We will be cleaning the New River, at Rio Vista Community Park, on Saturday April 19th from 8am. to 11am.

I agree as follows:1. I am volunteering my services for RIVER AND TRAIL CLEAN UP.  2. I will perform assigned tasks that are within my physicalcapability, and I will not undertake tasks that are beyond my ability;3. I will not participate if under the influence of alcohol orany drug that could impair my physical or mental abilities;4. I am familiar with the safe operation and use of machinery,equipment and tools that I may utilize in connection with the Event, and I willnot undertake to use any machinery, equipment or tools with which I amunfamiliar or which I do not know how to operate safely;5. I will perform only those tasks assigned, observe all safetyrules, and use care in the performance of my assignments;6. I specifically acknowledge that I am engaging in thisactivity as a volunteer and not as a City of Peoria employee, agent, official,officer or representative, and further acknowledge that I am not entitled toany compensation, benefit or insurance coverage from the City of Peoria, theCommunity Services Department, or any Event promoter, sponsor, or organizer,nor will I make any such claim. I understand that cleaning up parks, trails,riverbeds, rivers, lakes or other inland water areas involves certain inherentrisks, including but not limited to, the risks of possible injury, infection ordeath as a result of contact with needles, condoms, animal or human waste,chemicals, metal objects, burning embers, hazardous materials, wild or domesticanimals, other people, snakes, scorpions, thorny or poisonous plants,collisions with bicycles, motor vehicles or stationary objects, or fromover-exertion or environmental conditions, including but not limited to sunexposure, weather, flooding, rockslides, uneven or dangerous terrain, bloodborne viruses such as Hepatitis B or HIV, or airborne viruses such asHantavirus or Valley Fever. If I intend to use a watercraft in connection withthe Event, I also understand the risks related to the acquisition and use ofsuch crafts, including but not limited to risks related to marine facilities,fuels and lubricants, weather, tides, water movement, watercraft operation(including risks related to exertion), collisions, water temperature (includinghypothermia), swimming proficiency, and rescue efforts. Despite the risks, Istill choose to participate in such activity. No known physical or healthlimitation prevents me from safely participating in this Event. InConsideration for being allowed to participate, I personally assume all risks,whether foreseen or unforeseen, in connection with the Event of any harm,damage, injury or death that may befall me as a participant. I hereby release,hold harmless and forever discharge the City of Peoria, an Arizona municipalcorporation, its elected and appointed officials, directors, officers, boards,commissions, agents, representatives, employees, volunteers, Event sponsors,promoters or organizers, and any and all other persons, firms, or corporationswho are or might be liable (“Released Parties”) from any and claims of any kindor charged which I, my family, estate, heirs, or assigns, have or may haveagainst the Released Parties arising out of my participation in theEvent.  This waiver includes all damages, losses, costs, expenses,injuries and death that allegedly occur relating to this Event. I covenant toindemnify, defend and hold harmless to the fullest extent permitted by law theReleased Parties from any loss or damages, including reasonable attorney’s feesand litigation expenses, which may be incurred by them in the event any suchclaims are asserted against them or any of them.  I understand thatmedical claims are my responsibility. This waiver does not extend to any suchclaim or liability that is caused by the sole and exclusive intentional acts orgross negligence of the City of Peoria or its officials or employees. I am overthe age of eighteen and legally competent to sign this liability waiver, or Ihave acquired the written consent of my parent or guardian. I understand thatthe terms herein are contractual and not a mere recital, this instrument islegally binding, and I have signed this document of my own free act. I agree toallow my image to be used in published materials and social media sites thatpromote the programs of the City of Peoria or news media and/or that promoteany programs conducted by the City of Peoria.IF PARTICIPANT IS UNDER 18, THE PARENT OR LEGAL GUARDIAN MUSTSIGN. MINORS MAY NOT PARTICIPATE WITHOUT THE PARENT OR LEGAL GUARDIAN’SSIGNATURE.Iam the parent or legal guardian of the above participant and he/she has mypermission to participate in RIVER AND TRAIL CLEAN UP. I have read and agree to the provisions stated above for the participant andmyself. Further, I understand and agree that the Released Parties are notresponsible for supervision of minor participants and that if I allow the aboveminor to participate without my supervision, I assume all the risks from suchparticipation.
