General
Participants (each, a “Participant” or “you”) in any activity or program offered by the Niagara Cricket Club Inc. (“NCC”), including, but not limited to, District League and Niagara T20 /T25 ricket, should be aware of the possible risks inherent in participating in the sport of cricket. NCC strongly recommends that each Participant ensure that they are physically able to participate. Each Participant is responsible for their own personal health during District League or Niagara T20/T25 tournament games, including all practice drills, net practice sessions and other exercises at the cricket grounds. Each Participant must have personal accident and health insurance coverage.
In playing the sport of cricket it is possible for Participants to suffer common injuries including, but not limited to, cuts and bruises, serious muscle injuries, and serious bone fractures. By signing below, you hereby affirm that you are aware of your physical condition and that you are voluntarily participating in District League and/or Niagara T20/T25 cricket. You are aware that such participation may result in possible injury due to the nature of the sport of cricket, and that you are assuming any risk that may be involved. You further agree to be photographed or videotaped and/or during live streaming while photos/videos/live streaming to be used for the purpose of promotion of the District League or Niagara T20/T25 & T10 on various social and electronic media and/or for marketing and promotions of the game of cricket and sponsors.
As consideration for the right to participate in District League and/or Niagara T20/T25 & T10 Tournament and/or other activities and services provided by Niagara Cricket Club and the Niagara Cricket Centre, you, on behalf of yourself, your executors, administrators, heirs, next of kin, and successors, hereby covenant to hold harmless and indemnify NCC and Niagara Cricket Centre and all its officers, executives, agencies and employees from any and all claims, losses, damages, injuries, fines, penalties and costs, however, caused, resulting from, arising out of, or in any connection to your participation in the District League or Niagara T20 Tournament or related activities. This liability waiver and release extends to all persons involved including coaches, managers, players, parents, volunteers, and all other persons involved in the District League or Niagara T20 & T10 Tournament.
By signing below, you, or, if applicable, the minor which you are a guardian of that is named above, release and agree to hold NCC and Niagara Cricket Centre, its members, Board Members, employees, agents, and other representatives harmless from, and waive on behalf of yourself, your heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of Niagara Cricket Club or any NCC members, agents or representatives, or that may otherwise arise in connection with the District League or Niagara T20/T25 & T10 Tournament games, including Claims caused by the negligence of NCC or any of its members, agents, and representatives.
By signing below, you agree not to participate in any leagues or tournaments not sanctioned by Cricket Ontario and Cricket Canada. A list of sanctioned leagues is listed at www.cricketontario.com Any such participation in a non-sanctioned league or tournament by you will result in the termination of your membership with no refund of dues.
As a member of the club, you are fully responsible for your cleaning and housekeeping and treat the grounds and club with dignity and respect. You do not throw your gear, balls, and garbage all over the sports field. There are garbage cans provided that are to be used. At the end of the day, those bags are to be disposed of in the Blue Bin by Modern.
You understand that this waiver discharges and releases Niagara Cricket Club and the Niagara Cricket Centre from any liability or claim related to the occurrence of a COVID-19 infection that you, your heirs, or any personal representatives may have against Niagara Cricket Club and the Niagara Cricket Centre.
