BEMBRIDGE SAILING CLUB SAILING INSTRUCTIONS (EXTRACT)
CONDITIONS OF ENTRY
The BSC shall not be liable for any loss, damage, death or personal injury howesoever caused to the owner/competitor, his skipper or crew, as a result of them taking part in a race it organises. Moreover, every owner/competitor warrants the suitability of his boat for the race or races. Further, a boat is entirely responsible for its own safety, whether afloat or ashore, and nothing, whether in the Notice of Race or Sailing Instructions or anywhere else, reduces this responsibility. It is for the boat to decide whether it is fit to sail in the conditions in which it will find itself. By launching or going to sea, the boat confirms that it is fit for those conditions and that its crew is competent to sail and compete in them. The boat is required to hold adequate insurance and in particular to hold insurance against third party claims of at least £2m. Buoyance shall be in accordance with class rules (or as built in the absence of any specific class rule).
Nothing done by the organisers can reduce the responsibility of the boat nor will it make the organisers responsible for any loss, damage, death or personal injury, however, it may have occurred, as a result of the boat taking part in the racing. The organisers encompass everyone helping run the race and the event, and include the organising authority, the race committee, the race officer, patrol boats and beachmasters. The provision of safety/patrol boats does not relieve the boat of its responsibilities. Where the matter is not one to be determined under the Rules, competitors agree not to resort to any court of law or any tribunal until all internal remedies provided by ISAF or by the Court of Arbitration for Sport have been exhausted.
2- CONDITIONS OF ENTRY & NOTICE TO COMPETITORS
2.1 All helmsmen shall complete a Notice of Race/Entry Form for the season’s racing PRIOR to taking part in their first race of the season. This also covers EWCC Regattas. The Notice of Race provides detailed guidance on the responsibilities of the helmsman for the crew, the boat and her management. Cadet and Junior Cadet entries shall be counter-signed by a parent or guardian. Helms failing to complete the form prior to racing will be scored DNS.
Safety Afloat & Equipment.
2.4 The sea is a potentially hostile environment; by the very act of going afloat, members must accept that the safety of the boat they are in is the sole responsibility of the owner/person in charge. It follows therefore that by participating in a race or activity afloat, members shall accept full responsibility for:-
(a) The boat’s safe navigation and the competence of their crew.
(b) The decision as to whether to start, continue in or retire from a race in the light of existing or forecast weather conditions or any gear failure on the boat.
(c) The suitability of the entered boat for the races or sailing activity.
2.5 Adequate personal buoyancy for all crew members (CE 150 Newton Lifejackets for non-swimmers) shall be carried and shall be worn if ordered by Flag Y over the Class Flag signalled from the Club Flag Pole and/or Committee Boat. Wet suits do not constitute adequate personal buoyancy.
2.6 All members of the crew of a dinghy and all members under 18 shall wear CE approved buoyancy aids when afloat (this includes using the pontoons).
2.7 Wet suits, dry suits or steamers should be worn while racing before the end of April or after the end of October.
2.8 The responsibility of allowing a Cadet or Junior Cadet to race rests with the Parent or Guardian, who must ensure that they can swim at least 50 metres and can row or paddle a boat.
2.9 Parents and Guardians are responsible for ensuring that dinghies where crews are under 18 can be righted after capsizing, and that they contain sufficient buoyancy to remain afloat for at least half an hour.
