LuckyEbike Rentals LLC – Liability Waiver & Release Agreement (Revised for Clark County, NV)IMPORTANT: READ CAREFULLY BEFORE SIGNING. This agreement releases LuckyEbike Rentals LLC (“the Company”) from all liability relating to injuries, damages, or losses that may occur during the use of our e-bikes or scooters. It also protects any third-party locations where the equipment may be delivered or ridden. By signing this agreement, you (the “Renter”) acknowledge that you have read, understood, and voluntarily agree to the following terms:1. Age & Eligibility. I am at least 18 years of age OR the parent/legal guardian of a minor (minimum age 16 years) who will operate the rented equipment under my direct supervision.I confirm that all riders under 18 have parental or guardian consent and will wear helmets at all times.2. Assumption of RiskI understand that riding an electric bicycle or scooter involves inherent risks, including but not limited to collisions, loss of control, terrain hazards, equipment failure, and interactions with pedestrians, vehicles, or wildlife.I voluntarily and knowingly assume full responsibility for these risks, whether foreseeable or not.3. Release of LiabilityI hereby waive, release, and discharge LuckyEbike Rentals LLC, its owners, employees, agents, contractors, and affiliates, as well as Red Rock Casino & Hotel, Red Rock Canyon National Conservation Area, and any associated landowners, property managers, or public entities, from any and all claims, actions, damages, or losses—including those caused by negligence—arising out of my use or operation of the rental equipment.4. IndemnificationI agree to defend, indemnify, and hold harmless LuckyEbike Rentals LLC and all third-party locations from any claims, suits, or demands arising from my conduct or use of the equipment, including attorney’s fees and costs.5. Personal Insurance & Medical CostsI understand that the Company and third-party locations do not provide personal accident, health, or liability insurance.I am solely responsible for any medical treatment, expenses, or damages resulting from my participation and have been encouraged to carry my own insurance.6. Equipment ResponsibilityI accept full financial responsibility for any damage, loss, or theft of the rented equipment (including e-bikes, scooters, helmets, and locks) during my rental period. Replacement or repair charges may apply.7. Helmet & Safety RulesHelmet use is mandatory for all riders under 18 and strongly recommended for adults. I have been offered a helmet and agree to operate the equipment safely and in accordance with all Nevada traffic laws and park or resort regulations.8. Venue, Jurisdiction & Governing LawThis agreement shall be governed by and construed under the laws of the State of Nevada.Any disputes arising from this agreement shall be brought exclusively in the Eighth Judicial District Court, Clark County, Nevada.
