    Informed Consent
    By signing this agreement, I confirm that I have been provided with sufficient information about the activity, including the nature of the risks involved. I have had the opportunity to ask questions and am satisfied with the explanations provided. I am fully aware of the risks and voluntarily choose to participate in the activity.


    Assumption of Risk
    I, the undersigned, expressly assume any and all risks associated with participating in the above-mentioned activity. I understand and acknowledge that despite precautions, accidents, injuries, or other adverse outcomes may occur. I agree to assume full responsibility for all risks that may arise from my participation.


    Release of Liability
    In consideration of my participation in this activity, I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue the Activity providers, its employees, agents, contractors, and volunteers from any and all liability for any loss, injury, death, or damage to my person or property that may arise from or be related to my participation in the activity, whether caused by negligence, acts of God, or any other cause.

    This release of liability extends to all claims, including those arising from the inherent risks of the activity, as well as any negligent or reckless actions on the part of the Activity provider or others.


    Medical Treatment and Insurance
    I acknowledge that I am solely responsible for my medical care and any insurance coverage. I understand that the Activity providers do not provide insurance for me during my participation in this retreat. In case of an emergency or injury, I authorize the Activity provider to obtain emergency medical treatment for me if necessary.

    I confirm that I have health insurance or will cover the costs of any medical care I may require during my participation in this activity.


    Force Majeure Clause
    The Activity providers shall not be liable for any failure or delay in performance of its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, strikes, pandemics, government regulations, or any other unforeseeable event or cause. If such an event occurs, the Activity providers will promptly inform the Participant of the delay or cancellation and make reasonable efforts to reschedule or find an alternative solution, but are not liable for any resulting losses.


    Payment
    - Prices are per person + add 3% processing/admin fee for credit cards
    - Payment methods: cash, check, or credit card (make checks payable to Mackenzie Rae)
    - Secure your spot with a $500 deposit. Once you place your deposit we will email you to confirm your preferred room choice.
    - All deposits are non-refundable and non-transferable. 
    - Final balance due 90 days before the start of retreat on October 20, 2025

     
    Please be sure you will be able to attend before you submit your deposit. Payment is due in full 90 days prior to the start of the retreat. If you cancel 90 days or more prior to the retreat start date, you will be issued a refund, less your $500 non-refundable deposit.

    Cancellation Policy

    Cancellation by Participant:
    Should a participant need to cancel their participation, notice must be provided in writing to the Activity Providers.

    Refunds will be issued according to the following schedule:

    - Cancellation more than 90 days prior to the retreat start date: 100% refund, minus the nonrefundable $500 deposit
    - Cancellation less than 90 days prior to the retreat start date: No refund, transfer, or credit will be issued for any reason.

    Cancellation by Activity Provider:
    In the unlikely event that the Activity Providers must cancel the retreat due to unforeseen personal circumstances, you will be given the option to receive a full refund or transfer your payment to a future retreat.

    Retreat Center Cancellation Policy:
    In the unlikely event that the retreat center must cancel or postpone the retreat due to unforeseen circumstances within 90 days of the retreat start date—such as a natural disaster, severe weather, government-imposed travel restrictions, or other force majeure events—they may be able to offer an alternative retreat date depending on the nature of the disruption. However, this is not guaranteed and is subject to the center’s discretion and availability. Due to their policies, we may not be able to issue a refund or offer a future retreat date at this location, which is why we strongly recommend purchasing comprehensive travel insurance to protect your investment.

    Travel Insurance Recommendation:

    To protect your retreat investment, we strongly recommend that all participants obtain comprehensive travel insurance that covers trip cancellation, medical emergencies, and force majeure events—including, but not limited to, natural disasters, severe weather, government-imposed travel restrictions, and other unforeseen disruptions—whether due to your own need to cancel or in the event that the retreat center must cancel or reschedule the retreat.

    We recommend exploring Allianz with Epidemic Coverage Endorsement, GoReady Pandemic Plus, or Travel Insured’s Worldwide Trip Protector with Cancel For Any Reason (CFAR), as these plans offer robust coverage for retreat-style travel and adventure activities.


    Refunds for Travel/Accommodation: The Activity providers are not responsible for any expenses the Participant incurs related to travel, accommodation, or other personal expenses in the event of cancellation by the Participant or the Activity Provider. Thank you for your consideration with this policy as so much time and heart go into planning retreats for you!


    Travel and Accommodation Disclaimer
    The Activity providers are not responsible for arranging or paying for travel, accommodations, or related expenses unless explicitly stated in the event description. Any travel arrangements made by the Participant are at their own risk and expense. The Activity providers do not guarantee any specific accommodations, travel arrangements, or costs associated with the activity. It is the Participant’s responsibility to make their own travel and accommodation arrangements.


    Code of Conduct and Participant Responsibilities
    Behavior: The Participant agrees to behave in a respectful, responsible, and safe manner while participating in the activity. The Participant agrees to follow all instructions provided by the Activity Provider and abide by any rules or guidelines set forth for the activity.


    Alcohol/Drugs: The use of alcohol or illegal drugs during the activity is strictly prohibited unless explicitly allowed by the Activity Provider. Any violation of this policy may result in immediate removal from the activity without refund.


    Safety: The Participant agrees to immediately report any safety concerns or incidents to the Activity Provider. The Participant is responsible for their own health and safety during the activity, and must inform the Activity Provider of any medical conditions or limitations that may affect their participation.


    Liability for Damages: The Participant agrees to reimburse the Activity Provider for any damage caused by their actions to property or equipment during the activity.

     

  • Other Provisions
    Severability: If any part of this Agreement is found to be invalid or unenforceable, the remaining portions shall continue in full force and effect.


    Governing Law: This Agreement shall be governed by the laws of the state or jurisdiction where the activity takes place.

    Acknowledgement of Understanding
    I have carefully read and fully understand the terms and conditions of this Informed Consent, Liability Waiver, and Assumption of Risk Agreement. I acknowledge that by signing this document, I am giving up certain legal rights, including the right to sue for any damages or injuries I may sustain as a result of my participation in this activity. I am signing this agreement voluntarily and with full knowledge of its contents.

    By signing below, I affirm that I am of legal age (18 years or older) or that I have the consent of a legal guardian. If I am under the legal age of majority, the parent or legal guardian of the participant must sign below.
