The Renter agrees to provide space for the photo booth with the following requirements:
Space Dimensions: Minimum of 10 x 15 feet indoor flat surface.
Electrical Access: A power outlet within 5 feet of the booth location.
Additional Items/Services: If the Renter has selected optional add-ons (e.g., custom backdrop, extra hours), the cost for these items will be added to the rental fee.
Booth Attendant Responsibilities:
Attendant Role: The Provider will supply a booth attendant who will be on-site for the full duration of the event. The attendant’s role includes, but is not limited to:
Operating and maintaining the photo booth equipment.
Ensuring guests are having a positive experience and assisting with the photo booth operation.
Managing the flow of guests in and out of the booth to ensure the booth is used efficiently and safely.
Assisting with any technical issues that may arise during the rental period. While the booth attendant will provide technical assistance, supervision of the photobooth and for ensuring that the event space remains safe and orderly, ensuring that all guests use the photo booth equipment responsibly.
Renter Responsibilities:
Access and Space Requirements: The Renter is responsible for ensuring that the event location is accessible and provides the required space for the photo booth setup. The Renter also agrees to ensure the area remains clear of obstacles that could impede setup or operation.
Guest Conduct: The Renter acknowledges that the Provider will not be held responsible for any damage caused by the Renter’s guests to the photo booth or its props. The Renter agrees to ensure that guests follow the guidelines set forth for safe use of the photo booth.
To ensure a seamless experience with our photo booth services, we have established the following operational policies regarding service hours, overtime, setup, and teardown & service hours.
Setup Time: We require access to the event venue at least 1-2 hour before the event starts time for setup. This allows us to ensure the photo booth is fully operational and ready for use.
Teardown Time: Teardown will begin promptly at the conclusion of the event and is estimated to take approximately 1 hour. We request access to the venue for teardown to avoid any disruption to the event proceedings.

Cancellation and Refund Policy
(25% of the total amount of rental service are not refundable.)
Cancellation by Renter:
Cancellations made 30 days or more before the event date if paid in full, you will receive a partial refund, depending on any purchases made and services we provided up to that point. (25% of the total amount of rental service are not refundable.)
Cancellations made less than 30 days before the event will result in the forfeiture of the any downpayment. (25% of the total amount of rental service are not refundable.)
The Renter may reschedule the event without penalty if notice is given at least 35 days before the original event date. If rescheduled, the rental price will be adjusted based on availability and current rates.
Cancellation by Provider: The Provider reserves the right to cancel the rental agreement in the event of unforeseen circumstances (e.g., inclement weather, or other emergencies). In this case, the Renter will be offered the option of rescheduling or receiving a full refund of the deposit, excluding tax and transaction fees.
Liability and Insurance:
Liability Waiver: By signing this Agreement, the Renter acknowledges and agrees that the use of the photo booth involves certain risks, including but not limited to property damage, personal injury, or misuse of the equipment.
The Renter agrees to waive, release, and discharge Pix $ Props Party Creations, its employees, agents, or contractors from any and all liability, claims, damages, or injuries arising from the use of the photo booth at the event.
This waiver includes, but is not limited to, damages, injuries, or losses resulting from misuse or mishandling of the photo booth by the Renter or the Renter’s guests.
Indemnification: The Renter agrees to indemnify, defend, and hold harmless Pix $ Props Party Creations, its employees, agents, contractors, and affiliates from any and all claims, damages, losses, or expenses (including legal fees) arising from any injury or damage caused by guess and the misuse of the photo booth.
Equipment Damage: The Renter is responsible for any damage or loss to the photo booth or any of its components during the rental period cause by guest negligence. In the event of such damage, the Renter agrees to reimburse the Provider for the repair or replacement cost of the damaged equipment.
Compliance with Colorado Laws:
Business Licenses: The Provider is fully licensed to operate as a photo booth rental business in the state of Colorado. The Renter acknowledges that the Provider is in compliance with all local and state business regulations, including but not limited to business registration, insurance, and tax obligations.
Sales Tax: The rental fee for the photo booth is subject to applicable tax as required by Colorado state law. The Provider will add the necessary sales tax to the total rental cost and remit it to the appropriate state and local authorities. The Renter agrees to pay this tax as part of the rental fee.
Insurance Requirements:
The Provider carries commercial liability insurance in compliance with Colorado state requirements for event rental businesses.
The Renter acknowledges that they have been informed of their right to carry additional event insurance, should they wish to do so. The Provider is not responsible for enforcing these regulations, but will assist in providing a safe, clean environment for the event.
Public Health and Safety: The Renter agrees to comply with all local, state, and federal health and safety regulations in connection with the event, including any public health guidelines related to COVID-19 or other communicable diseases. The Provider is not responsible for enforcing these regulations, but will assist in providing a safe, clean environment for the event.
Miscellaneous:
Equipment Malfunction: In the unlikely event of an equipment malfunction that cannot be fixed on-site, the Provider will provide a backup booth or extend the rental period, at the Provider’s discretion.
Force Majeure: Neither party shall be liable for failure to perform their obligations under this Agreement due to causes beyond their reasonable control, including but not limited to acts of God, war, strikes, government restrictions, or natural disasters.
Photo Rights: The Provider reserves the right to use any photos taken during the event for promotional or marketing purposes only. The Renter agrees to allow Pix $ Props Party Creations to use these images without compensation. If the Renter does not agree, a written request must be submitted before the event.
Governing Law: This Agreement will be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflicts of laws principles.
Acknowledgement and Acceptance:
By signing below, the Renter acknowledges and agrees to all terms and conditions stated in this Photo Booth Rental Agreement, including the Liability Waiver and Indemnification Clause.
